Bogar, Esquire and files the following municipal claim against Eric I. Abramson and Tiffany Ann Abramson, husband and wife, adult individuals, owning property located at 1417 Creek Road, Boiling Springs, Monroe Township, Cumberland County, Pennsylvania, 17055, their last known mailing address being: 66 North Old Stone House Road, Carlisle, Cumberland County, Pennsylvania, 17015. Eric I. Abramson and Tiffany Ann Abramson are the owners of all that certain lot of ground, including any improvements thereon, being more fully described as follows: ALL THOSE CERTAIN tracts of land situate in Monroe Township, Cumberland County, Pennsylvania, bounded and described as follows: PARCEL NO. 1: BEGINNING at a point in line of other land now or formerly of James L. Shumberger and Shirley L. Shumberger, his wife, said point lying on the southern edge of the pre-existing Q1µ X50 right-of-way line for Township Road T-650, Creek Road, said point also being 179.04 feet from a P.K. nail in the center of the intersection of Township Road T-650 and Township Road T-651; thence by other land now or formerly of James L. Shumberger and Shirley L. Shumberger, his wife, and across Township Road T-650, North 03 degrees 17 minutes 04 seconds West, 40 feet to a point at the low water line of the Yellow Breeches Creek; thence by the low water line of the Yellow Breeches Creek, South 76 degrees 27 minutes 44 seconds East, 21.04 feet to a point in said low water line; thence by the same, North 87 degrees 43 minutes 58 seconds East, 108.62 feet to a point at corner of Lot No. 1 on the hereinafter mentioned Plan of Lots; thence by the same, South 01 degree 58 minutes 00 seconds East, 218.78 feet to an iron pin on the northern edge of a 20 foot wide private right-of-way shown on the hereinafter mentioned Plan of Lots; thence by said private right-of-way, South 78 degrees 29 minutes 56 seconds West, 125 feet to an iron pin at corner of other land now or formerly of James L. Shumberger and Shirley L. Shumberger, his wife; thence by the same, North 03 degrees 17 minutes 04 seconds West, 204.61 feet to an iron pin, the place of BEGINNING. CONTAINING .6639 acre, more or less. BEING Lot No. 2 on the Plan of Lots of Marie D. Shumberger, recorded in Cumberland County Plan Book 37, Page 71. UNDER AND SUBJECT, NEVERTHELESS, to building and use conditions and restrictions and a right-of-way for Township Road T-650 as set forth on said Plan of Lots. BEING known and numbered as 1417 Creek Road, Boiling Springs, Pennsylvania. PARCEL NO. 2: BEGINNING at a point on the north side of a gravel drive and in the approximate center of a road at line of land now or formerly of Wilmer Harris; thence by said Harris land and by the center of the said road, North 43 degrees West 282.13 feet to a point; thence North 15 degrees 15 minutes East 64 feet to a point on the bank of the Yellow Breeches Creek; thence by the bank of the Yellow Breeches Creek, South 61 degrees 7 minutes East 167.85 feet to a point; thence by -2- land now or formerly of Lee W. Shumberger, South 3 degrees 43 point on the north side of the the same, South 81 degrees 4 m point, the place of BEGINNING. The above description is taken Smith, Registered Surveyor. Shumberger and Marie D. minutes East 241 feet to a said gravel drive; thence by inutes West 165 feet to a from a survey made by Noel B. BEING THE SAME TWO (2) PARCELS which James L. Shumberger and Shirley L. Shumberger, husband and wife, by Corrective Deed dated April 28, 2003, and recorded May 13, 2003, in the Office of the Recorder of Deeds in and for Cumberland County, Pennsylvania, in Deed Book 257, Page 24, granted and conveyed unto Eric I. Abramson and Tiffany Ann Abramson, his wife. Tax Parcel No. 22-12-0348-004. Monroe Township Municipality Authority hereby files this Municipal Lien for Services and Sewer Rates levied and assessed from June 1, 2009 through and including December 31, 2010. Said Authority services and sewer rates were levied and assessed pursuant to Authority Resolution No. 02- 04, same being known as a Resolution of the Board of Monroe Township Municipal Authority imposing user charges to be collected from the owner of each improved property served or to be served by this Authority's sewer systems; and providing for payment and collection of such user charges. Attached hereto and incorporated herein are the statements forwarded by Monroe Township Municipal Authority to Eric I. Abramson and Tiffany Ann Abramson for sewerage due to be treated from June 1, 2009 through December 31, 2010, which -3- services total is in the amount of $1,304.16, which sum was duly assessed against Eric I. Abramson and Tiffany Ann Abramson, and the real property described herein from the date of said billing statements as attached hereto, and for which sum, with interest in the amount of ten (10%) percent, along with penalties and all costs, including attorneys, fees, a municipal lien is claimed against the above- described real property and premises in accordance with the Act of May 16, 1923, P.L. 207, §7, as amended, 53 P.S. §7101, et seq, as amended (Municipal Claims and Tax Liens). Old Stone House Road Carlisle, PA 17015 Dear Mr. Abramson: I am contacting you on behalf of Monroe Township relative to your sewer account #1270, This account is delinquent. As of the last billing notice, same being dated November 15, 2010, the delinquency is in the amount of $1,304.16. The purpose of this letter is to request that this account be brought current. If the account is not brought current within thirty (30) days of receipt of this letter, a Municipal Lien will be placed against real estate owned by you, same being known and numbered as 1417, Creek Road, Boiling Springs, PA- This will result in filing fees, service costs, and attorney's fees. Attorney's fees that are incurred with respect to the collection of this delinquent account will be assessed. Attorney's fees will be charged at the current rate. Attomey's fees will be imposed and/or assessed if this amount remains delinquent after thirty (30) days from the mailing of this notice. The imposition of assessment of attorney's fees may be avoided by you making payment in full of the delinquency within thirty (30) days of receipt of this letter as set forth herein.
