~, publ~n and dele this as and for my Last Will and Testament, hereby revoking and making null and
~any an~all W~lls~nd Testaments and writings in the nature thereof by me at any time heretofore made
~ ~Z IT_EM 1: ~I~.?'rect that my hereinafter named Executor pay all my just debts, my funeral expenses,
and the expenses of the administration of my estate. With this direction, I authorize and empower my Executor
to expend for my funeral expenses and interment such mounts as he may consider necessary and proper,
without regard to any limit that may be prescribed by a court of law.
ITEM 2: I direct my Executor to pay all inheritance, estate, succession, and legacy taxes of
whatsoever nature and kind, to which my estate, or the transfer of any property passing hereunder or otherwise
passing by reason of my demise, may be subject, and to charge such taxes against my residuary estate. It is
my intention that none of the aforesaid taxes, either federal or state, on any property required to be included
in my gross estate, under the provisions of any state or federal law now in force or hereat~er enacted, shall be
prorated among the persons interested in my estate to whom such property is or may be transferred or to whom
any benefit accrues.
ITEM 3: I give, devise, and bequeath the residence which I own at the time of my death, and its
contents, to my son, KEITH A. FINK, of Mechaaicsburg, Pennsylvania. In the event I reside in a property
that I do not own at the time of my death, I direct that this bequest lapse, and that my son, Keith A. Fink,
participate in the distribution of the residue of my estate as set forth in Item 5 of my this my Last Will and
Testament.
ITEM 4: I direct that my Executor market the Cabin Property in Howell Township, Perry County,
Pennsylvania, and the proceeds of the sale of that property be included in the residue of my
estate.
ITEM 5: All the rest, residue and remainder of my estate, I give, devise, and bequeath unto my issue
hereai~er named, in equal shares: KAREN L. WEIKEL, of New Cumberland, Pennsylvania; BRADLEY S.
FINK, of Mechanicsburg, Pennsylvania; KIMBERLY J. BIXLER, of Pine Grove, Pennsylvania; RONALD
E. FINK, of Newport, Pennsylvania; SUSAN E. FINK, of Erial, New Jersey; TINA M. FINK, of Houston,
Texas; DONALD E. FINK, of Camp Hill, Pennsylvania; LISA M. JONES, of Spokane, Washington;
DIANNE L. FINK, of Mechanicsburg, Pennsylvania; and WAYNE A. FINK, of Eden, Maryland.
In the event I do not own the premises which I occupy at the time of my death, I direct that my son,
KEITH A. FINK, be added as an eleventh individual to participate in the equal distribution of the residue of
my estate.
ITEM 6.: I nominate, constitute and appoint my son, KEITH A. FINK, to serve as
Executor of this my Last Will and Testament.
ITEM 7: I direct that my hereinbefore named Executor shall not be required to give bond for the
faithful performance of his duties in this or any jurisdiction.

3. Said Will was accepted by the Register of Wills of Cumberland County for
probate on July 20, 2004, and steps necessary to complete the
administration were undertaken by the Executor.
4. The beneficiaries desire that the distribution of the assets of the Estate be
made without the formality of an Accounting in the Orphans' Court
Division of the Cumberland County, Pennsylvania Court of Common Pleas,
and the Executor is willing to make this distribution upon the execution of
this Agreement.

Keith A. Fink, a beneficiary hereunder, desires to forever settle and

compromise any and all claims and rights which he may possess, now or
hereafter, in the Estate and to confirm his acceptance of the residence

located at 530 Penn-Ayr Road, Camp Hill, Cumberland County,
Pennsylvania, as the distribution of an informal settlement of the Estate.
6. The beneficiaries wish to release the Executor and to indemnify him against
any and all claims that may be asserted against the Estate with the Executor
after the date hereof.
7. The Executor is willing to make a distribution of informal settlement of the
Estate in consideration of the indemnification and agreements hereinafter
provided by the beneficiaries.
NOW, THEREFORE, in consideration of the foregoing and intending to be legally
bound hereby, jointly and severally, the Beneficiaries do, for themselves, their heirs,
personal representatives, successors and assigns, agree as follows:
A. Represent and warrant that they have read and they understand this
Agreement and confirm that the facts set forth above are true and correct,
to the best of their knowledge, information and belief.
B. Declare that they have sufficient information to make an informed waiver
of their right to a formal accounting with the Court, and do hereby waive
the filing and auditing of said formal accounting.
C. Acknowledge that the distributive share or amount set forth on the
"Accounting" shall be in satisfaction of their respective entitlements under
the Will.
D.
Release, remise, quitclaim and forever discharge the Executor, his heirs,
personal representatives, successors and assigns, from and against all
claims that they, as residuary beneficiaries of the Estate, had, now have, or
may in the future have in connection with the Estate.
