STIPULATION AGAINST LIENS
THIS AGREEMENT made this ~~ 5`- day of ~2C~vtt~3~-+CL 2010, by
and between
HOFFMAN'S CUSTOM CONTRACTING, INC. a Pennsylvania corporation,
hereinafter referred to as Contractor,
AND
TERESA A. DOWS, hereinafter referred to as Owner, whereby the
contractor undertook and agreed to erected and construct a single
family dwelling situate in South Middleton Township, Cumberland
County, Pennsylvania and more fully described in Exhibit "A" which
is attached hereto and made a part hereof known as Lot 108,
Netherby Lane, Boiling Springs, PA 17007.
NOW THEREFORE, THIS AGREEN~NT WITNESSETH: That the said
Contractor, for an in consideration of the sum of (51.00) Dollar
to Contractor in hand paid by Owner, the receipt whereof is hereby
acknowledged, and the further consideration mentioned in the
agreement aforesaid, for itself, himself or themselves and its,
his or their subcontractors, and all parties acting through or
under them, covenant and agree that no mechanic's liens or claims
shall be filed or maintained by them or any of them against the
said buildings and the lot of ground appurtenant thereto for or on
account of any work done or materials furnished by them or any of
them under said contract or otherwise, for, towards, in, or about
the erection and construction of the said buildings on the lot
above described, and the said Contractor, for itself, himself or
themselves, its, his or their subcontractors and others under
them, hereby expressly waive and relinquish the right to have,
file, and maintain any mechanic's liens or claims against the said
buildings or any of them, and agree that this instrument, waiving
the right of lien, shall be an independent covenant.

On this, the ~ day of ~~ ~,i, 2010, before me a
Notary Public, the undersigned officer, personally appeared
Timothy D. Hoffman who acknowledged himself to be the President
of Hoffman's Custom Contracting, Inc. a Corporation, and that he
as such President, being authorized to do so, executed the
foregoing instrument for the purposes therein contained by
signing the name of the said Corporation by himself as such
President.
IN WITNESS WHEREOF, I hereunto set my hand and official
seal.
Exhibit A
ALL THAT CERTAIN tract of land situate in South Middleton Township,
Cumberland County, Pennsylvania, bounded and described according to the Final
Subdivision Plan for Phase Number Two-The Plan of Netherby prepared by
Dawood Associates dated 4/24/05 and revised through 4/13/07 and recorded in
Cumberland County, Pennsylvania Plan Book 94., Page 39, as follows, to wit:
BEGINNING at a point on the right of way line of Netherby Lane (50'ROW) at the
southeastern corner of Lot No. 107 on the above Plan; thence along said Lot No.
107, North 34 degrees 00 minutes 33 seconds East 137.66 feet to a point; thence
along future Phase IV Lot No. 89 on the above Plan, South 55 degrees 59 minutes 27
seconds East 124.93 feet to a point; thence along Lot No. 87 on the above Plan,
South 34 degrees 00 minutes 33 seconds West 137.66 feet to a point on said Netherby
Lane; thence along the dedicated right of way of said Netherby Lane, North 55
degrees 59 minutes 27 seconds West 124.93 feet to a point, the point and place of
BEGINNING.
BEING Lot No. 108 on the Final Subdivision Plan for Phase Number Two-The Plan
of Netherby.
BEING a portion of the same premises which Raymond E. Diehl and Donald E.
Diehl by their deed dated 12/4/09 and recorded 12/10/09 in Instrument #200941227,
granted and conveyed unto Raymond E. Diehl and Donald E. Diehl.
