MUNICIPAL LIEN FOR SEWER SERVICES
North Middleton Authority, North Middleton Township, County of Cumberland, Commonwealth of
Pennsylvania by its solicitor, Martson Deardorff Williams Otto Gilroy & Faller, hereby files its
claim for sewer services against the real estate hereinafter described and sets forth its claim as
follows:
STATEMENT OF CLAIM
The name of the municipality by which this claim is filed is North Middleton Authority, a municipal
authority of the Commonwealth of Pennsylvania, located in the County of Cumberland and
organized pursuant to ordinances of North Middleton Township.

The name of the owner of the property against which this lien is filed is Theodore Syphax, P.O. Box
7295, Lancaster, Pennsyvlania 17604.
A description of the property against which this Lien is filed is attached hereto and marked as
Exhibit "A" with an address of 73 Partridge Circle, Carlisle, Pennsylvania 17013.

The authorities under and by virtue of which this Lien is filed is the Municipal Claims and Liens Act
of May 16, 1923, P.L. 207, as amended and supplemented, 53 P. S. 7101 et seq.

The lien is claimed for unpaid water and sewer user fees against the above-described property in the
amount of $743.85 plus any additional fees incurred thereafter.

Interest is claimed on the above-mentioned fees until paid in full.

Recorder of Deeds of Cumberland County In Plan Book 72, Page 118.
UNDER AND SUBJECT to the Declaration of Covenants and Restrictions, dated September 8,
1987, recorded in the Office of the Recorder of Deeds of Cumberland County in Miscellaneous
Book 340, Page 622, Bylaws of Middleton Estates Community Association, Inc., dated
September 8, 1987, recorded In the Office of the Recorder of Deeds of Cumberland County In
Miscellansous Book 340, Pegs 597, First Amendment to Bylaws of Middleton Estates
Community Association, Inc., dated August 28, 1997, recorded in the Office of the Recorder of

AND UNDER AND SUBJECT to a forty (40) foot sanitary sewer easement across the
southernmost portion of the premises, and to the 100 yew flood line of the
Conodogulnet Creek, across the mid-portion of the premises, as shown on the above-
referenced Final Subdivision Plan.
FURTHER UNDER AND SUBJECT TO the covenant and restriction that said Lots Nos.
11-E and 11-F hereafter be considered to be one tract and shall never be separately
conveyed, sold or mortgaged, the foregoing two lots being Intended to be held and
considered as one parcel. The foregoing covenants regarding the holding of said Lots
Nos, 11-E and 11-F as one parcel shall be a covenant which shall run with the land and
shall be binding upon lie Grantees, their heirs and assigns, and may be enforced in
equity by North Middleton Township.

BEING PART OF THE SAME PREMISES which Middleton Estates Development

granted and conveyed unto Remington Development Corporation, Grantor herein.
