Plainfi~ Refinance America, LTD, is a Colorado corporation and service is accepted in Pennsylvania at the address of Plaintiff's Pennsylvania counsel, Robert M. Reibstein, 705 Montgomery Avenue, Narberth, Pennsylvania. 2. Defendant, Susan J. English Burylo, is an individual residing at 731 Torway road, Czrdners, Cumberland County, Pennsylvania. 3. Defendant accepted a credit card from a credit card issuer, FIRST USA, N.&, under ~unt number 4417 1228 0724 6674, as evidenced by the annexed Acc~tance Certificate, a copy of which is annexed hereto as exhibit "A", with the understanding that use of this credit card ~unt would be subject to the card holder agreement, a copy of which is attached hereto and marked Exhibit 4. On various ~ions, from time to time, the credit card issued to Defendant by FIRST NA was used by Defendant, or others with Defendant's consent, to make purchases of merchandise or services, which purchases were paid by FIRST USA, NA under it's credit card progrmn, or to obtain cash advances from FIRST USA, NA. 5. Pursuant to the card holder agreement, defendant was indebted to FIRST USA, NA in the sum of $5,851.93 being the balance due on the credit card as of the date of charge o~ September 11, 1998. 6. Plaintiff further alleges that there was an account stated by operation of law between FIRST USA, NA and Defendant wherein FIRST USA, NA billed Defendant for the credit card acx~unt balance and rec~ved no timely objections to such billing, as per the attached copy of such billings marked as Exhibit "C". 7. On or about October 10, 1998, FIRST USA, NA assigned the debt for good and valuable consideration to Plainfifl~. A copy of the Certificate of Assiglm~ent is annexed hereto as Exhibit "D". 8. Plaintiff is entitled to recover pre-litigation interest as permitted by the card holder agreement annexed hereto as Exhibit "B'"'. Interest is caloflated at the annual percentage rate of 12.99°/3 as per the attached billing wherein as to the date of the filing of this Complaint, Plaintiff is entitled to an additional sum of $1,521.07. 9. As per Exhibit "B", Plaintiff is entitled to reasonable attorneys fees for the lawl~ collection of this debt billed at Plaintiff's previous attorney and Plaintiff's current attorney's normal hourly fee of $175.00 per hour totaling $2,800.00 through the time of the filing of this Common Pleas Complaint 10. PlaimJff's reasonable attorneys fees continue at Plaintiff's attorney's normal hourly fee orS175.00 per hour. 11. The Defendant, in accepting the credit card ~unt, did promise to pay said sums upon demand. Payment has been demanded and has not been made. On or about November 6, 1996, Defendant sent a check for $4,800.00 to First USA, NA along with a letter explaining that it was for payment in full of the balance of her credit card account, which instructed First USA, NA to close the account from any further purchases. 12. When the $4800.00 payment was remitted to First USA, NA Defendant had already withdrawn authorization for anyone to utilize the First USA account. 13. After instructing First USA, NA to close her account, Defendant never received a further statement or communication from First USA, NA until after the account had been charged off and the company began telephoning her for payment. 14. In accordance with the credit card holder agreement between First USA, NA and Defendant, Defendant notified First USA, NA as soon as she herself became aware that the card had been stolen and was being used without authorization. 15. There was a delay in Defendant's knowledge of the theft, because it is believed, therefore averred, that her mail was stolen along with the card after Defendant closed the credit card account in November of 1996. 16. During the time from November 1996, until the billing address was changed with First USA, NA, an individual known as Angie O'Keefe was living in Defendant's home. 17. While Angie O'Keefe had access to Defendant's mail at all times during her residence in Defendant's home, she was never authorized to utilize her First USA card.
