GORDON 186 Booz Road Shippensburg, Pennsylvania 17257 CIVIL ACTION COMPLAINT Plaintiff, TELE-PLUS CORPORATION, with an office located at 916 Eldridge Drive, Hagerstown, MD 21740, by way of Complaint against the above named Defendants say: 1. Defendant, LEROY K. GORDON a/k/a Kenny Gordon, is an adult individual residing at 186 Booz Road, Shippensburg, Pennsylvania 17257. 2. Defendant, KAREN E. GORDON, is an adult individual residing at 186 Booz Road, Shippensburg, Pennsylvania 17257. 3. On or about May 24, 2008, Defendants executed and delivered to Plaintiff a General Sales Agreement. 4. Plaintiff provided and delivered to Defendants certain equipment, goods, wares, merchandise and/or services, as is more specifically shown by Plaintiff's General Sales Agreement, a true and correct copy of which is attached hereto marked Exhibit "A" and made a part hereof. 5. Defendants received and accepted the aforementioned equipment, goods, wares, merchandise and/or services. 6. The prices charged by Plaintiff were fair, reasonable and market prices that prevailed at the time(s) of the transaction(s). 7. The prices charged by Plaintiff were the prices that Defendants agreed to pay. 8. The agreement of open account between the parties arose from words, course of dealing, and the aforementioned document(s). 9. Plaintiff avers that all conditions precedent to the Defendants' duty of performance under said agreement have occurred. 10. Plaintiff avers that the balance due amounts to $3,207.27. 11. Plaintiff avers that interest has accrued at 18% per annum per the Agreement on the balance due from September 21, 2009 to August 12, 2010 in the amount of $1,091.30. 12. Although repeatedly requested to do so by Plaintiff, Defendants have willfully failed and refused to pay the amount due Plaintiff or any part hereof. WHEREFORE, Plaintiff demands Judgment against the Defendants, LEROY K. GORDON a/k/a Kenny Gordon and KAREN E.
