On or about May 24, 2001, Plaintiff filed a Petition for the Release of Escrow Funds with the Prothonotary of Cumberland County. A true and correct copy of the time-stamped Petition is attached hereto and made a part hereof as Exhibit 2. Thereafter, on May 30, 2001, The Honorable Judge Edgar Bailey issued a Rule to Show Cause upon the Defendant providing Defendant ten (10) days from the date of the Rule to show why the Court should not grant the relief requested by Plaintiff. A true and correct copy of the Rule to Show Cause is attached hereto and made a part hereof as Exhibit "B". 3. Defendant has failed to file a response to the Rule to Show Cause within ten (10) days from the date of service as required by the Rule. Plaintiff, Property Management, Inc., is a Pennsylvania corporation having a business address of 1300 Market Street, Lemoyne, Cumberland County, Pennsylvania 17043, and is the duly authorized agent for Mountain View Road Associates with respect to the property located at 4183 Cove Court #105, Mechanicsburg, Cumberland County, Pennsylvania 17050 (,,Premises,,) . 2. Mountain View Road Associates is the owner of the ' Premises with a business address of 1300 Market Street, Lemoyne, -- Cumberland County, Pennsylvania 170~3 3. Defendant, Lisa Colwell., is an adult individual currently residin~ at 4183 Cove Court #105, Mechanicsburg, Cumberland County, Pennsylvania 17050. 4.. On or about February 1, 2000, Plaintiff, as Landlord, and Defendant, as Tenant, entered into a Rental Agreement for the Premises ("Lease"). A true and correct copy of the Lease is attached hereto and made a part hereof as Exhibit "A". 5. The initial term of the Lease commenced on February 1, 2000, and ended January 1, 2001. 6. Plaintiff and Defendant executed subsequent Lease amendments regarding other individuals who resided at the Premises with Defendant. · 7. Ail other terms and' conditions of the Lease remained the same. 8. Defendant took possession of the Premises on February 1, 2000. 9. The Lease provides, inter ali_~, that after the intial period, the Lease renews automatically for 60 days after which it continues to renew in 60 day periods unless 60 days, written termination notice is ~iven by either party. 10. The Lease further provides, inter ali~, that the resident may renew the Lease for one year by written request for .the prevailin~ market rent for the unit. 11. Defendant remains in possession of the Premises under the 60 day renewal provision of the Lease. _ 12. Pursuant to the terms of the Lease, Defendant is responsible for rent in the amount of $665.00 per month. 13. Pursuant to the terms of the Lease, Defendant also pays an additional charge of $20.00 per month to permit Plaintiff,s pet to enter the Premises. 14. Hereinafter, the rent and pet charges totaling $685.00 shall be known as "Rent,,. 15. The Lease provides, i_nter al i~, that a late charge of ten (10%) percent be added to any full or partial Rent no~ received in the office of the Landlord by the fifth day of the · month. 16. Pursuant to the terms of the Lease, in the event of default by resident, Landlord may take all actions necessary to · collect money due and Owin~ includin~ eviction if necessary. 17. Despite request, Defendant has failed to pay Rent for the months of March and April of 2001. " · ! 18 As a resulz of Defendan~ s failure to pay Rent due and -' Owing, Plaintiff filed a Landlord/Tenant Complaint for Rent due and owin~ and for possession of the Premises a~ains~ Defendant with the District Magistrate. 19. Judgment was entered in favor of Plaintiff and a~ains't Defendant for both money and possession, and this appeal followed. ~ C~OUNT I. 20. The averments contained in Paragraphs 1 through 19 of Plaintiff,s Complaint are hereby incorporated by reference as if set forth at length. 21. Defendant owes Plaintiff Rent, late char~es and District Justice Char~es as follows. Rent for March and April', 2001 $ 1,370.00' Late Fees for March and April, 2001 $ 137.00 District Justice char~es $- 81.50 TOTAL' $ 1,588.50 22. Despite demand, the $1,588.50 plus costs remains unpaid by Defendant. i · · · WHEREFORE, Plaintiff respectfully requests this Honorable Court to enter judgment a~ainst Defendant and in favor 'of · Plaintiff in the amount of $1,588.50 plus interest costs of suit and attorneys fees. Defendant remains in possession of the Premises without permission of Plaintiff. The averments contained in Paragraphs 1 through 25 of Plaintiff,s Complaint are hereby incorporated by reference as if -- set forth at length. 27. The Lease provides, inter ali_a, that the playing of radios, Stereos, TV or musical instruments between the hours of 11-00 p.m. and 8-00 a.m. is prohibited. At no time may any noise be audible OUtside of the apartment/house. · 28. The Lease further provides, i~nter ali~, that action by a resident or guest that causes Police Action or deprives the right of quiet enjoyment to other residents, is cause for eviction. 29. On November 9, 2000, the POlice responded to .a complaint at the Premises for a noise complaint for loud music after 11-00 P.m. 30. On February 4, 2001, the POlice responded to a complaint at the Premises re~ardin~ a nei~kborhood dispute. 31. On February 15, 2001, the Police responded to a complaint at the Premises for a noise complaint involvin~ loud music at 11-40 P.m. .. 32. On March 6, 2001, the Police responded to a noise COmplaint at 11-05 a.m. 33. On March 17, 2001, the Police responded to a COmplaint at the Premises for a domestic dispute. True and COrrect copies of the Police incident reports for the above COmplaints are attached hereto and made a part hereof as Exhibit "B,, · 34. The actions of Defendant caused the need for Police Action and deprived Other residents of their quiet enjoyment on ~ five different Occasions. 35. Defendant,s actions', which Caused the Police Action are in violation of the Lease. , 36. Defendant is in default Under the terms of the Lease for breachin~ the provisi'ons re~ardin~ quiet enjoyment and police action, but for failure to pay Rent when due as set forth in Count /'of this Complaint. 37. Plaintiff, Property Management, Inc., is a Pennsylvania corporation having a business address of 1300 Market Street, Lemoyne, Cumberland County, Pennsylvania 17043, and is the duly authorized agent for Mountain View Road Associates with respect to the property located at 4183 Cove Court #105, Mechanicsburg, Cumberland County, Pennsylvania 17050 ("Premises") . 2. Mountain View Road Associates is the owner of the Premises with a business address of 1300 Market Street, Lemoyne, Cumberland County, Pennsylvania 17043. 3. Defendant, Lisa Colwell, is an adult individual currently residing at 4183 Cove Court #105, Mechanicsburg, Cumberland County, Pennsylvania 17050. 4.. On or about February 1, 2000, Plaintiff, as Landlord, and Defendant, as Tenant, entered into a Rental Agreement for the Premises ("Lease"). A true and correct copy of the Lease is attached hereto and made a part hereof as Exhibit "A". 5. The initial term of the Lease commenced on February 1, 2000, and ended January 1, 2001. 6. Plaintiff and Defendant executed subsequent Lease amendments re~ardin~ other individuals who resided at the Premises with Defendant. 7. Ail other terms and conditions of the Lease remained the same. 8. Defendant took possession of the Premises on February 1, 2000. 9. The Lease provides, inter alia, that after the intial period, the Lease renews automatically for 60 days after which it continues to renew, in 60 day periods unless 60 days' written termination notice is ~iven by either party. 10. The Lease further provides, inter al ia, that the resident may renew the Lease for one year by written request for the prevailin~ market rent for the unit. 11. Defendant remains in possession of the Premises under the 60 day renewal provision of the Lease. 12. Pursuant to the terms of the Lease, Defendant is responsible for rent in the amount of $665.00 per month. 13. Pursuant to the terms of the Lease, Defendant also pays an additional charge of $20.00 per month to permit Plaintiff' s pet to enter the Premises. 14. Hereinafter, the rent and pet char~es totalin~ $685.00 shall be known as "Rent',. 15. On November 9, 2000, the Police responded to a complaint at the Premises for a noise complaint for loud music after 11-00 p.m. 30. On February 4, 2001, the Police responded to a complaint at the Premises re~ardin~ a neighborhood dispute. 31. On February 15, 2001, the Police responded to a complaint at the Premises for a noise complaint involvin~ loud music at 11-40 p.m. 32. On March 6, 2001, the Police responded to a noise complaint at 11-05 a.m. 33. On March 17, 2001, the Police responded to a complaint at the Premises for a domestic dispute. Placey entered a Judgment for Possession on behalf of Plaintiff and against Defendant for property located at 4183 Cove Court #105, Mechanicsburg, Pennsylvania (,'Premises"), 91us a monetary judgment in the amount of $685.00. A true and correct copy of the Notice of Judgment is attached hereto and made a part hereof as Exhibit "A". 2. On March 30, 2001, Defendant filed a Notice of Appeal from District Justice Judgment and Rule to File a Complaint was issued to Plaintiff. 3. As part of the Appeal filed by Defendant, a Supersedeas was issued and monthly rental payments were made to the Prothonotary of Cumberland County. A true and correct copy of the Notice of Appeal containing the Supersedeas is attached hereto and made a part hereof as Exhibit "B". 4. On or about April 18, 2001, Plaintiff filed a Complaint for both money and possession of the Premises. A true and correct copy of Plaintiff's Complaint is attached hereto and made a part hereof as Exhibit "C". 5. Despite bein~ provided the proper Important Notice, Defendant failed to answer Plaintiff's Complaint. 6. On May 21, 2001, Plaintiff entered Default Judgment for Money in the amount of $1,604.38 representin~ the amount requested in the Complaint plus interest. A true and correct copy of the Default Judgment for Money is attached hereto and made a part hereof as Exhibit "D". 7. On May 21, 2001, Plaintiff also entered a Default Judgment for Possession a~ainst Defendant. A true and correct copy of the Default Judgment for Possession is attached hereto and made a part hereof as Exhibit "E". 8. Defendant has paid $835.00 to the Prothonotary of Cumberland County for the Appeal and Supersedeas. 9. Plaintiff is entitled to the money bein~ held in escrow by the Prothonotary of Cumberland County pursuant to Pa R.C.P. D.J. No. 1008 and as a result of the Default Judgments. On February 4, 2001, the Police responded to a complaint at the Premises re~ardin~ a neighborhood dispute. 31. On February 15, 2001, the Police responded to a o~. complaint at the Premises for a noise complaint involvin~ loud music at 11-40 p.m. ,. 32. On March 6, 2001, the Police responded to a noise complaint at 11-05 a.m. 33. On March 17, 2001, the Police responded to a complaint at the Premises for a domestic dispute. True and correct copies of the Police incident reports for the above complaints are attached hereto and made a part hereof as Exhibit "B". 34. The actions of Defendant caused the need for Police Action and deprived other residents of their quiet enjoyment on at least five different occasions. 35. I OBSERVED JARED DEPARTING THE APARTMENT -- ABOUT THE SAME TIME AND SPOKE BRIEFLY WITH HIM TELLING HIM HE WAS 20 YRS OLD AND SHOULD GROW UP STOP ACTING LIKE A KID I ALSO TOLD HIM I ALREADY GOT A NOISE COMPLIANT IN THE FEW MINUTES I WAS GONE HE REPLIED IT WAS JUST THE NIEGHBOR LIKE IT WAS NOTHING TO BE CONCERNED WITH.
