THIS AGREEMENT made this 9th dayof

hereinafter called the Contractor.
JERRY J. NELSON and SANDRA E. NELSON, husband and wife
hereinafter called the Owner.
WITNESSETH THAT: July 9 , 2 0 0 4
The Contractor by instrument dated dwelling house
entered into an Agreement with the Owner for the erection and construction of a
480-A Samples Bridge Road, Enola, Cumberland County, PA
, situated on
as set forth on Exhibit "A" attached hereto.
AND WHEREAS, the Contractor has covenanted and agreed therein to enter into an additional agreement
with the Owner stipulating that no lien or liens of any kind shall be filed against the above building or the
appurtenances thereto.
NOW, THIS AGREEMENT WITNESSETH, that the Contractor, for and in consideration of the awarding to him
of the said contract as for the sum of ONE DOLLAR ($1.00) to him in hand paid by the Owner, the receipt of
which is hereby aoknowledged, promises and agrees that no Mechanic's Lien or liens shall be filed against
the aforesaid building or the appurtenances thereto by any subcontractor, subcontractors, materialmen,
mechanics, laborers or anyone for materials furnished, work done or services rendered of any kind
whatsoever, for or about, or on aocount of the aforesaid building or on the credit thereof.
IN WITNESS WHEREOF, the said parties hereunto set their hands and seals the day and year aforesaid.

PROPERTY DESCRIPTION
The land referred to in this Commitment is described as follows:
ALL THAT CERTAIN piece or pamel of land situate, in Silver Spring Township,
Cumberland County, Pennsylvania, more particularly described as follows:
BEGINNING at a point at the northern line of Samples Bddge Road at the
corner of Lot No. I of the hereinafter mentioned subdivision plan;
THENCE by Lot No. 1, North 4 degrees 00 minutes 00 seconds West, a
distance of 1,380.51 feet to an iron pin at lands now or formedy of Bell and
Albright; THENCE by same North 86 degrees 23 minutes 00 seconds
East, a distance of 145.66 feet to an iron pin at lands now or late of Joey
and Denise Sullenberger; THENCE by same South 04 degrees 00
minutes 00 seconds East, a distance of 950.44 feet to an iron pin at the
corner of Lot No. 2-B of the hereinafter mentioned subdivision plan;
THENCE by same South 67 degrees 04 minutes 30 seconds West, a
distance of 185.00 feet to an iron pin; THENCE South 04 degrees 00
minutes 00 seconds East, a distance of 363.26 feet to a point on the
northern line of Samples Bridge Road; THENCE by the northern line of
Samples Bridge Road South 73 degrees 40 minutes 00 seconds West, a
distance of 25.59 feet to a point, the place of BEGINNING.
BEING Lot No. 2-A as shown on the Final Subdivision Plan for Larry M.
Nelson, as prepared by Hartman & Associates, Inc., dated October 20,
1999, last revised November 18, 1999, recorded in the Office of the
Recorder of Deeds of Cumberland County, Pennsylvania in Plan Book 80,
Page 81.
BEING THE SAME PREMISES which Larry M. Nelson and Joan Nelson,
husband and wife, by deed dated May 6, 2004, and recorded in the Office
of the Recorder of Deeds of Cumberland County, in Deed Book 262, Page
4966, granted and conveyed unto Jerry J. Nelson and Sandra E. Nelson,
Insured herein.
