COMPLAINT
I. Plaintiff Belinda Riggleman is an adult individual residing at 446 West Main Street,
Walnut Bottom, Cumberland County, PA l7266.
2. Defendant Stephanie Kiner is an adult individual residing at 196 Shippensburg Mobile
Estates, Shippensburg, Cumberland County, PA l7257.
3. On or aboutJune 16, 2003, Plaintiff owned a 200l Pontiac Sunfire with Pennsylvania
registration plates DVT60l4.
4. On the aforesaid date, Defendant was operating Plaintiff's vehicle without Plaintiff's
permission and traveling north on Kline Road, Shippensburg, Cumberland County, P A.
5. On the aforesaid date, at approximately 1 1 :55 p.m., Defendant lost control of
Plaintiff's vehicle and collided with a Pennsylvania Department of Transportation sign on the west
side of Kline Road.
COUNT I - NEGLIGENCE
6. Plaintiff incorporates and makes part of this Complaint paragraphs 1 through 5 above,
as if the same were set forth fully below.
7. The aforementioned collision was caused as the result of the negligence, recklessness,
and carelessness of Defendant Stephanie Kiner in that she:
a. operated a vehicle in a careless, reckless, and negligent manner;
b. failed to properly operate and control the vehicle;
c. operated the vehicle in careless disregard for the safety of Plaintiff s property
(75 Pa. C.S.A. 93714);
d. failed to keep a proper look out;
e. failed to drive at a safe speed (75 Pa. C.S.A. \)336l);
f. failed to use due care under the circumstances;
g. operated the vehicle in disregard ofthe Rules of the Road, the ordinances of
the local municipality and the laws of the Commonwealth of Pennsylvania,
including, but not limited to 75 Pa. C.S.A. 93745, 75 Pa. C.S.A. 93746, 75
Pa. C.S.A. 9l50l, and 75 Pa. C.S.A. \)3361.
8. At all times material hereto, Plaintiff acted with due care and was not contributorily
negligent.
9. The collision caused damage to the Plaintiffs vehicle in the amount of$4,277.66. A
true and correct copy of the estimate of property is attached hereto as Exhibit "A."
10. As a result of Defendant's negligence, Plaintiff was required to rent a vehicle totaling
$575.00. A true and correct copy of the rental invoice is attached hereto as Exhibit "B."
WHEREFORE, Plaintiff demands Judgment against Defendant in the amount of$4,852.66,
exclusive of interest and costs; an amount within compulsory arbitration limits.
COUNT II - TRESPASS TO CHATTEL
1 1 . Plaintiff incorporates and makes part of this Complaint paragraphs 1 through 10 above,
as if the same were set forth fully below.
l2. Defendant intentionally and unreasonably interfered with Plaintiff s use, exclusive use
and enjoyment of her vehicle, proximately causing injury to the Defendant.
13. Defendant intentionally invaded Defendant's reasonable and legitimate interest in her
property, proximately causing injury to the Plaintiff.
l4. Defendant intentionally used and substantially intermeddled with the chattel in the
possession of the Plaintiff, proximately causing injury to the legally protected interests of the
Plaintiff.
15. Plaintiff demanded compensation for the losses she sustained. Defendant has failed
to pay.

WHEREFORE, Plaintiff demands Judgment against Defendant in the amount of$4,852.66,
exclusive of interest and costs; an amount within compulsory arbitration limits.

PARTS LOCATIONS: OEM parts can be obtained at an OEM dealership. The
names of where any non-OEM parts used can be purchased is listed above
AFTERMARKET CRASH PARTS (AFTERMARKET or AFTERMARKET CAPA):
A non-original equipment manufacturer (non-oem) replacement part,
either new or used, for any of the non-mechanical parts that
genreally constitute the exterior of the motor vehicle, including
inner and outer panels. This appraisal will indicate if aftermarket
crash parts are specified by stating "Aftermarket" or "Aftermarket
CAPA". If use of such parts voids the warranty on the part being
replaced or any other part, the aftermarket crash part shall have a
warranty equal to or better than the remainder of the existing
warranty.
QUALITY RECYCLED PARTS/USED(QUAL RECYCLED PART):If appraisal specifies
recycled parts they must be of like kind and quality or better than
those being replaced.
SUPPLEMENTAL
AUTHORIZATION TO REPAIR: This is not an authorization to repair
Vehicle owner is responsible for authorizing shop to begin repairs.
If vehicle owner is a third party or claimant, the insurance company
should be contacted to confirm liability coverage before authorizing
repairs.
CUSTOMER CHOICE OF SHOPS: Selection of the repair shop is the
responsibility of the vehicle owner. Vehicle owner is under no
obligation to use any specific repair shop. The insurer will
provide, upon request, information regarding repair facilities that
will be able to repair the vehicle for the appraised amount.
CHARGES DISCLAIMER: Any additional towing or storage charges incurred
may become the responsibility of the vehicle owner after a time
frame determined by the insurer.

SETTLEMENT AGREEMENT
WHEREAS, Plaintiff, Belinda Riggleman, has instituted suit against Defendant, Stephanie
Kiner, at the above number and term for property damage resulting from a motor vehicle accident
on or about June 16,2003; and
WHEREAS, Defendant does not dispute Plaintiffs claims; and
WHEREAS, the parties have reached an agreement in full settlement and compromise of all
claims.
NOW, THEREFORE, the parties hereto, intending to be legally bound hereby, agree as
follows:
1. Defendant agrees to the entry of Judgment against him and in favor of Plaintiff in the
amount of $4,852.66, plus costs of suit and interest accruing at the statutory rate of 6% per annum
from date of Judgment.
2. Defendant agrees to pay the Judgment in full by making a down payment of$250.00
and 54 consecutive monthly payments of$99.55 to Plaintiff on or before the Sixteenth of each month
beginning September 1 6,2004. Plaintiff agrees it will not issue execution against Defendant unless
he defaults in making any monthly payment of said sum.
3. All payments shall be made payable to "MDW&O" and sent to MDW&O, Attn:
Christopher E. Rice, Esquire, lO East High Street, Carlisle, PAl 70 1 3.
4. At the time of execution hereof, each party shall execute a Stipulation and Agreement
for Entry of Judgment which shall be presented to the Court upon motion of Plaintiff.
5. Upon payment of the Judgment amount, Plaintiff shall promptly have the Judgment
marked satisfied in the Office of Prothonotary.
6. Nothing herein shall be construed to prevent Plaintiff from transferring the Judgment
to other counties or states or to otherwise limit its rights as a motor vehicle judgment creditor.
7. Nothing herein shall be construed to prevent Plaintiff from filing a separate action
for additional collection or attorneys' fees if Defendant breaches any provision of this Settlement
Agreement.
8. Nothing herein shall be construed to prevent Plaintiff from filing a Certification of
Motor Vehicle Judgment with the Bureau of Driver Licensing if Defendant breaches any provision
ofthis Settlement Agreement.
