PETITION FOR RULE FOR JUDICIAL SALE
AND NOW, comes the Cumberland County Tax Claim Bureau, by its attorney,
Stephen D. Tiley, Esquire, Assistant Cumberland County Solicitor, and files this Petition
for Rule for Judicial Sale, of which the following is a statement:
1. Your Petitioner is the County of Cumberland through its Tax Claim Bureau,
a Bureau created by the Real Estate Tax Sale Law. 72 P.S. §5860.101, et
sic.
2. Pursuant to 72 P.S. §5860.610, your Petitioner respectfully represents as
follows:
a. Tax claim upon which the property was exposed for sale: 2007,
2008 and 2009 Cumberland County, Library and North Middleton
Township real estate taxes. 2007-08, 2008-09 and 2009-10 Carlisle
Area School District real estate taxes. Total amount of claim,
including penalty, interest, and cost as of date of tax sale:
$1,731.08.
b. Neither the owner, his, her, their, or its heirs, successors, assigns,
or legal representatives, or any lien creditor, or his, her, their or its
heirs, successors or legal representatives, or any other person
interested, has caused stay of sale, discharge of tax claim or
removal from tax sale.

C. The property was exposed to public sale pursuant to 72 P.S.
§5860.601 on: September 16, 2010.
d. Before exposing the property to public sale the Bureau fixed
the upset sale price, pursuant to 27 P.S. §5860.605, which upset
price was $ 2,411.57.
e. Your Petitioner, the Bureau, was unable to obtain a bid at
the public sale sufficient to pay the said upset price.
3. Attached hereto, marked Exhibit "A," and incorporated herein by reference
as if fully set forth herein, is a copy of a vehicle record abstract from the
Pennsylvania Department of Transportation, Bureau of Motor Vehicles,
referencing the mobile home by V.I.N. number 079166C0334 and owner
as John Holder. The tax parcel number of the property as recorded in the
assessment office is 29-15-1251-056 TR04299 and owner as John
Holder. The property is situate in the Township of North Middleton,
Cumberland County Pennsylvania, and is known as 101 Dawn Drive.
4. The names and addresses of known parties holding tax and municipal
claims, liens, mortgages, ground rents, charges and estates against the
property are as follows:

Delinquent tax claim payable through February 28, 2011:
$2,401.50 (Includes 2007, 2008, 2009 and 2010 county/ municipal

school real estate taxes collected by the Tax Claim Bureau and

Ground rent.
5. The last known address of the owner of the property as set forth in the
assessment records of Cumberland County is: John Holder, 34 Crescent
Drive, New Cumberland, PA 17070. Certified mail sent to said address has
been returned to the Bureau as unclaimed and regular first class mail sent to
same has not been returned. Mr. Holder has contacted the Bureau and
verified said address as being a correct.

WHEREFORE, Your Petitioner prays your Honorable Court to grant a rule upon
all interested parties, including those listed at paragraphs four and five of the within
Petition, to show cause why a decree should not be made that the property be sold,
freed and cleared of tax and municipal claims, liens, mortgages, charges and estates,
except separately taxed ground rents, pursuant to Section 612 of the Real Estate Tax
Sale Law. 72 P.S. §5860.612(a).

RULE TO SHOW CAUSE

Petition, a Rule to Show Cause is issued upon all interested parties to appear and show
cause why a decree should not be made that the property which is the subject of the
within Petition be sold freed and cleared of all tax and municipal claims, liens,
mortgages, charges and estates, except separately taxed ground rents. Service of this
Rule shall be made to all parties listed at paragraphs four and five of the within Petition
in the manner provided by Section 611 of the Real Estate Tax Sale Law 72 P.S.

This is not a summons, you are not required to appear before the court, however
you must appear if you desire to preserve your right to any interest or value in the real
estate which is the subject of this proceeding. If you do not appear you may lose any
ownership interest in the property or any right to any lien or other security interest in the
property.

03-28-2011 - I, Richard P. Keuerleber, Sheriff, who being duly sworn according to law, states he made
diligent search and inquiry for the within named defendant to wit: John Holder, but was unable to locate
the defendant in his bailiwick. Ther Sheriff therefore returns the within requested rule to show cause as
"Not Found" at 34 Crescent Drive, New Cumberland, PA 17070.

AND NOW, this 14tt' day of April, 2011 after Hearing on the Rule to Show Cause filed
pursuant to the Petition for Rule for Judicial Sale of the Cumberland County Tax Claim Bureau, it is
Ordered and Decreed, pursuant to 72 P.S.§ 5860.612 (a), that the property which is the subject of
the within Petition be sold freed and cleared of all tax and municipal claims, liens, mortgages,
charges and estates, except separately taxed ground rents, to the highest bidder at a sale to be
held on July 7, 2011 at 10:00 a.m. in the Second Floor Courtroom of the Old Courthouse Building of
the Cumberland County Courthouse, and that the purchaser at such sale shall take and thereafter

NOTICE OF TAX SALE
To owners of properties described
in this notice and to all persons
having tax liens, tax judgments or
municipal claims against such prop-
erties, notice is hereby given that the
TAX CLAIM BUREAU OF CUMBER-
LAND COUNTY will hold a JUDICIAL
SALE of the hereinafter listed proper-
ties on July 7, 2011 at 10:00 A.M.,
in the CUMBERLAND COUNTY OLD
COURTHOUSE, SECOND FLOOR,
Carlisle, Pennsylvania.
The properties will be sold free
and clear of all taxes and municipal
claims, mortgages, liens, charges,
and estate whatsoever kind, except
ground rents separately taxed and
year 2011 real estate taxes which
will not be discharged by the sale (**
where indicated, property is subject
to current municipal liens).
CONDITIONS OF SALE
1. The Tax Claim Bureau acting as
an agent of each taxing municipality
on which taxes are unpaid is selling
the taxable interest of the owner.
It makes no guaranty or warranty
whatsoever as to the existence or
condition of the property, accuracy
of ownership, size, boundaries, lo-
cations, existence of structures or
lack thereof, liens, titles, occupancy,
possession, or any other matter
whatsoever affecting the property.
It has attempted to comply with all
statutory rules regarding notice, and
retains records of such notices in
its office for public inspection, but
makes no guaranties or warranties
whatsoever.
2. An initial bid must equal the
Judicial Sale price as announced
at the sale for each property. If the
winning bid is $1,000.00 or less,
payment must be made in full at the
time the property is struck down by
cash in the form of currency of the
United States. For any bid exceeding
$1,000.00 a deposit of $1,000.00
cash, in the form of currency of the
United States, must be paid at the
time the property is struck with the
balance due by 3:00 p.m. the day of
the sale. The remaining balance must
also be paid by cash in the form of
currency of the United States, or cer-
tified funds, such as certified check,
cashier's check or money order pay-
able to County of Cumberland. Fail-
ure to pay the balance in full by 3:00
P.m. on the day of sale will result in
loss of the $1,000.00 deposit, the sale
will be voided, and the bidder will be
prohibited from bidding at future tax
sales. Any sale of properties that are
voided by failure to be paid in full by
3:00 p.m. maybe offered up again at
the next scheduled sale.
3. The Judicial Sale price of each
property includes all unpaid costs
and fees incurred since the property
has been in delinquent status. All
other outstanding liens or mortgages
will be divested by the Judicial Sale,
except 2011 real estate taxes and
where indicated current municipal
liens**.
4. In addition to the bid price, the
purchaser will be required to pay the
costs of recording the deed and the
applicable realty transfer taxes of 2%
of the fair market value. For realty
transfer taxes, fair market value is es-
tablished by multiplying the current
assessment of the property by the
common level ratio factor for the year.
5. The Tax Claim Bureau will
record a deed to the purchaser or
purchaser's nominee, after which the
deed will be mailed to the address
given by the purchaser. Or in the
case of a mobile home, a bill of sale
will be provided, in the name of the
purchaser or purchaser's nominee,
and copy of the bill of sale will be
mailed to the address given by the
purchaser, and the purchaser will
be responsible for transfer of the
mobile home title. The purchaser is
solely responsible for resolving any
problems or difficulties in obtaining
possession of the property.
