PETITION FOR RULE FOR JUDICIAL SALE
AND NOW, comes the Cumberland County Tax Claim Bureau, by its attorney,
Stephen D. Tiley, Esquire, Assistant Cumberland County Solicitor, and files this Petition
for Rule for Judicial Sale, of which the following is a statement:
1. Your Petitioner is the County of Cumberland through its Tax Claim
Bureau, a Bureau created by the Real Estate Tax Sale Law. 72 P.S.
§5860.101, et sic.
2. Pursuant to 72 P.S. §5860.610, your Petitioner respectfully represents
as follows:
a. Tax claim upon which the property was exposed for sale: 2009
Cumberland County, Library and South Middleton Township real
estate taxes. 2008-09 and 2009-10 South Middleton School District
real estate taxes. Total amount of claim, including penalty, interest,
and cost as of date of tax sale: $16,501.83.
b. Neither the owner, his, her, their, or its heirs, successors, assigns, or
legal representatives, or any lien creditor, or his, her, their or its
heirs, successors or legal representatives, or any other person
interested, has caused stay of sale, discharge of tax claim or
removal from tax sale.
c. The property was exposed to public sale pursuant to 72 P.S.
§5860.601 on: September 16, 2010.

d. Before exposing the property to public sale the Bureau fixed
the upset sale price, pursuant to 27 P.S. §5860.605, which upset
price was $24,661.37.
e. Your Petitioner, the Bureau, was unable to obtain a bid at the public
sale sufficient to pay the said upset price.
3. Attached hereto, marked Exhibit "A," and incorporated herein by
reference as is fully set forth herein, is a copy of a title report received
from a title searcher retained by the Bureau together with a reduced
copy of the most recent deed for the subject premises, as of the date of
the search. The tax parcel number of the property is 40-30-2644-026.
The property is situate in the Township of South Middleton, Cumberland
County, Pennsylvania and is known as, 217 Pine Road.
4. The names and addresses of known parties holding tax and municipal
claims, liens, mortgages, ground rents, charges and estates against the
property are as follows:

correspondence sent to said address has been returned as
"unclaimed" and regular U.S. mail was not returned. Another address
recently obtained by the Bureau for both Respondents is 238 S. West
Street, Carlisle, PA 17013-3878.

WHEREFORE, Your Petitioner prays your Honorable Court to grant a rule upon
all interested parties, including those listed at paragraphs four and five of the within
Petition, to show cause why a decree should not be made that the property be sold,
freed and cleared of tax and municipal claims, liens, mortgages, charges and estates,
except separately taxed ground rents, pursuant to Section 612 of the Real Estate Tax
Sale Law. 72 P.S. §5860.612(a).

AND NOW, comes the Cumberland County Tax Claim Bureau, by its attorney,

to Continue Generally, of which the following is a statement:
1. On February 10, 2011 the Court issued a Rule to Show Cause with a
Rule Returnable date of April 14, 2011, in response to a Petition for a
Judicial Sale of the above captioned property. On April 14, 2011 the
Court issued an order for a Judicial Sale to be held July 7, 2011 on said
property.
2. On April 27, 2011 the Tax Claim Bureau received notice that the
property owners, Mark A. and Sheila R. Thesen, had filed a bankruptcy
petition.

MOTION TO RESCHEDULE SALE
AND NOW, comes the Cumberland County Tax Claim Bureau, by its attorney, Stephen
D. Tiley, Esquire, Assistant Cumberland County Solicitor, and files this Motion to Reschedule
Tax Sale, of which the following is a statement:
This action began with a Petition for Rule for Judicial Sale filed by the
Cumberland County Tax Claim Bureau. (Hereinafter the "Bureau") Pursuant to that Petition, a
Rule to Show Cause was issued on February 10, 2011 by Judge Ebert, scheduling a Rule
Returnable date of April 14, 2011. On April 14, 2011, after the Hearing, Judge Ebert entered an
Order directing that the property by sold on July 7, 2011.
2. Thereafter, counsel for the Bureau received a telephone call from attorney
Markian R. Slobodian, indicating that the property owners had filed for bankruptcy protection
and that the County's action was a violation of the automatic stay in bankruptcy. Attorney
Slobodian followed up with a letter dated April 27, 2011, and a copy of a Bankruptcy Petition,
for case No. 1:08-bk-04002-MDF.

3. The Bureau had never received any notification of the filing of the above
referenced year 2008 Bankruptcy Petition, nor any other Bankruptcy Petition, or other filing, for
this property.
4. Nevertheless, as a result of Attorney's Slobodian's letter of April 27, 2011, the
Bureau filed, on June 28, 2011, a Motion to Continue Generally and by Order of Court dated
June 29, 2011 Judge Ebert cancelled the sale scheduled for July 7, 2011 and continued the matter
generally.
5. It has now come to the attention of the Bureau that the aforementioned
bankruptcy action was discharged in February of 2009.
6. The year 2008 Bankruptcy Petition would have only effected pre-petition taxes.
No post-petition taxes have been paid. Real estate taxes, in any event, are not discharged in
banbkruptcy.
7. The Bureau has a tax sale scheduled for December 12, 2011 and it would be
economically desirable to combine this judicial sale with that December 12'h tax sale.
8. Good service of process was made upon the creditors listed in paragraph 4 of the
Petition for Judicial Sale, and upon the record owners of the property, listed at paragraph 5 of the
Petition for Judicial Sale. The South Middleton Township Authority had not been identified as a
creditor, and so was not served with the original Petition for Rule for Judicial Sale. Therefore,
the Bureau asks that the property be ordered to be sold subject to the lien of the South Middleton
Township Authority.
9. The Bureau asks that the Court, pursuant to 72 P.S. §5860.612(b), order
advertisement of the sale, by one (1) insertion in two (2) newspapers of general circulation in
Cumberland County, and by one (1) insertion in the Cumberland County Law Journal.

10. The property owner's attorney Lawrence G. Frank, concurs (does not concur) in
this Motion or the relief requested. The Bankruptcy Trustee, Markian R. Slobodian; semis--

WHEREFORE, the Cumberland County Tax Claim Bureau, prays Your Honorable
Court for an Order: (a) Rescheduling the Judicial Sale pursuant to 72 P. S. §5860.612(a), of
Tax Parcel No. 40-30-2644026, for December 12, 2011, such that the said property be sold
freed and cleared of all tax and municipal claims, liens, mortgages, charges and estates, except
current South Middleton Township Authority liens and separately taxed ground rents, to the
highest bidder, at a sale to be held on December 12, 2011 at 10:00 a.m. in the Second Floor
Courtroom of the Old Courthouse Building of the Cumberland County Courthouse, and that the
purchaser at such sale shall take and thereafter have an absolute title to the property free and
clear of all tax and municipal claims, mortgages, liens charges and estates of whatsoever kind,
except ground rents, separately taxed, and except for current South Middleton Township
Authority liens.
(b) Directing that the Cumberland County Tax Claim Bureau notify all parties listed
at paragraphs 4 and 5 of the Petition for Rule for Judicial Sale, by regular United States mail, of
the rescheduled sale date, and pursuant to 72 P. S. §5860.612(b), advertisement of such sale need
only be made by one (1) insertion in two (2) newspapers of general circulation in Cumberland
County, and by one (1) insertion in the Cumberland County Law Journal. Such mailed notice
shall be sent, and such advertisement shall appear, at least thirty (30) days prior to the sale date
and shall include the purpose, the time, the place and the terms of such sale with reference to the
prior advertisement, (72 P.S. §5860.612).

MOTION TO RESCHEDULE SALE
The Cumberland County Tax Claim Bureau,by its attorney, Keith O. Brenneman,
Assistant Cumberland-County Solicitor, submits this Motion to Reschedule Sale as follows:
1. On April 14, 2011 the Court issued an Order for a Judgment Sale to be held on July 7,
2011 with respect to the property of Mark A. Thesen and Sheila R. Thesen identified as Tax
Parcel No. 40-30-2644-026 and commonly known as 217 Pine Road, South Middleton Township
(the "Property").
2. On April 27, 2011 the Cumberland County Tax Claim Bureau (the "Tax Claim
Bureau")received notice that the property owners had filed for bankruptcy.
3. By Order dated June 29, 2011, the Court granted a Motion filed by the Tax Claim

4. Upon Motion of the Tax Claim Bureau, the Court issued an Order dated October 31,
2011 rescheduling the Judicial Sale of the Property for December 12, 2011.
5. The sale of the Property on December 12, 2011 was withdrawn by the Tax Claim
Bureau as a result of learning that although the Property owners, Mark A. Thesen and Sheila R.
Thesen, had been personally discharged, the bankruptcy case had not been closed and the
automatic stay imposed by the bankruptcy filing of the Property owners was still applicable.
6. On April 24, 2012 Chief Judge Mary D. France issued an Order modifying the
automatic stay to enable the Tax Claim Bureau to enforce its liens against the Property. A true
and correct copy of the Order issued April 24, 2012 is attached hereto and incorporated by
reference herein as 'Exhibit A."
7. This matter had been previously assigned to Judge M.L. Ebert, Jr.
WHEREFORE, the Cumberland County Tax Claim Bureau requests this Court to issue
an Order:
A. Rescheduling the Judicial Sale pursuant to 72 P.S. §5860.612(a) of Tax Parcel
No. 40-30-2644-026 for September 19, 2013, such that the property be sold freed and
cleared of all tax and municipal claims, liens, mortgages, charges and estates, except
separately taxed ground rents,to the highest bidder, at a sale to be held on September 19,
2013 at 10:00 a.m. in the Second Floor Courtroom of the Old Courthouse Building of the
Cumberland County Courthouse, and that the purchaser at such sale shall take and
thereafter have an absolute title to the property free and clear of all tax and municipal

PRIECIPE TO CONCLUDE JUDICIAL SALE
TO: Cumberland County Prothonotary
On May 2, 2013 the Court issued an Order to sell the above captioned property
at Judicial Sale. The Cumberland County Tax Claim Bureau sold said property at
Judicial Sale on September 19, 2013 to Jeremy Hunter and Lawrence Hodges and
recorded a deed in the Cumberland County Recorder of Deeds Office as instrument
number 201334449.
Proceeds from the sale will cover the delinquent taxes on the property. There
will be no further distribution.
Please mark the above captioned action discontinued and ended.
