NO: 4 - (21 c? L ?ER S?r'1 V. CIVIL ACTION - LAW BRADSHAW LEE HANDY, a/k/a BRADLEY LEE HANDY Defendant. COMPLAINT AND NOW, comes Plaintiff by and through her attorneys, Post & Schell, P.C., and in support of this Complaint, avers the following: 1. Plaintiff Stacey Odogwu is an adult individual with an address of 240 Grandview Avenue, Camp Hill, Cumberland County, PA 17011. 2. Defendant Bradshaw Lee Handy, a/k/a Bradley Lee Handy is an adult individual with an address of P. O. Box 1383, Cockeysville, Maryland 21030, 3. The parties entered into a series of agreements pursuant to which Defendant Handy borrowed money from Plaintiff Odogwu. 4. Defendant Handy borrowed $10,000.00 in cash which Plaintiff Odogwu obtained from her Waypoint credit card. 5. Plaintiff Odogwu also borrowed $1,500.00 from her State Farm credit card, and loaned it to Defendant Handy. 6. On February 2, 2004, the parties signed an agreement whereby Defendant Handy agreed to pay Plaintiff Odogwu $17,500.00, plus a year of gym facility fees. 7. Defendant Handy represented that this money would be repaid within thirty (30) days of the loan. 8. Defendant Handy has refused to pay all or any part of the money, and has accordingly breached the agreement. 9. A true and correct copy of the agreement between the parties is incorporated hereby and attached hereto as Exhibit "A." 10. At the present time, an amount is due and owing from Defendant to Plaintiff of $19,000.00, with interest at 19.99% for part of the indebtedness represented by the Waypoint credit card, as well as interest on the other credit card debt. 11. Plaintiff Odogwu has been harmed by the default of Defendant Handy in the amount of $19,000.00. COUNT I - BREACH OF CONTRACT 12. The averments of Paragraphs 1 - I 1 of this Complaint are incorporated herein by reference as if set forth fully and at length. 13. The parties had an agreement whereby Defendant Handy agreed to pay back whatever amounts he borrowed from Plaintiff Odogwu. 14. At the present time, an amount of $19,000.00 with 19.99% interest is due and owing from Defendant to Plaintiff. 2 15. Defendant also agreed to pay for a year gym charges for Plaintiff. 16. Defendant has refused to pay all or any of this debt. WHEREFORE, Plaintiff Odogwu respectfully requests this Honorable Court to grant judgment in her favor and against Defendant Handy in the amount of $19,000.00 plus interest of 19.99%, and 10% statutory interest on the remainder, and whatever other relief the Court may consider just and equitable, which amount is below the jurisdictional limit for compulsory arbitration.
