AND NOW, comes Irma Davenport, Executor of the Estate of William Ids, by~d _

through her attorney, Mateya Law Firm, Mazk A. Mateya, Esquire, and requests This ItIonora~"'ble ~~
Court schedule a hearing in this matter, averring the following:
1. The decedent, William I Evans died testate on September 26, 2008.
2. On or about October 1, 2008, the Last Will and Testament of William I. Evapas dated
April 14, 2006, was admitted for probate and Letters Testamentary were issued to Irma'
Davenport.
3. On or about Mazch 4, 2009, Danny B. Evans, (hereinafter referred to as "Objectant")
by and through his counsel Ronald L. Finck, filed a Petition for Citation Sur Appeal frdm the
Decree of Probate and an appeal from the Decree of the Register of Wills.
4. On or about Mazch 6, 2009, This Honorable Court issued a Decree that requited
Executrix to show cause why the relief requested by Objectant should not be granted.
5. On or about Mazch 26, 2009, Executrix responded to the Petition filed by Objectant.

4. Both counsel have engaged in discovery, including depositions, request for production
of documents and interrogatories.
WHEREFORE, Irma Davenport, Executrix of the Estate of William I. Evans,
respectfully requests that this Honorable Court schedule apre-hearing conference ui otder to
identify the issues, address any remaining discovery issues, and schedule a hearing date to
determine the merits of Objectant's claims as raised in his petition.
