Bogar, Esquire and files the following municipal claim against Samer Thabteh, an adult individual, owning property located at 320 Contempra Drive, Mechanicsburg, Monroe Township, Cumberland County, Pennsylvania, 17055, his last known mailing address being: 320 Contempra Drive, Mechanicsburg, Monroe Township, Cumberland County, Pennsylvania, 17055. Samer Thabteh is the owner of all that certain lot of ground, including any improvements thereon, being more fully described as follows: ALL THAT CERTAIN piece or parcel of land situate in the Township of Monroe, County of Cumberland and Commonwealth of Pennsylvania, more particularly bounded and described as follows: BEGINNING at an iron pin on the dividing line between Lots Nos. 1 and 2 as shown on the hereinafter mentioned Plan of Lots at the Northwest corner of said Lot Nos. 1 and 2; thence along said dividing line between Lots Nos. 1 and 2 the following two (2) courses and distances: (1) South 14 degrees 15 minutes East, a distance of 174.45 feet to an iron pin; and (2) North 75 degrees 45 minutes East, a distance of 100 feet to an iron pin at lands now or formerly of Glenn Brechbeil; thence along said lands now or formerly ?^7 Er) ? t .'P4? Tai C?- "z a ?.?a of Glenn Brechbeil and along lands now or formerly of James F. Shaeffer, South 14 degrees 15 minutes East, a distance of 165.81 feet to an iron pin at lands now or formerly of Robert Jones; thence along said lands now or formerly of Robert Jones, South 75 degrees 26 minutes West, a distance of 589.95 feet to an iron pin; thence along lands now or formerly of Edward E. Palmer, Ronald G. Nicholas, Harry G. Benion, Jr. And Merle C. Wertz, North 8 degrees 00 minutes West, a distance of 342.27 feet to an iron pin at corner of lands now or formelry of Joseph Kramer, Jr.; thence along said lands now or formerly of Joseph Kramer, Jr. and along lands now or formerly of Carl A. Banks and Alfred J. Strudwick, North 75 degrees 20 minutes East, a distance of 452.69 feet to an iron pin at the dividing line between Lots Nos. 1 and 2 as shown on the Plan of Lots hereinafter mentioned, the place of BEGINNING. BEING Lot No. 1 as shown on a certain Plan of Lots entitled "Final Subdivision Plan for Robert E. Jones" dated April 24, 1986 (revised June 24, 1986) and recorded in the office of the Recorder of Deeds in and for Cumberland County, Pennsylvania, in Deed Book 50, Page 139. BEING THE SAME PREMISES which Dale E. Elicker and Patricia M. Elicker, Trustees or their successors interest under the Dale E. Elicker Living Trust dated August 31, 1994 and any amendments thereo, and Patricia M. Elicker and Dale E. Elicker, Trustees or their successors :interest under the Patricia M. Elicker Living Trust dated August 31, 1994, and any amendments thereto, by their Deed dated May 27, 2005, and recorded June 1, 2005, in Deed Book 269, Page 631, granted and conveyed unto Samer Thabteh, married man. Tax Parcel No. 22-24-0783-164. Monroe Township Municipality Authority hereby files this Municipal Lien for Services and Sewer Rates levied and assessed from June 1, 2009 through and including December 31, 2010. Said Authority services and sewer rates were levied and assessed pursuant to Authority Resolution No. 02-04, same being known as a -2- Resolution of the Board of Monroe Township Municipal Authority imposing user charges to be collected from the owner of each improved property served or to be served by this Authority's sewer systems; and providing for payment and collection of such user charges. Attached hereto and incorporated herein are the statements forwarded by Monroe Township Municipal Authority to Samer Thabteh for sewerage due to be treated from June 1, 2009 through December 31, 2010, which services total is in the amount of $1,064.25, which sum was duly assessed against Samer Thabteh, and the real property described herein from the date of said billing statements as attached hereto, and for which sum, with interest in the amount of ten (10%) percent, along with penalties and all costs, including attorneys' fees, a municipal lien is claimed against the above-described real property and premises in accordance with the Act of May 16, 1923, P.L. 207, §7, as amended, 53 P.S. §7101, et seq, as amended (Municipal Claims and Tax Liens). This account is delinquent. As of the last billing notice, same being dated November 15, 2010, the delinquency is in the amount of $1,084.25. The purpose of this letter is to request that this account be brought current. If the account is not brought current within thirty (30) days of receipt of this letter, a Municipal Lien will be placed against real estate owned by you, same being known and numbered as 320 Contempra Drive, Mechanicsburg, PA. This will result in filing fees, service costs, and attorney's fees. Attorney's fees that are incurred with respect to the collection of this delinquent account will be assessed. Attorney's fees will be charged at the current rate. Attorney's fees will be imposed and/or assessed if this amount remains delinquent after thirty (30) days from the mailing of this notice. The imposition of assessment of attorney's fees may be avoided by you making payment in full of the delinquency withln thirty (30) days of receipt of this letter as set forth herein.
