STONER I , RONALD L. STONER, of Boiling Springs, Cumberland County, Pennsylvania, being of sound mind, memory and understanding, do hereby make, publish and declare this as and for my Last Will and Testament, hereby revoking all other Wills and Codicils heretofore made by me. FIRST I direct the payment of my debts and expenses of my last illness and funeral from my estate as soon after my death as conveniently may be done. I direct that my body be cremated and that the ashes be placed in a suitable container and thereafter be retained at the directions of my wife, Rebecca L. Waddell. SECOND All my personal effects, clothing, furniture, furnishings, jewelry, automobiles, other tangible personal property of every kind, and insurance thereon, I give in accordance with a memorandum which accompanies my will. To the extent that such memorandum fails to dispose of all personal property or if the memorandum is not in . ~ U~ ex~tence ~t~ny death, then I give the same to Rebecca L. Waddell, my spouse, if she ` ~ ~o ~ '~ suPwve~r a period of sixty days. If she shall not so survive me, then I give the same ~ Y~~ ~? ~ c.~ ~ ~~ o m `~ o 0 N to my eldest daughter, Christine Hummell. Any items not so disposed of shall be sold by my personal representative and the proceeds added to my residuary estate. THIRD If my wife, Rebecca L. Waddell, shall survive me, I give and devise to my wife, during her lifetime and until her remarriage, my house and the insurance thereon, together with all the furniture, furnishings, household articles, and the insurance thereon, without liability for waste, until the earlier of her death or remarriage. Upon the death or remarriage of my wife, or at such time as my wife is no longer able to independently reside in my house, whichever event first occurs, I give and devise my house and the furniture, furnishings, and household articles and insurance thereon to my eldest daughter, Christine Hummell. As long as my wife uses the premises, she shall pay all costs of maintenance, utilities, repairs, insurance, mortgage, taxes and special assessments. My wife shall not be required to post bond as the life tenant. My eldest daughter, Christine Hummell, shall resolve any dispute as to whether my wife qualifies to continue to retain her possessory interest in such property. FOURTH All the rest, residue and remainder of my estate, of whatsoever nature, and wheresoever situate, I give, devise and bequeath unto Rebecca L. Waddell, my spouse, provided she survives me by sixty (60) days. 2 FIFTH In the event Rebecca L, Waddell, my spouse fails to survive me by sixty (60) days, or in the event that she disclaims any interest hereunder, I give the rest, residue and remainder of my estate, to my eldest daughter, Christine Hummell. If my said eldest daughter is not living at the time of my death then I leave my residuary estate to my nephew Charles Smith. SIXTH In addition to the powers conferred by law, I authorize my personal representative, in his or her absolute discretion: A. To retain in the form received and to sell either at public or private sale, any real or personal property; and B. To manage real estate; and C. To invest and reinvest in all forms of property without being confined to legal investments and without regard to the principal of diversification; and D. To exercise any option or rights arising from ownership of investments; and E. To compromise claims without court approval and without the consent of any beneficiary, but not limited to claims by the Commonwealth of Pennsylvania with respect to inheritance taxes on any future interest passing under this will. F. To continue the operation of any business that I may own at the time of my death for the period of time and in the manner that he, she or it considers advisable and to be in the best interest of my estate, or to sell, or to liquidate the business at the time and on the terms and conditions that he, she, or it considers advisable and in the best interests of my estate. 3 SEVENTH All shares of principal and income herein given shall be free from anticipation, assignment, pledge or obligation of any beneficiary and shall not be subject to any execution or attachment. EIGHTH I direct that any and all inheritance, estate and transfer taxes imposed upon my estate passing under my Will or otherwise, shall be paid out of the principal of my residuary estate. NINTH I nominate, constitute and appoint Rebecca L. Waddell, my spouse, as personal representative of this my Last Will and Testament. In the event of the renunciation, death, resignation or inability to act for any reason whatsoever of my spouse, I nominate, constitute and appoint my eldest daughter, Christine Hummell, as personal representatives of this my Last Will and Testament. I hereby relieve my personal representatives from the necessity of posting security in connection with duties as such in any jurisdiction in which my personal representatives shall be called upon to act insofar as I am able by law to do so.
