Tiley, Esquire, Assistant Cumberland County Solicitor, and files this Petition for Rule for Judicial Sale, of which the following is a statement: 1. Your Petitioner is the County of Cumberland through its Tax Claim Bureau, a Bureau created by the Real Estate Tax Sale Law. 72 P.S. §5860.101, et sic. 2. Pursuant to 72 P.S. §5860.610, your Petitioner respectfully represents as follows: a. Tax claim upon which the property was exposed for sale: 2008 and 2009 Cumberland County, Library and East Pennsboro Township real estate taxes. 2008-09 and 2009-10 East Pennsboro Area School District real estate taxes. Total amount of claim, including penalty, interest, and cost as of date of tax sale: $721.18. b. Neither the owner, his, her, their, or its heirs, successors, assigns, or legal representatives, or any lien creditor, or his, her, their or its heirs, successors or legal representatives, or any other person interested, has caused stay of sale, discharge of tax claim or removal from tax sale. c. The property was exposed to public sale pursuant to 72 P.S. §5860.601 on: September 16, 2010. Petition for Judicial Sale (Parcel No. 09-16-1051-024) Page 1 d. Before exposing the property to public sale the Bureau fixed the upset sale price, pursuant to 27 P.S. §5860.605, which upset price was $944.97. e. Your Petitioner, the Bureau, was unable to obtain a bid at the public sale sufficient to pay the said upset price. 3. Attached hereto, marked Exhibit 'A" and incorporated herein by reference as is fully set forth herein, is a copy of a title report received from a title searcher retained by the Bureau together with a reduced copy of the most recent deed for the subject premises, as of the date of the search. The tax parcel number of the property is 09-16-1051-024. The property is situate in the Township of East Pennsboro, Cumberland County, Pennsylvania and is known as, 32 W Pine Street. 4. The names and addresses of known parties holding tax and municipal claims, liens, mortgages, ground rents, charges and estates against the property are as follows: a. Cumberland County Tax Claim Bureau One Courthouse Square Carlisle, Pennsylvania 17013 Delinquent taxes payable through December 31, 2010: $761.02 (Includes 2008 and 2009 county/municipal real estate taxes and 2008-09 and 2009-10 School real estate taxes). b. East Pennsboro Township, Tax Collector Debbie Lupold 98 S. Enola Drive, Room 101 Enola, PA 17025 2010 County and Municipal real estate taxes at penalty in the amount of $54.43. 2010-11 school real estate taxes, in the amount of $169.36, if not paid by 12/31/2010 to Tax Collector, will be turned over to Tax Claim Bureau. c. East Pennsboro Township 98 S. Enola Drive Enola, PA 17025 East Pennsboro Township is the taxing authority of all delinquent municipal real estate taxes collected by the Tax Claim Bureau and current taxes collected by Debbie Lupold. East Pennsboro Area School District 890 Valley Street Enola, PA 17025 East Pennsboro Area School District is the taxing authority of all delinquent school real estate taxes collected by the Tax Claim Bureau and current taxes collected by Debbie Lupold. e. BELCO Community Credit Union 449 Eisenhower Blvd Harrisburg, PA 17111 Mortgage recorded February 3, 1998 in Mortgage Book 1429, Page 1027, in the amount of $51,600.00. f. East Pennsboro Township 98 S. Enola Drive Enola, PA 17025 Judgment 2005-6607, entered December 19, 2005 in the amount of $989.08. 5. The last known address of the owner of the property as set forth in the assessment records of Cumberland County is: Susan Ellen Devine, 34 West Pine Street, Enola, PA 17025. Certified correspondence sent to said address has been returned as "unclaimed" but regular U.S. mail was not returned. The properties will be sold free and clear of all taxes and municipal claims, mortgages, liens, charges, and estate whatsoever kind, except ground rents separately taxed and year 2011 real estate taxes which will not be discharged by the sale (** where indicated, property is subject to current municipal liens). CONDITIONS OF SALE 1. The Tax Claim Bureau acting as an agent of each taxing municipality on which taxes are unpaid is selling the taxable interest of the owner. It makes no guaranty or warranty whatsoever as to the existence or condition of the property, accuracy of ownership, size, boundaries, lo- cations, existence of structures or lack thereof, liens, titles, occupancy, possession, or any other matter whatsoever affecting the property. It has attempted to comply with all statutory rules regarding notice, and retains records of such notices in its office for public inspection, but makes no guaranties or warranties whatsoever. 2. An initial bid must equal the Judicial Sale price as announced at the sale for each property. If the winning bid is $1,000.00 or less, payment must be made in full at the time the property is struck down by cash in the form of currency of the United States. For any bid exceeding $1,000.00 a deposit of $1,000.00 cash, in the form of currency of the United States, must be paid at the time the property is struck with the balance due by 3:00 p.m. the day of the sale. The remaining balance must also be paid by cash in the form of currency of the United States, or cer- tified funds, such as certified check, cashier's check or money order pay- able to County of Cumberland. Fail- ure to pay the balance in full by 3:00 P.m. on the day of sale will result in loss of the $1,000.00 deposit, the sale will be voided, and the bidder will be prohibited from bidding at future tax sales. The Judicial Sale price of each property includes all unpaid costs and fees incurred since the property has been in delinquent status. In addition to the bid price, the purchaser will be required to pay the costs of recording the deed and the applicable realty transfer taxes of 20/. of the fair market value. For realty transfer taxes, fair market value is es- tablished by multiplying the current assessment of the property by the common level ratio factor for the year. 5. The Tax Claim Bureau will record a deed to the purchaser or purchaser's nominee, after which the deed will be mailed to the address given by the purchaser. Or in the case of a mobile home, a bill of sale will be provided, in the name of the purchaser or purchaser's nominee, and copy of the bill of sale will be mailed to the address given by the purchaser, and the purchaser will be responsible for transfer of the mobile home title. The purchaser is solely responsible for resolving any problems or difficulties in obtaining possession of the property. CUMBERLAND LAW JOURNAL 6. If an owner should file excep- tions or objections to the sale of a purchased property, it will be the responsibility of the purchaser to defend the validity of the sale, or negotiate with the owner for releas- ing the purchaser's interest. The Tax Claim Bureau may choose to defend the validity of a sale, whether or not the purchaser does so. The Tax Claim Bureau may choose not to agree to void a sale even if the prior owner and the purchaser have agreed to do so. 7. The Real Estate Tax Law pro- vides that: "There shall be no re- demption of any property after the actual sale thereof. (501(c) of Real Estate Tax Sale Law.) All sales shall be made under these conditions and will be final. No adjustments will be made after the property is struck down. If any problem of possession of the premises arises after purchase, it shall be the responsibility of the purchaser to resolve the same. The sale does not purport to convey per- sonal property which may be on the premises. 8. It is strongly urged that the prospective purchasers have ex- amination made of the title to any property which they may be inter- ested. Every reasonable effort has been made to keep the proceedings free from error. However, in every case, the Tax Claim Bureau sale and conveyance is without guarantee or warranty, whatsoever, either as to existence, correctness of ownership, size, boundaries, location, structures or lack of structures upon the land, liens, titles, or any other matter or thing whatsoever.
