PETITION FOR RULE FOR JUDICIAL SALE
AND NOW, comes the Cumberland County Tax Claim Bureau, by its attorney,
Stephen D. Tiley, Esquire, Assistant Cumberland County Solicitor, and files this Petition
for Rule for Judicial Sale, of which the following is a statement:
1. Your Petitioner is the County of Cumberland through its Tax Claim
Bureau, a Bureau created by the Real Estate Tax Sale Law. 72 P.S.
§5860.101, et sic.
2. Pursuant to 72 P.S. §5860.610, your Petitioner respectfully represents
as follows:
a. Tax claim upon which the property was exposed for sale: 2008 and
2009 Cumberland County, Library and Hampden Township real
estate taxes. 2008-09 and 2009-10 Cumberland Valley School
District real estate taxes. Total amount of claim, including penalty,
interest, and cost as of date of tax sale: $1,052.05.
b. Neither the owner, his, her, their, or its heirs, successors, assigns, or
legal representatives, or any lien creditor, or his, her, their or its
heirs, successors or legal representatives, or any other person
interested, has caused stay of sale, discharge of tax claim or
removal from tax sale.
c. The property was exposed to public sale pursuant to 72 P.S.
§5860.601 on: September 16, 2010.

d. Before exposing the property to public sale the Bureau fixed
the upset sale price, pursuant to 27 P.S. §5860.605, which upset
price was $1,422.88.
e. Your Petitioner, the Bureau, was unable to obtain a bid at the public
sale sufficient to pay the said upset price.
3. Attached hereto, marked Exhibit "A," and incorporated herein by
reference as is fully set forth herein, is a copy of a title report received
from a title searcher retained by the Bureau together with a reduced
copy of the most recent deed for the subject premises, as of the date of
the search. The tax parcel number of the property is 10-17-1033-038.
The property is situate in the Township of Hampden, Cumberland
County, Pennsylvania and is known as, Lot 6, Good Hope Road & Mill
Road.
4. The names and addresses of known parties holding tax and municipal
claims, liens, mortgages, ground rents, charges and estates against the
property are as follows:

Delinquent taxes payable through December 31, 2010: $1097.83
(Includes 2008 and 2009 county/municipal real estate taxes and

2010 County and Municipal real estate taxes at penalty in the
amount of $84.70. 2010-11 school real estate taxes, in the

Hampden Township is the taxing authority of all delinquent
municipal real estate taxes collected by the Tax Claim Bureau and

Certified correspondence sent to said address has been returned as
"unclaimed" but regular U.S. mail was not returned.

WHEREFORE, Your Petitioner prays your Honorable Court to grant a rule upon
all interested parties, including those listed at paragraphs four and five of the within
Petition, to show cause why a decree should not be made that the property be sold,
freed and cleared of tax and municipal claims, liens, mortgages, charges and estates,
except separately taxed ground rents, pursuant to Section 612 of the Real Estate Tax
Sale Law. 72 P.S. §5860.612(a).

THE above-described premises are conveyed under and subject to easements and restrictions

BEING THE SAME PREMISES (except for the above-referenced grant and conveyance out to
the Hampden Township Sewer Authority, dated April It, 1995, recorded in Deed Book 126, Page 98)
which John E. Eckstine, Jr. married man, by deed dated September 26, 1985 and recorded September 27,
1985 in the Office of the Recorder of Deeds in and for Cumberland County, Pennsylvania in Deed Book
"M," Volume 31, Page 824, granted and conveyed to Martin E. Gross, Jane A. Gross, Gerald M. Cohen,
and Nancy Bruno Cohen, a partnership, its successors and assigns, for the uses and purposes of the
partnership.
SUBSEQUENTLY, the said Cohens, by deed dated December 18, 2003 and recorded January 9,
2004 in the said Recorder's Office in Deed Book 261, Page 855, granted and conveyed their one-half
(1 /2) interest in the said partnership real estate to the said Grosses, thus consolidating full and absolute
title into the said Grosses.
ADDITIONALLY, the said Grosses, on December 18, 2003, entered into an Agreement with the
said Jeffrey L. Cassell and Terri A, Cassell by which the said Grosses were to sell, grant and convey title
to the premises to the said Casselis. Said Agreement is recorded in the said Recorder's Office in
Miscellaneous Book 705, Page 1489.
THE SAID GROSSES sign herein as partners and as individuals to grant and convey all of their
right, title and interest in and to the premises in whatever capacity they might hold or arguably hold the
same.
THE SAID CASSELLS sign herein to grant and convey all of their right, title and interest,
including any equitable title, rights, or claims whatsoever derived from their rights under the said
Agreement.
All of the aforesaid Grantors join in the warranty of title.
THIS CONVEYANCE IS PART OF A DEFERRED TAX-FREE EXCHANGE OF LIKE-KIND
PROPERTY BY THE GRANTEES UNDER SECTION 1031 OF THE U.S. INTERNAL
REVENUE CODE OF 1986.
AND, the said Grantors hereby covenant and agree that they will warrant specially the property
