1. Minerva Lo DunkELberger, decedent, died testate on
September 30, 2002, and resided at 700 Market Street, Camp Hill,
Cumberland County, Pennsylvania.
2. Decedent's social security number is 180-10-1084.
3. Your Petitioner is Glenn B. Diller, whose address is 1010
Lewisberry Roa¢!, Lewisberry, Pennsylvania 17339, is the Executor
n~med in the Last Will and Testament of Decedent, a copy of which
is marked Exhibit D, attached hereto and made part hereof.
4. Decedent was not married on date of her death.
5. Decedent died testate on September 30, 2002, survived by
David Henke, nephew, of 4218 Grayton Drive, Waterford, Michigan
48328; Ruth Wittlet, niece, of 7402 Hill Drive, Houston, Texas, and
Kathryn Hayes, niece, of 4075 Glasglobe Drive, Sterling, Michigan,
48310.
6. No local inventory has been filed.
7. A state inheritance tax return was filed January
2003, showing no inheritance tax due, being a deficit estate.
8. Debts of decedent known to Petitioner consist of the

Dear Attorney Meyers:
Please be advised that the Department of Public Welfare maintains a
claim in the amount of $130,579.36 against the above-mentioned estate. This
claim is for restitution of medical assistance granted on behalf of the
decedent for which the Probate Estate is now responsible to reimburse the
Department according to Act 49, 62 P.S. 1412, effective August 15, 1994, as
amended by Act 20-95, effective June 30, 1995. Enclosed is the Department's
itemized statement of claim.
A portion of this medical expense, namely $22,795.52, was incurred
during the last six months of the decedent's life; therefore, it is a Class 3
claim pursuant to Section 3392 of the Decedents, Estates, and Fiduciaries
Code, 20 Pa. C.S.A. 3392(3). The balance of the claim, namely $107,783.84,
is to be entered as a priority Class 6 claim against the estate.
Please acknowledge receipt of this letter and advise whether the
Commonwealth's claim is admitted and when payment may be expected. If the
estate accounting is complete, please provide a copy. If the estate contains
real estate, please provide copies of the deed, the latest tax assessment,
and a current appraisal, if available.

MINERVA L. DUNKELBERGER
I, MINERVA L. DUNKELBERGER, a resident Of Fairview Township,
York county, Pennsylvania, being of sound and disposing mind,
memory and understanding, do hereby make, publish and declare this
to be my Last Will and Testament, hereby revoking all other Wills
and Codicils previously made by me.
ITEM I: I direct the payment of all my just debts, expenses
of my last illness, funeral expenses through Parthemore Funeral
Home, perpetual care of my burial lot, suitable marker for my grave
and the costs of administrating my estate from my estate as soon
after my death as Conveniently may be done.
ITEM II: I give, devise and bequeath all of the rest,
residue and remainder of my estate of every nature and wherever
situate, together with all insurance policies thereon to~ the
following then living to wit; DAVID HENKE 4218 Grayton Drive,
WaterfQrd, Michigan, 48328, RUTH WILLET 7402 Kite Hill Drive,
Houston, Texas, 77041, KATHRYN HAYES, 4075 Gasglobe Drive,
Sterling, Michigan, 48310; and in the event if none are then living
then to the BETHESDA MISSION, Harrisburg, Pennsylvania.
ITEM III: I direct that any and all taxes that may be
assessed in consequence of my death, including all Inheritance,
Estate and Transfer Taxes imposed upon my estate passing under my
Will or otherwise, shall be paid out of the principal of my
residuary estate as a part of the expense of the administration of
my estate.
ITEM IV: I authorize and empower my personal
representative and/or said Trustee representative to compromise,
adjust, release and discharge in such manner as my personal
representative may deem proper, all debts and claims owed by or to
me or my Estate; to sell, lease or exchange at public or private
sale or in such manner, at such prices, and upon such terms of
credit or otherwise, as my personal representative or said Trustee
may deem proper, all or any part of my property, real or personal;
to execute, acknowledge and deliver instruments of conveyance,
including deeds in fee simple; to borrow money for the purpose of
paying estate, inheritance or other taxes which are required to be
paid and to secure any such loan by pledge or mortgage of all or
any part of my property and to execute the necessary instruments
to carry out such powers; to distribute my estate in kind or partly
in money or partly in kind, and to determine the fair value at
which any property so distributed in kind shall be received by the~
distributees; to conduct any business in which I have an interest
at the time of my decease, for such period as my personal
representative may deem proper, power to borrow money and pledge
assets of the business and the power to do all other acts that I,
in my lifetime could have done, to delegate such power to any
partner, manager or employee without liability for any loss
occurring therein and to organize a corporation to carry on said
business as capital to such corporation and accept stock in the
corporation in lieu thereof and hold such stock for the uses of
this my Will, and to vote said stock or sell the same as to my
personal representative may seem best; to retain all stocks,
assets, bonds and investments owned by me without being confined
to what is known as legal investments; to execute any options to
purchase, to apply for stocks, bonds or other investments, to
purchase or otherwise acquire real estate and to execute the same
powers thereover as hereinbefore provided, to retain iqdefinitely
any part of my assets, real or personal, which is or may become
unproductive or to make sale thereof; to pay carrying charges and
expenses of the property out of other principal or income of my
estate; to invest and reinvest in all forms of property without
restriction to investments authorized for Pennsylvania fiduciaries,
as they deem proper, without regard to the principle of
diversification or risk; ~o exercise any law-given option to treat
administrative expenses either as income tax or as estate tax
deductions, without regard to whether the expenses were paid from
principal or income. The powers herein conferred shall be to my~
named personal representative and said Trustee and all successors
thereto and shall be in addition and not in limitation of other
powers conferred on said fiduciaries.
Any and all payment or payments of any sum or
sums, whether in cash or in kind and whether for principal or
income, payable to any beneficiary shall be made upon the sole
receipt of the respective beneficiary to whom the payment is made,
and free from anticipation, alienation, assignment, attachment, and
pledge and free from control by the creditors of any such
beneficiary.
ITEM V: I nominate, constitute and appoint GLENN DILLER
to be the sole executor of this my Last Will and Testament, to
serve without bond. In the event of the renunciation, death,
resignation, refusal or inability to act for any reason whatsoever
of GLENN DILLER, I nominate, constitute and appoint PNC BANK as
sole ExeCutor of this my Last Will and Testament, to serve without
bond.

Zf any tax due is paid aithin three (3) calendar months after the decedant's death, a five percent (eX) discount of
the tax paid is allowed.
The ISZ tax amnesty non-participation penalty is computed on the total of the tax and interest assessed, and not
paid before January 18, 1996, the first day after the end of the tax amnesty period. This non-participation
penalty is appealable in the same manner and in the the same time period as you mould appeal the tax and interest
that has been assessed as indicated on this notice.
INTEREST:
Interest is charged beginning aith first day of delinquency, or nine (9) months and one (1) day from the date of
death, to the date of payment. Taxes which became delinquent before January 1, 1982 bear interest at the rate of
six (6Z) percent per annum calculated at a daily rate of .OOOl6q. All taxes which became delinquent an and after
January 1, 19BI will bear interest at a rate which will vary from calendar year to calendar year with that rate
announced by the PA Department of Revenue. The applicable interest rates for 1982 through 2003 are:

PETITION TO AMEND PETITION FOR SETTLEMENT OF SMALL ESTATE
PURSUANT TO 30 PA. CONS. STAT. §3102
TO THE HONORABLE, THE JUDGES OF THE SAID COURT:
1. A Petition to Settle a Small Estate was filed by Glenn B.
Diller, your Petitioner in the above captioned matter.
2. On March 28, 2003, your petitioner received from Audrey
Aungst, decedent's Power of Attorney immediately prior to her
death, a refund check in the amount of $534.00 payable to Minerva
L. Dunkelberger, decedent, from HCR-Manor Care dated March 19,
2003.
3. Judge George E. Hoffer made a Decree on February 28, 2003,
upon the Petition filed awarding $182.15 remaining after costs of
administration to the Pennsylvania Department of Welfare.
4. The costs of administration included a fee of $325.00 to
your Petitioner who in fact received $235.00 as PNC Bank deducted
charges of $90.00 paying $449.55 rather than $539.55 listed in the
Petition.
5. In accordance with the said Petition filed the said
$534.00 less reimbursement to Glenn B. Diller of $90.00, Filing fee
of $9.00 and legal fee to Attorney Robert E. Myers of $75.00 is due
to Pennsylvania Department of Public Welfare.
WHEREFORE, Petitioner requests that this Court award the said
$534.00 as follows:

I, MINERVA L. DUNKELBERGER, a resident Of Fairview Township,
York cOunty, Pennsylvania, being of sound and disposing mind,
memory and understanding, do hereby make, publish and declare this
to be my Last Will and Testament, hereby revoking all other Wills
and Codicils previously made by me.
ITEM I: I direct the payment of all my just debts, expenses
of my last illness, funeral expenses through Parthemore Funeral
Home, perpetual care of my burial lot, suitable marker for my grave
and the costs of administrating my estate from my estate as soon
after my death as Conveniently may be done.
ITEM II: I give, devise and bequeath all of the rest,
residue and remainder of my estate of every nature and wherever
situate, together with all insurance policies t~ereon to' the
following then living to wit; DAVID HENKE 4218 Grayton Drive,
Waterford, Michigan, 48328, RUTH WILLET 7402 Kite Hill Drive,
Houston, Texas, 77041, KATHRYN HAYES, 4075 Gasglobe Drive,
Sterling, Michigan, 48310; and in the event if none are then living
then to the BETHESDA MISSION, Harrisburg, Pennsylvania.
ITEM III: I direct that any and all taxes that may be
assessed in consequence of my death, including all Inheritance,
Estate and Transfer Taxes imposed upon my estate passing under my
Will or otherwise, shall be paid out of the principal of my
residuary estate as a part of the expense of the administration of
my estate.
ITEM IV: I authorize and empower my personal
representative and/or said Trustee representative to compromise,
adjust, release and discharge in such manner as my personal
representative may deem proper, all debts and claims owed by or to
me or my Estate; to sell, lease or exchange at public or private
sale or' in such manner, at such prices, and upon such terms of
credit or otherwise, as my personal representative or said Trustee
may deem proper, all or any part of my property, real or personal;
to execute, acknowledge and deliver instruments of conveyance,
including deeds in fee simple; to borrow money for the purpose of
paying estate, inheritance or other taxes which are required to be
paid and to secure any such loan by pledge or mortgage of all or
any part of my property ~nd to execute the necessary instruments
to carry out such powers; to distribute my estate in kind or partly
in money or partly in kind, and to determine the fair value at
which any property so distributed in kind shall be received by the~
distributees; to conduct any business in which I have an interest
at the time of my decease, for such period as my personal
representative may deem proper, power to borrow money and pledge
assets of the business and the power to do all other acts that I,
in my lifetime could have done, to delegate such power to any
partner, manager or employee without liability for any loss
occurring therein and to organize a corporation to carry on said
business as capital to such corporation and accept stock in the
corporation in lieu thereof and hold such stock for the uses of
this my Will, and to vote said stock or sell the same as to my
personal representative may seem best; to retain all stocks,
assets, bonds and investments owned by me without being confined
to what is known as legal investments; to execute any options to
purchase, to apply for stocks, bonds or other investments, to
purchase or otherwise acquire real estate and to execute the same
powers thereover as hereinbefore provided, to retain iqdefinitely
any part of my assets, real or personal, which is or may become
unproductive or to make sale thereof; to pay carrying charges and
expenses of the property out of other principal or income of my
estate; to invest and reinvest in all forms of property without
restriction to investments authorized for Pennsylvania fiduciaries,
as they deem proper, without regard to the principle of
diversification or risk; to exercise any law-given option to treat
administrative expenses either as income tax or as estate tax
deductions, without regard to whether the expenses were paid from
principal or income. The powers herein conferred shall be to my'
named personal representative and said Trustee and all successors
thereto and shall be in addition and not in limitation of other
powers conferred on said fiduciaries.
Any and all payment or payments of any sum or
sums, whether in cash or in kind and whether for principal or
income, payable to any beneficiary shall be made upon the sole
receipt of the respective beneficiary to whom the payment is made,
and free from anticipation, alienation, assignment, attachment, and
pledge and free from control by the creditors of any such
beneficiary.
ITEM V: I nominate, constitute and appoint GLENN DILLER
to be the sole executor of this my Last Will and Testament, to
serve without bond. In the event of the renunciation, death,
resignation, refusal or inability to act for any reason whatsoever
of GLENN DILLER, I nominate, constitute and appoint PNC BANK as
sole ExeCutor of this my Last Will and Testament, to serve without
bond.
