Complaint
1. Plaintiff is CITIBANK (SOUTH DAKOTA), N.A., with place of business located at
701 East 60th Street North, Sioux Falls, South Dakota.
2. Defendant is Billy W Martin, who resides at 57 West I Street, Carlisle, Cumberland
County, Pennsylvania.
3. Plaintiff is a national banking association, engaged in various types of banking
business including consumer lending through the issuance of credit cards.
4. Plaintiff furnished consumer credit to the defendant by means of a(n) CITI
MASTERCARD credit card with account number ending in 5636 hereinafter referred to as the
credit card account.
5. Plaintiff kept accurate running records of all debits and credits to the account.
6. Plaintiff mailed to defendant monthly statements for the account including the billing
statement attached hereto as Exhibit A. The monthly statements accurately stated the previous
balance, the debits and credits to the account for the prior billing period.
7. Before plaintiff mailed Exhibit A, defendant had for many months made payments on
account of the billing statement or retained the statement without payment.
8. Defendant's actions as set forth above constituted an account stated between parties
for the sum of $10,242.76 which sum reflects the Exhibit A statement balance less credits, if
any, which were applied subsequent to the date of Exhibit A.
Wherefore, plaintiff demands judgment against defendant for the sum of $10,242.76, and
the costs of this action.

provider for plaintiff in that it services credit card accounts owned by plaintiff. I am authorized to
make this verification on behalf of plaintiff. The statements of facts set forth in the complaint are
true and correct upon my information and belief and are made subject to the penalties of 18 Pa.
C.S. Section 4904, relating to unworn falsification to authorities.

Motion to Compel Binding Arbitration
Billy W. Martin, Jr. (Defendant), hereby answers the complaint of CitiBank, South Dakota, N.A.
(Plaintiff) for its self alone as follows and moves this court to bar, stay, or dismiss Plaintiffs
claim based on the following:
1. Plaintiff filed a complaint against the defendant for a credit card balance due.
2. Defendant moves this court to compel binding arbitration based on the credit card Credit
Card Agreement provided by the Plaintiff.
a. The parties are bound by Credit Card Agreement to settle disputes by binding
arbitration, not by litigation, upon the election of either party. This Motion
constitutes notice of election by the undersigned to have this dispute resolved by
binding arbitration, as provided for in the Credit Card Agreement.
I Plaintiff has never sought to take the defendant to arbitration.
4. The Federal Arbitration Act (FAA), 9 USC, Section 1-2, provides
a. "A written provision in any maritime transaction or a contract evidencing a
transaction involving commerce to settle by arbitration a controversy thereafter
arising out of such a contract or transaction, or the refusal to perform the whole or
any part thereof, or an agreement in writing to submit to arbitration an existing
controversy arising out of such a contract, transaction, or refusal, shall be valid,
irrevocable and enforceable, save upon such grounds as exist at law or in equity
for the revocation of any contract."
5. Defendant request that pending the court's ruling on this Motion this action be stayed.
6. "FAA", 9 USC, Section 1-3 provides:
a. "If any suit or proceeding be brought in any of the court of the United States upon
any issue referable to arbitration under an agreement in writing for such
arbitration, the court in which such suit is pending, upon being satisfied that the
issue involved in such suit or proceeding is referable to arbitration under such an
agreement, shall on application of one of the parties stay the trial of the action
until such arbitration has be had in accordance with the terms of the agreement,
providing the applicant for the stay is not in default in proceeding with such
arbitration."
WHEREFORE, Defendant request that:
This honorable court stay the Plaintiff's complaint and any and all action related to this
case.
2. This honorable court compels the Plaintiff to seek binding arbitration per the terms and
conditions of the Credit Card Agreement.
