PETITION FOR RULE FOR JUDICIAL SALE
AND NOW, comes the Cumberland County Tax Claim Bureau, by its attorney,
Stephen D. Tiley, Esquire, Assistant Cumberland County Solicitor, and files this Petition
for Rule for Judicial Sale, of which the following is a statement:
1. Your Petitioner is the County of Cumberland through its Tax Claim
Bureau, a Bureau created by the Real Estate Tax Sale Law. 72 P.S.
§5860.101, et sic.
2. Pursuant to 72 P.S. §5860.610, your Petitioner respectfully represents
as follows:
a. Tax claim upon which the property was exposed for sale: 2008 and
2009 Cumberland County, Library and Shippensburg Township real
estate taxes. 2008-09 and 2009-10 Shippensburg Area School
District real estate taxes. Total amount of claim, including penalty,
interest, and cost as of date of tax sale: $2,793.95.
b. Neither the owner, his, her, their, or its heirs, successors, assigns, or
legal representatives, or any lien creditor, or his, her, their or its
heirs, successors or legal representatives, or any other person
interested, has caused stay of sale, discharge of tax claim or
removal from tax sale.
c. The property was exposed to public sale pursuant to 72 P.S.
§5860.601 on: September 16, 2010.

d. Before exposing the property to public sale the Bureau fixed
the upset sale price, pursuant to 27 P.S. §5860.605, which upset
price was $3,208.65.
e. Your Petitioner, the Bureau, was unable to obtain a bid at the public
sale sufficient to pay the said upset price.
3. Attached hereto, marked Exhibit "A," and incorporated herein by
reference as is fully set forth herein, is a copy of a title report received
from a title searcher retained by the Bureau together with a reduced
copy of the most recent deed for the subject premises, as of the date of
the search. The tax parcel number of the property is 36-12-0320-052.
The property is situate in the Township of Shippensburg, Cumberland
County, Pennsylvania and is known as, Walnut Bottom Road, Lot 3.
4. The names and addresses of known parties holding tax and municipal
claims, liens, mortgages, ground rents, charges and estates against the
property are as follows:

WHEREFORE, Your Petitioner prays your Honorable Court to grant a rule upon
all interested parties, including those listed at paragraphs four and five of the within
Petition, to show cause why a decree should not be made that the property be sold,
freed and cleared of tax and municipal claims, liens, mortgages, charges and estates,
except separately taxed ground rents, pursuant to Section 612 of the Real Estate Tax
Sale Law. 72 P.S. §5860.612(a).

widower, testate, on the 14th day of December, 1987, and Letters Testamentary were duly issued
on the 21 st day of December, 1987 by the Register of Wills of Cumberland County,
Pennsylvania to J. Harold Kauffman, Leonard D. Goldring, W. Mickey Nye and Dauphin
Deposit Bank and Trust Company, docketed to No. 21-87-896; and
WHEREAS, the said Leonard D. Goldring has departed this earthly life and the
corporate successor to the said Dauphin Deposit Bank and Trust Company, by merger, to wit:
All First Trust Company of Pennsylvania, a national banking association, has withdrawn as Co-
Executor and the aforesaid Frank C. Nye has been appointed as a Successor Co-Executor as
more fully appears at large in those several PETITIONS to PERMIT AND APPROVE THE
WITHDRAWAL OF ALLFIRST TRUST COMPANY OF PENNSYLVANIA, N.A., AS CO-
EXECUTOR, and to APPOINT FRANK C. NYE AS A SUCCESSOR CO-EXECUTOR, filed
contemporaneously on the 28th day of February 2002 and the two (2) orders granting the prayers
of the said two (2) PETITIONS signed by the Honorable George E. Hoffer, P.J, on the 5th day of
March 2002, as well as, in that certain ORDER OF REGISTER issued by the Honorable Mary C.
Lewis, Register of Wills, dated the 9th day of April 2002 whereby the aforesaid Co-Executors
are now officially titled as Administrators C. f.A., but also, in some official documents known
and styled as Co-Executors, as per documents, orders and instructions docketed to the aforesaid

WHEREAS, the lands herein-mentioned have not been specifically devised.

BEING PART OF the same premises which Anna S. Himes, widow, by Deed bearing

Cumberland County, Pennsylvania, on the 9th day of May, 1956, in Record Book D, Volume 17,
Page 331, granted and conveyed unto Frank E. Hollar, Jr. and Janet M. Hollar, his wife, as
tenants by entireties. The said Janet M. Hollar having departed this earthly life on 18 September
1964, thereby vesting the entire fee in Frank E. Hollar, Jr. WHEREAS, the said Frank E.
Hollar, Jr. was vested in his lifetime with title to the premises hereinafter described in the
Township of Shippensburg, Cumberland County, Commonwealth of Pennsylvania; and
WHEREAS, the said Frank E. Hollar, Jr. departed this life, an unremarried widower, testate, on

with the appurtenances, unto the said Grantees, their heirs and assigns, to and for the only proper

NOTICE OF TAX SALE
To owners of properties described
in this notice and to all persons
having tax :liens, tax judgments or
municipal claims against such prop-
erties, notice is hereby given that the
TAX CLAIM BUREAU OF CUMBER-
LAND COUNTY will hold a JUDICIAL
SALE of the hereinafter listed proper-
ties on July 7, 2011 at 10:00 A.M.,
in the CUMBERLAND COUNTY OLD
COURTHOUSE, SECOND FLOOR,
Carlisle, Pennsylvania.
The properties will be sold free
and clear of all taxes and municipal
claims, mortgages, liens, charges,
and estate whatsoever kind, except
ground rents separately taxed and
year 2011 real estate taxes which
will not be discharged by the sale (**
where indicated, property is subject
to current municipal liens).
CONDITIONS OF SALE
1. The Tax Claim Bureau acting as
an agent of each taxing municipality
on which taxes are unpaid is selling
the taxable interest of the owner.
It makes no guaranty or warranty
whatsoever as to the existence or
condition of the property, accuracy
of ownership, size, boundaries, lo-
cations, existence of structures or
lack thereof, liens, titles, occupancy,
possession, or any other matter
whatsoever affecting the property.
It has attempted to comply with all
statutory rules regarding notice, and
retains records of such notices in
its office for public inspection, but
makes no guaranties or warranties
whatsoever.
2. An initial bid must equal the
Judicial Sale price as announced
at the sale for each property. If the
winning bid is $1,000.00 or less,
payment must be made in full at the
time the property is struck down by
cash in the form of currency of the
United States. For any bid exceeding
$1,000.00 a deposit of $1,000.00
cash, in the form of currency of the
United States, must be paid at the
time the property is struck with the
balance due by 3:00 p.m. the day of
the sale. The remaining balance must
also be paid by cash in the form of
currency of the United States, or cer-
tified funds, such as certified check,
cashier's check or money order pay-
able to County of Cumberland. Fail-
ure to pay the balance in full by 3:00
p.m. on the day of sale will result in
loss of the $1,000.00 deposit, the sale
will be voided, and the bidder will be
prohibited from bidding at future tax
sales. Any sale of properties that are
voided by failure to be paid in full by
3:00 p.m. maybe offered up again at
the next scheduled sale.
3. The Judicial Sale price of each
property includes all unpaid costs
and fees incurred since the property
has been in delinquent status. All
other outstanding liens or mortgages
will be divested by the Judicial Sale,
except 2011 real estate taxes and
where indicated current municipal
liens".
4. In addition to the bid price, the
purchaser will be required to pay the
costs of recording the deed and the
applicable realty transfer taxes of 2%
of the fair market value. For realty
transfer taxes, fair market value is es-
tablished by multiplying the current
assessment of the property by the
common level ratio factor for the year.
5. The Tax Claim Bureau will
record a deed to the purchaser or
purchaser's nominee, after which the
deed will be mailed to the address
given by the purchaser. Or in the
case of a mobile home, a bill of sale
will be provided, in the name of the
purchaser or purchaser's nominee,
and copy of the bill of sale will be
mailed to the address given by the
purchaser, and the purchaser will
be responsible for transfer of the
mobile home title. The purchaser is
solely responsible for resolving any
problems or difficulties in obtaining
possession of the property.

On February 10, 2011 the Court issued a Rule to Show Cause with a Rule
Returnable date of April 14, 2011 in regard to a Petition for a Judicial Sale of the above
captioned property. At said Rule Returnable hearing, the Court issued an Order to sell
the above captioned property at Judicial Sale on July 7, 2011.
On July 5, 2011, Tod G. & Lisa T. Shedlosky made payment to the Cumberland
County Tax Claim Bureau satisfying the 2008, 2009 and 2010 real estate taxes plus
cost on said property in the amount of $4,026.51.
