PETITION TO MAKE RULE ABSOLUTE
AND NOW, comes Petitioner, Mark A. Mateya, Esquire, counsel for the Estate of
Richard R. Cook, deceased, and in support avers the following:
Petitioner was engaged by James R. Cook to assist with the administration of the
estate of Richard R. Cook on July 13, 2010.
2. Farmers and Merchants Trust Company of Chambersburg was appointed as Trustee of
funds for the benefit of the decedent's minor children.
3. On or about October 1, 2010, Petitioner requested payment from the Trustee for the
legal fees relating to the administration of the estate of the decedent.
4. On December 13, 2010, Petitioner filed a Petition for Administration Fees Under the
Estate Administration of Richard R. Cook, Deceased.
5. On December 16, 2010, this Honorable Court issued a Rule to Show Cause upon
James R. Cook, Executor of the Estate of Richard R. Cook and F&M Trust, Testamentary
Trustee, to show cause why Petitioner's Petition for Administration Fees Under state ~--R ~,

Administration of Richard R. Cook should not be granted.

6. The last date for respondents James R. Cook and F&M Trust to file objections to the
Petition for Administration Fees Under the Estate Administration of Richard R. Cook was
January 6, 2011.
7. To date, no responsive pleadings have been filed by either James R. Cook or F&M
Trust relating to the Petition for Administration Fees Under the Estate Administration of Richard
R. Cook.
WHEREFORE, upon consideration of the foregoing, it is respectfully requested that this
Honorable Court;
1. Issue an Order upon James R. Cook, Executor of the Estate of Richard R. Cook,
and F&M Trust making the Rule Absolute; and
2. Direct F&M Trust, as Trustee make payment to Petitioner in the amount of
$10,000.00 for legal fees and associated costs in administering the estate of Richard R. Cook.
