Plaintiff, Rockford Cabinet and Millwork Company, Inc. ("Plaintiff'), is a Delaware corporation with its principal place of business located at 4200 Governor Printz Boulevard, Wilmington, Delaware 19809. Plaintiff files this mechanics' lien claim as a subcontractor. 2. The owner of the property subject to the lien is The Great Commission Care Communities, Inc. d/b/a The Woods at Cedar Run ("Great Commission"), a Pennsylvania non-profit corporation. Great Commission's registered office is located at 824 Lisburn Road, Camp Hill, Pennsylvania, 17011. 3. The date on which Plaintiff completed the work for which this claim is made on June 28, 2010. A true and correct copy of Plaintiff s subcontract, including all change orders, is attached hereto as Exhibit "A." Plaintiff provided formal notice of its intention to file this claim to Great Commission, the owner of the property subject to this mechanics' lien claim, on July 26, 2010. A true and correct copy of the formal notice is attached hereto as Exhibit "B." 5. This mechanics' lien claim is made for Plaintiff s furnishing of the following materials: Item Description Room Amount 1. ("Rockford"). This letter serves as formal notice of Rockford's intention to file a mechanic's lien claim for their work on the above-referenced property, which is located at 824 Lisburn Road, Camphill, PA 17011. Rockford contracted with and served as a labor and materials subcontractor to subcontractor, Brandywine Millwork, for work performed on the above-referenced property. Rockford is due the sum of $26,040.43 for furnishing and installing cabinet, countertop and shelving materials in certain of the areas in the above-referenced property. Rockford completed the work for which it is making this claim on June 28, 2010. As of the date hereof, the sum due has not been paid. In the event that the $26,040.43 is not paid to Rockford within thirty (30) days of the date of this letter, we intend to file a mechanic's lien for our work on the property. On December 22, 2010, Rockford filed a mechanics' lien claim against Great Commission, the owner of the property claimed to be subject to the lien, located at 824 Lisburn Road, Camp Hill, Pennsylvania. 2. Section 1701(b) of the Mechanics' Lien Law requires that "an action to obtain judgment upon a claim shall be commenced within two (2) years from the date of filing unless the time be extended in writing by the owner." 49 P.S. § 1701(b). 879882.1 3. More than two years have passed since Rockford filed the above-captioned mechanic's lien claim against Great Commission. 4. Great Commission has not agreed to extend the two year time period for filing an action to obtain judgment on the mechanics' lien claim. 5. Accordingly, the mechanics' lien claim filed by Rockford is invalid and should be stricken, with prejudice. The Rule was returned as undeliverable. It was subsequently discovered that Mr. Cianci is no longer with The Chartwell Law Offices, and that Chartwell's Wilmington, Delaware office closed last year. Notwithstanding this fact, Mr. Cianci nor The Chartwell Law Office withdrew as counsel for Rockford. 6. Accordingly, on August 2, 2013, counsel for Great Commission served the Rule directly upon Rockford via First Class U.S. Mail. See correspondence dated August 2, 2013 addressed to Rockford and enclosing a copy of Great Commission's Motion to Strike and Order with Rule to Show Cause attached hereto and marked as Exhibit"B." 7.
