No. COMPLAINT 1. Plaintiff State Farm Fire and Casualty Company is an insurance company licensed and authorized to conduct business in the Commonwealth of Pennsylvania and having as one of its principal places of business the above captioned address. 2. Richard Ladka is an adult individual insured by Plaintiff State Farm Fire and Casualty Company. 3. Defendant Hamer's Appliance Service is a business entity located at the above captioned address. 4. On June 21, 2010, Plaintiff State Farm Fire and Casualty Company insured Richard Ladka with a homeowners policy, number 38-PQ-5603-8, said policy covering the property located at 571 Grahams Woods Road in Carlisle, Cumberland County, Pennsylvania and carrying with same, structure and contents coverages 5. On or about February, 2005 Plaintiff's insured, Richard Ladka hired Defendant Hamer's Appliance, or Hamer's Appliances was assigned to perform repair work at the Plaintiff's home, following a recall on a heating element in the dishwasher. 6. As the result of the Defendant acting by and through their agents, servants, workmen, sub-agents and/or employees tomake a repair on the dishwasher unit, a water leak took place which resulted in damage to the flooring and water protruding to the lower level at the Ladka residence, saturating the drop ceiling. 7. On or about June 21, 2010 as a result of the negligent and or careless installation, inspection, service, testing and or repair of the dishwasher by Defendants, said leak took place, resulting in extensive water damages to the structure and contents of Plaintiff's insured's property. 8. . The negligence of the Defendant consisted o£ a) Improper inspection of the dishwasher and its component parts; b) Improper testing of the dishwasher; c) Failing to properly prepare and/or install the dishwasher and its replacement parts; d) Hiring and using unskilled and/or unlicensed contractors, e) failing to warn plaintiff of the hazards associated with improperly installed parts; f) failing to make proper connection of the water supply line to the dishwasher and or water source g) failing to properly secures the water lines wile performing work on the system, h) failing to perform the installation is a professional and workmanlike manner and free from defect; i) other such negligence that may be developed through continuing discovery and trial of this matter. 9. The aforesaid water discharge resulted solely from the negligent acts and/or omissions on part of Defendant named herein and were due in no manner whatsoever to any act and/or failure to act on part of Plaintiff s insured. 10. As a result of the aforesaid water discharge, Plaintiff State Farm Fire and Casualty Company settled the first party claims of Richard Ladka in the amount of $5,519.00 (said figure includes Plaintiff s insured's first party deductible) representing fair and reasonable reimbursement for the damages sustained. 11. Pursuant to the aforesaid policy of insurance, Plaintiff Farmers Insurance Co. is subrogated to Richard Ladka for this loss. WHEREFORE, Plaintiffs demand judgment against the Defendant in the of $ 5,519.00 plus costs, interest and such other relief this finds equitable and just.
