Home My WebLink About12-21-10 ~ r ~'r~~ ~. 1 FAMILY SETTLEMENT AND FINAL RELEASE IN ' ~1~ ~~~C 2 ~ Pry ~~ ~~ ESTATE OF STEPHANY TACEY, DECEASED ~I..ER~ ~P ORPHAP~'~ C~'~1RT CLIME}cPl~~^a'°,i::~ ~;~~., PA, KNOW ALL MEN BY THESE PRESENTS, that WHEREAS, Stephany Tacey late of 1636 Benner Street, Philadelphia, PA 19149, deceased, died testate on May 12, .2009, having made her last will and testament, which was duly executed on, January 15, 2003, and is duly recorded in Cumberland County; WHEREAS, the said Stephany Tacey by the aforesaid last will and testament, named Theodore Cheski and Janine M. Farrell, as Executors of said last will and testament; WHEREAS, Theodore Cheski signed a renunciation, renouncing his rights sol~y to Janine M. Farrell on May 28, 2009 WHEREAS, letters testamentary on the estate of the said decedent were duly issued by the Register of Wills of Cumberland County, Pennsylvania, to the said Janine M. Farrell, hereinafter called personal representative on June 1, 2009. WHEREAS, the said personal representative has gathered the assets of the estate of the said decedent and the assets consists of both real property and personal property to a total gross estate value of $1,165,577.76, as set forth in Estate Tax Return of the Decedent which was filed with the Cumberland County Register of Wills and Exhibit A, which is a Summary of Distribution to Beneficiaries, which is attached hereto and made a part hereof; WHEREAS, the total debts and deductions of the estate equal $135,848.46, as set forth in Estate Tax Return of the Decedent which was filed with the Cumberland County Register of Wills and Exhibit A. Thereby reducing the gross estate value to a net estate value of $1,029,729.30. WHEREAS, after specific gifts pursuant to the will to Theodore Cheski and Henry Cichaczewski plus other final debts, including inheritance taxes in the said estate, a balance of $63,131.66 of personal property was left for disbursement to the heirs under the will. WHEREAS, this agreement may be executed in multiple counterparts, which said counterparts shall constitute a single Agreement. ~~~ NOW THEREFORE, KNOW YE, that we, BENEFICIARIES Theodore Cheski $27,357.06 Stephanie Panzienza $17,887.30 Janine M. Farrell $17,887.30 being all of the heirs under the last will and testament of the said decedent and being those persons entitled to inherit under said last will and testament do hereby each of us, acknowledge that we have this day had and received from the aforesaid personal representative, in full satisfaction and payment of all sum or sums of money, legacies, bequests, and devises as are given, devised and bequeathed to each of us respectively by the said last will and testament, the amounts due us under said last will and testament, which amount we shall receive upon the sale of the real estate, which amounts are in the amount set opposite our respective names in the table and schedule of distribution in said statement attached hereto and marked Exhibit A as well as the Estate Tax Return of the Decedent which was filed with the Cumberland County Register of Wills AND, we agree with the distribution schedule as set forth in the Estate Tax Return of the Decedent which was filed with the Cumberland County Register of Wills and Exhibit A; AND, each of us does hereby stipulate that in order to avoid the expense and time involved in the filing of a formal account and schedule of distribution, we each agree that no account is necessary and we do hereby agree that we do consent to distribution being made without the filing of an account and schedule distribution, the same to be with the same force and effect as if they had been filed and confirmed by the Orphans' Court Division of the Court of CUMBERLAND COUNTY. THEREFORE, we and each of us, do hereby remise, release, quitclaim and forever discharge the said personal representative, JANINE M. FARRELL, her heirs, Executors, and administrators, the Law Offices of Peter J. Russo, P.C. and assigns of and from the said estate and from all actions, suits, payments, accounts reckonings, claims and demands whatsoever for or by reason thereof, or for any other use, matter, cause or thing whatsoever, touching upon the estate of the said STEPHANY TACEY, and each of us do further hereby covenant and agree that should any liability come due to the estate of the said decedent after the signing of this agreement, we and each of us do hereby covenant and agree with each other and the estate to satisfy any and all claims, demands, suits, or causes of action which may be successfully prosecuted against the said estate of the aforesaid personal representative after the signing, sealing and delivery of this family settlement agreement and final release.
