Z/-/D-I PETITION TO ADMIT COPY OF ORIGINAL WILL TO PROBATE t" AND NOW this ~1 day of December, 2010, comes Petitioner, ROBE by and through his attorneys, Irwin & McKnight, P.C., and respectfully petiti admit to probate a copy of the original Last Will and Testament of the Dec Suders, and in support thereof avers as follows: 1. Petitioner is Robert R. Suders, the son of Martha S. Suders (the died on November 30, 2010, a resident of 114 West Orange Street, Shippens County, Pennsylvania. 2. Decedent was predeceased by her spouse, John M. Suders, born J 3. Decedent's spouse, John M. Suders, died on March 8, 1992. 4. The sole heirs and relationship to the Decedent are as follows: James D. Suders -Son Lester E. Suders -Son Robert R. Suders -Son Jeffrey L. Suders -Son Kathleen M. Helman -Daughter 5. On September 9, 1986, Decedent executed a Last Will and T prepared by her attorney, Sally J. Winder. PLEAS OF vSYLVANIA ,, r°~ a n~ ~~ ;cam this Court to Martha S. who Cumberland 11, 1921. which was ~~~' , ~~.~ 6. Decedent executed the Last Will and Testament at the office of a 'attorney, Sally J. Winder, in her presence and in the presence of Beth Spahr and John Mc r a, III, both of whom acted as subscribing witnesses. j I 7. The heirs listed in Pazagraph 4 of this Petition aze entitled to I equal shaze of Decedent's estate, as listed in the Decedent's Last Will and Testament. 'I 8. Petitioner is the named Executor under the Last Will and T stament dated September 9, 1986. A true and correct copy of the Last Will and Testament to September 9, 1986, bearing the signatures of Decedent, her attorney, and the subscribing wi a ses is attached hereto and incorporated herein as Exhibit "A." ~~ 9. The copy of Decedent's Last Will and Testament attached as bit "A" was located along with her other important paperwork and documentation, including records. 10. Decedent's attorney, Sally. J. Winder, is unable to locate the orig' al Last Will and Testament of Decedent dated September 9, 1986 and believes the orig' ast Will and Testament was given to Decedent for safe-keeping. I 'i 11. After diligent seazch, Petitioner has been unable to locate the o 'ginal will of Decedent dated September 9, 1986, a copy of which is attached hereto as Exhib t ` A," and upon information and belief avers that the original was not revoked or destroyed by De a ent. 12. Furthermore, Petitioner is not aware of Decedent executing or ~a ing prepazed any subsequent will to that prepared and signed by Decedent on September 9, 196. I~ ~li 13. The assets of Decedent's estate include a checking account wi &M Bank and real estate located at 114 West Orange Street, Shippensburg, Pennsylvania. 14.
