I, MARJORIE A. HOOKS, of Mechanicsburg, Upper Allen Township,
Cumberland County, Pennsylvania, being of sound and disposing mind, memory and
understanding, do make, publish and declare this to be my Last Will and Testament
hereby revoking all other Wills and Codicils by me at any time heretofore made.
ITEM I: I direct that all of my just and currently due debts and funeral
expenses shall be paid from my estate as soon as practicable after my decease as a part of
the administration of my estate.
ITEM II: I direct that my Executrix named hereafter shall distribute my
tangible personal property in accordance with an unsigned memorandum attached to this,
my Last Will and Testament. Any remaining tangible personal items not set forth in the
unsigned memorandum shall become a part of the residue of my estate.
ITEM III. I give and bequeath the sum of One Thousand ($1,000.00)
Dollars to my son, JACK C. HOOKS, only if he survives me.
ITEM IV: I give and bequeath the sum of Four Thousand ($4,000.00)
Dollars to my neighbors, MR. and MRS. FRANCIS J. KESSLER, JR. of 311 Mt. Allen
Drive, Mechanicsburg, Pennsylvania, only if they survive me.
ITEM V: I give and bequeath the sum of Five Thousand ($5,000.00)
Dollars to my sister, DONNA DYE, of Londonderry, Ohio, only if she survives me.
ITEM VI: I give and bequeath the sum of Two Thousand ($2,000.00)
Dollars to the LAURA WILLIAMS of 306 Mt. Allen Drive, Mechanicsburg,
Pennsylvania, only if she survives me.
ITEM VII. I give and bequeath the sum of Five Thousand ($5,000.00)
Dollars to my granddaughter, SHANI WALTERS, of 3705 Pleasant Valley Road, York,
Pennsylvania, only if she survives me.
ITEM VIII. I give and bequeath the sum of Five Thousand ($5,000.00)
Dollars to my grandson, JACK C. HOOKS, of 305 Meadow Trail, Dillsburg,
Pennsylvania, only if he survives me.
ITEM IX. I give and bequeath the sum of Five Hundred ($500.00)
Dollars to the GARDEN CLUB OF HARRISBURG.
ITEM X. I give and bequeath the sum of Two Thousand ($2,000.00)
Dollars to JANET R. MAYS of 1092 Siddonsburg Road, Mechanicsburg, Pennsylvania,
only if she survives me.
ITEM XI:
of my estate in equal shares to the following organizations: HELEN O. KRAUSE
ANIMAL FOUNDATION, INC. of Mechanicsburg, Pennsylvania; HUMANE
SOCIETY OF HARRISBURG, PENNSYLVANIA of Harrisburg, Pennsylvania;
COLLIE RESCUE of Texaco Road, Mechanicsburg, Pennsylvania; and PAWS OF
PENNSYLVANIA, or to any successor organization of the above-named organizations.
ITEM XII: I nominate and appoint my good friend, JANET R. MAYS, as
Executrix of this my Last Will and Testament. In the event that she is unable or unwilling
to serve, then I appoint my sister, DONNA DYE, as Executrix of this my Last Will and
Testament. In the event that neither JANET R. MAYS or DONNA DYE are able or
willing to serve, then I appoint my attorney, FRANCIS A. ZULLI, as Executor of this my
Last Will and Testament.
ITEM XIII: It is hereby directed that my Executrix shall pay all
inheritance, estate, succession and legacy taxes to which my estate for the transfer of any
property hereunder may be subject, and to charge such taxes as a part of the expense of
the administration, payable out of my residuary estate.
ITEM XIV: I direct that no Executrix or other fiduciary named,
nominated or appointed in this my Last Will and Testament shall be required to post any
bond or give any security of any type for any purpose whatsoever, any law or rule of the

For dates of death on or a f 1, 1994 and befon / 1, 1995, the tax rate imposed on the net value of transfers to or for the use of the surviving
spouse is 3% [72 P.S. §91 [1.1) (i)].
For dates of death on or after January 1, 1995, the tax rate imposed on the net value of transfers to or for the use of the surviving spouse is 0% [72 P.S.
§9116 (a) (1.1) (ii)]. The statute does not exempt a transfer to a surviving spouse from tax, and the statutory requirements for disclosure of assets and tiling a
tax return are stilt applicable even if the surviving spouse Is the onJy beneficiary.
For dates of death on or after July 1, 2000:
The tax rate imposed on the net value of transfers from a deceased child twenty-one years of age or younger at death to or for the use of a natural parent, an
adoptive parent, or a stepparent of the child is 0% [72 P.S. §9116(a) (1.2)].
The tax rate imposed on the net varue of transfers to or for the use of the decedent's lineal beneticiaries is 4.5%, except as noted in 72 P.S. §9116(1,2) [72
P.S. §9116(a) (1)].
The tax rate imposed on the net value of transfers to or for the use of the decedent's siblings is 12% [72 P.S. §9116(a)(t.3)]. A sibling is detined, under
Section 9102, as an individual who has at least one parent in common with the decedent, whether by blood or adoption.

TO THE HONORABLE, THE JUDGE OF SAID COURT:
AND NOW, comes Janet R. Mays, Executrix of the Estate of Marjorie A. Hooks,
deceased and under the Will of said decedent, respectfully petitions the Court as follows:
1. Your Petitioner is Janet R. Mays, an adult individual, residing at
1092 Siddonsburg Road, Mechanicsburg, York County, Pennsylvania.
2. Your Petitioner, Janet R. Mays, is the duly appointed Executrix of the Estate of
Marjorie A. Hooks, deceased, late of Upper Allen Township, Cumberland County,
Pennsylvania, who died on August 3, 2003.
3. The Decedent, Marjorie A. Hooks, executed a Will dated September 30,2002
which was duly probated in the Register of Wills Office in and for Cumberland County
on August 7, 2003, indexed to the above number.
4. The Register of Wills of Cumberland County issued Letters Testamentary to
Janet R. Mays on or about August 7, 2003, indexed to the above referred to number.
5. The Decedent, Marjorie A. Hooks, in paragraph Item XI, in her Last Will and
Testament, bequeathed all of the rest, residue and remainder of her estate in equal shares
to the following organizations: "Helen O. Krause Animal Foundation, Inc. of
Mechanicsburg, Pennsylvania; Humane Society of Harrisburg, Pennsylvania; Collie
Rescue of Texaco Road, Mechanicsburg, Pennsylvania; and PAWS of Pennsylvania, or
to any successor organization of the above named organizations". A copy of the
Decedent's Last Will and Testament is attached hereto as Exhibit "A" and incorporated
herein by reference thereto.
6. Your Petitioner avers that the inventory of the assets of the estate of the
Decedent has been duly filed in the Register of Wills Office of Cumberland County, on
or about July 22, 2004.
7. Your Petitioner avers that the Pennsylvania Inheritance Tax Return was duly
filed in the Register of Wills Office of Cumberland County, on or about July 22, 2004.
8. Your Petitioner avers that the Department of Revenue has filed its Notice of
Inheritance Tax Appraisement and that all Pennsylvania inheritance taxes have been paid
in full.
9. Pursuant to Pennsylvania Orphans' Court Rule 5.5 Charities; Notice to the
Attorney General, the Petitioner provided notice to the Pennsylvania Office of Attorney
General advising that office of the designated charitable beneficiaries set forth in the
Decedent's Last Will and Testament.
10. Prior to preparation of a First and Final Account for the Estate of Marj orie A.
Hooks, deceased, counsel for the Estate made an inquiry to the Charitable Trusts and
Organizations Section of the Office of the Attorney General to determine the status of the
charitable organizations set forth in Item XI of the Decedent's Last Will and Testament.
11. By letter dated August 26, 2004, from Michael T. Foerster, Deputy Attorney
General, counsel for the Estate, was advised of the charitable status of the residuary
beneficiaries named in the Decedent's Last Will and Testament. The letter dated August
26, 2004, from Michael T. Foerster, Deputy Attorney General, is attached hereto as
Exhibit "B" and incorporated herein by reference thereto.
12. Under Item XI of the Decedent's Last Will and Testament, Collie Rescue of
Texaco Road, Mechanicsburg, Pennsylvania, is one of the organizations named to
receive one-fourth (1/4) of the rest, residue and remainder of the Decedent's Estate.
13. By letter dated October 13, 2004, from Michael T. Foerster, Deputy Attorney
General with the Charitable Trusts and Organizations Section of the Office of Attorney
General, counsel for the Estate, was advised that Collie Rescue of Central Pennsylvania,
with an address of 263 Texaco Road, Mechanicsburg, Pennsylvania, was in the process
of dissolving, thus the Estate of Marjorie A. Hooks was notified that it would be
inappropriate to distribute a one-fourth (1/4) share of the residue of the Estate proceeds
to Collie Rescue of Central Pennsylvania. Attached hereto as Exhibit "C" is a copy of
the letter dated October 13, 2004, from Michael T. Foerster, Deputy Attorney General,
and incorporated herein by reference thereto. Also, see letter dated November 15, 2004
from Michael T. Foerster, Deputy Attorney General, regarding the status of Collie
Rescue of Central Pennsylvania, attached hereto as Exhibit "D" and incorporated herein
by reference thereto.
14. As a result of the information and directive received from the Office of the
Attorney General of Pennsylvania, the Executrix believes that it would be inappropriate
to distribute one-fourth (1/4) of the residue of the Decedent's Estate to Collie Rescue of
Central Pennsylvania.
15. Your Petitioner has made an internet search through the Collie Club of
America for other Collie Rescue organizations located in the Commonwealth of
Pennsylvania. Such search reveals the names of three (3) Collie Rescue organizations
other than Collie Rescue of Central Pennsylvania. The three (3) other Collie Rescue
organizations located in Pennsylvania, are as follows:

16. Your Petitioner is in the process of completing the First and Final Account for
the Estate of Marjorie A. Hooks and she believes that the residue of the Estate available
foe distribution to the charitable organizations set forth in Item XI of the Decedent's Last
Will and Testament, will be a sum of approximately $170,000.00.
17. Your Petitioner believes and avers that the residuary share of the Decedent's
Estate, payable to Collie Rescue of Central Pennsylvania, should be paid to and divided
equally among the three (3) other Collie Rescue organizations existing in Pennsylvania
as designated in paragraph 15 above.
18. In light of the foregoing, the Petitioner requests that this Honorable Court
conduct a hearing as follows:
(a) To determine whether it would be appropriate to distribute one-
fourth (1/4) of the residue of the Decedent's Estate equally among
Anthracite Collie Rescue, Collie Rescue S/E PA, Inc. and
CR W. PA, Inc. in order to carry out Decedent's specific charitable
purpose as nearly as possible in the nature of a Cy Pres proceeding
under Section 6110 (a) of the Probate, Estate and Fiduciaries Code;
or
(b) in the alternative, determine whether the share of Collie Rescue of
Central Pennsylvania shall be distributed to one of the Collie Rescue
organizations set forth in paragraph 15 above.

19. Your Petitioner is giving notice of the filing of this Petition to the Attorney
General of Pennsylvania and each of the organizations who are set forth as the residuary
beneficiaries set forth in Item XI of Decedent's Last Will and Testament, and the
proposed distributees set forth in paragraph 15 above.
WHEREFORE, Petitioner requests the Court to conduct a hearing to determine
the identity of the organization or organizations entitled to receive the one-fourth (1/4)
share of the residual Estate under Item XI of Decedent's Will.

hereby revoking all other Wills and Codicils by me at any time heretofore made.
ITEM I: I direct that all of my just and currently dne debts and funeral
expenses shall be paid fi'om my estate as soon as practicable after my decease as a part of
the administration of my estate.
ITEM Ih I direct that my Executrix named hereafter shall distribute my
tangible personal property in accordance with an unsigned memorandum attached to this,
my Last Will and Testament. Any remaining tangible personal items not set forth in the
unsigned memorandum shall become a part of the residue of my estate.
ITEM III. I give and bequeath the sum of One Thousand ($1,000.00)
Dollars to my son, JACK C. HOOKS, only if he survives me.
ITEM IV: I give and bequeath the sum of Four Thousand ($4,000.00)
Dollars to my neighbors, MR. and MRS. FRANCIS J. KESSLER, JR. of 311 Mt. Allen
Drive, Mechanicsburg, Pennsylvania, only if they survive me.
ITEM V: I give and bequeath the sum of Five Thousand ($5,000.00)
Dollars to my sister, DONNA DYE, of Londonderry, Ohio, only if she survives me.
ITEM VI: I give and bequeath the sum of Two Thousand ($2,000.00)
Dollars to the LAURA WILLIAMS of 306 Mt. Allen Drive, Mechanicsburg,
Pennsylvania, only if she survives me.

SOCIETY OF HARRISBURG, PENNSYLVANIA of Harrisburg, Pennsylvania;
COLLIE RESCUE of Texaco Road, Mechanicsburg, Pennsylvania; and PAWS OF
PENNSYLVANIA, or to any successor organization of the above-named organizations.
ITEM XII: I nominate and appoint my good friend, JANET R. MAYS, as
Executrix of this my Last Will and Testament. In the event that she is unable or unwilling
to serve, then I appoint my sister, DONNA DYE, as Executrix of tt~is my Last Will and
Testament. In the event that neither JANET R. MAYS or DONNA DYE are able or
willing to serve, then I appoint my attorney, FRANCIS A. ZULLI, as Executor of this my
Last Will and Testament.
ITEM XIII: It is hereby directed that my Executrix shall pay all
inheritance, estate, succession and legacy taxes to which my estate for the transfer of any
property hereunder may be subject, and to charge such taxes as a part of the expense of
the administration, payable out of my residuary estate.
ITEM XIV: I direct that no Executrix or other fiduciary named,
nominated or appointed in this my Last Will and Testament shall be required to post any
bond or give any security of any type for any purpose whatsoever, any law or role of the
Court o~' the Commonwealth of Pennsylvania or any other jurisdiction to the contrary
notwithstanding.

letter you request comment on the charitable status of several organizations.
Enclosed please find several documents regarding those organizations. The first two
docutnents are search results from the Pennsylvania Bm:eau of Charitable Organizations showing
that the Helen O. Krause Foundation and the Humane Society of Harrisburg are charities
regis[ered to solicit donations in Pennsylvania. Thus, they are recognized charities. Third is a
printkd selection from the website for the parent organization of the Garden Club of Harrisburg.
Alth~bugh it is not stated which chapters, apparently 107 chapters are in the process of obtaining
501(~)(3) status, i recommend that you contact the organization if issue arises. Fourth, please
find ¢ printed page from the web site of Collie Rescue of Central PA. In that page, they assert to
have[obtained 501(c)(3) status. Finally, please find a similar page from the PAWS web site
whe~eln you will see that they claim to be recognized as 501(c)(3) exempt. While a 501(c)(3)
detegrnination is not necessarily binding on Pennsylvania, it is certainly persuasive.

our ltnderstanding that Tom Lewis is no longer in any position of leadership with the Collie
ResCue of Central Pennsylvania organization, if he is affiliated with the organization at all.
Moreover, we understand that the current principals have no intention o£maintaining ttrat
orgahization as a going concern. Given these circumstances, we will object to any proposed
distribution that provides benefit to Collie Rescue of Central Pennsylvania. I am hopeful that

The 15Z tax amnesty non-participation penalty is computed an the total of the tax and interest assessed, and not
paid before January 16, 1996, the first day after the end of the tax amnesty period.
INTEREST:
Interest is charged beginning mith first day of delinquency, or nine (9) months and one (1) day from the date of
death, to the data of payment. Taxes which became delinquent before January l, 198Z bear interest at the rate of
six (GZ) percent par annum calculated at a daily rate of .000164. All taxes which became delinquent on and after
January l, 1982 will bear interest at a rate which will vary from calendar year to calendar year with that rate

Collie Rescue of Central Pennsylvania a Petition for a proceeding in The Nature of Cy

A hearing has been scheduled for April 4, 2005 before the Honorable Judge Wesley Oler.
It is requested that the remaining twenty-five (25%) percent distribution of the residual
estate be held in escrow by the Executrix of the Estate, Janet R. Mays, pending final
disposition of the Cy Pres Petition and Order of Court.

AFFIDAVIT AND PETITION PURSUANT TO PA TITLE 15 use 15793
AND NOW, comes the Petitioner, Thorn Lewis, acting Pro Se, does seek the
protection and review of this Honorable Court, as an officer of the Charity Collie
Rescue of Central P A, Inc and as individual. I am an adult and competent to make this
affidavit based upon personal knowledge, and at all time relevant to this affidavit, I was
acting in my capacity as a member of the charity Collie rescue of Central P A, Inc.
1. The petitioner TROM LEWIS' home address is 263 Texaco Road,
Mechanicsburg P A, 17050 (hereafter referred to as "myself' or "f')
2. The charity, COLLIE RESCUE OF CENTRAL P A, INC. (hereafter
referred to as "the Charity") is a non profit registered kennel and 501(c)3 charity with a
registered corporate address of263 Texaco Road Mechanicsburg PA, Inc. that has 3
(three) board members, and.the Charity shares the address with Lewis.
3. That the charity, since Nov. 10,2002, by its charter, has 3 (three) board
members: Thorn Lewis (Myself) with Becky Mazlowski and Dr. Curtis Barnet (hereafter
referred to as Mazlowski and Barnet)

4. I am at all times relative to this petition, President and sole signatory for
all matters involving the Corporation, since November 10, 2002.
5. I have made repeated requests to Mazlowski and Barnet to produce the
corporate records, and they have refused to respond. (Exhibit A multiple pages)
6. The charity has been properly served with request for its records
on numerous occasions, to which it's Board members Barnet and Mazlowski have
refused to respond. (Exhibit A, multiple pages)
7. Around Nov 4,2004 Janet Mays and Francis Zulli (hereafter referred to as
Petitioner Zulli and Mays) did file before this court, a petition marked "Petition to
determine the identity of successor organization or, in the Alternative petition in the
nature ofCy Pres" Docket number 2003-00648. (hereafter referred to as Cy pres petition)
that contains the following material statements:
a. "Please be advised that it is our understanding that Tom Lewis is
no longer in a1Q' position of leadership with the Collie Rescue if he
is affiliated at all"
b. "Moreover, we understand the principles have no intention of
maintaining that organization as a going concern"
c. "given those circumstances, we will object to a1Q' proposed
distribution that benefits Collie Rescue. "
d. "lor service purposes, we understand that Collie Rescue of Central
PA is represented by Joseph A. Curcii/o...."
WHEREFORE, petitioners Zulli and Mays, have presented material facts in their
petition for Cy Pres, and have failed to notifY this Honorable Court that the Charity,
Collie Rescue of Central P A, Inc and myself, specifically deny the information contained
in the petition. Furthermore, because Attorney Joseph Curcillo has refused to provide the

charity or myself with any information whatsoever and has acted in violation of his
agreement with myself and Collie Rescue of Central P A, Inc, I hereby respectfully
request that this Honorable Court accept my affidavit and petition and exercise its
discretion and rights under PA Title 15, Corporations and Unincorporated Associations
(sections 5508, 5512, and 5793) section 5793, which states in relevant part:
5793(a) General Rule - Upon Petition of a1Q' person whose status as, or
whose rights or duties as, a member, director, member of another body, officer or
otherwise of a non profit corporation are, or may be affected by a1Q' corporate action, the
court may hear and determine the validity of such corporate action.
(b) Powers and Procedures. - The court may make such orders in a1Q'such
case as may be just and proPer, with the power to enforce the production of a1Q' books,
papers, and records of the corporation and other relevant evidence which may relate to
the issue....
I hereby respectfully request this Honorable Court hear and determine the validity
of the alleged corporate actions contained in the Cy Pres petition docket Number 2003-
00648 prior to accepting the information contained in the Cy Pres petition as factual. That
this Honorable Court order Mazlowski and Barnet to produce all records relative to the
corporation, and that a hearing be held to determine their validity.
I further request that this Honorable Court allow my voice to be heard at the start
any Cy Pres hearing to state my objections to, since it is my reputation and name that has
been defamed in the Cy Pres petition.

Since we've been unable to come together, I want to make one final attempt to see if you
are willing to cooperate. I am deeply concerned at the refusal or inability to produce the
corporate records that I have repeatedly requested. rrn also alarmed that you have refused
to attend the last nine monthly board meetings that you personally approved.
If you continue to refuse to produce all corporate documents at either the registered
corporate address of263 Texaco Road Mechanicsburg, 17050, or at the office of Don
Bailey, 4311 North 6th Street, Harrisburg PA 17110 (717-221-9500), I will have no
choice but to petition the court to take action against anyone who may be hiding records,
and I will have to do so in the next few days. Please contact Mr. Bailey as soon as possible
and let him know your intentions.
Our corporate charter indicates we have 3(three) board members, including myself. Both
you and Becky are in possession of Mr. Curcillo's letters identifYing me as one of 3 (three)
board members, and that he is my personal legal representative in the matters involving
Collie Rescue. It has come to my attention that Mr. Curcillo now claims there is a fourth
board member, which directly contradicts our corporate charter and Mr. Curcillo's
statements to the Attorney General's Office. You also both apparently signed an AVC on
June 28th, 2004 identifYing me as a board member, and I request those records be
produced at this time as well. As a result of some unknown information one of you gave
Mr. Curcillo, he is now refusing to cooperate with me in any manner.
Please check your records, and note that you, Becky, and myself unanimously voted Mr.
Curcillo as my personal legal representative, at a meeting in October 2003, and that he
identified himself: in writing, as such to the Attorney General and you.

Corporations and Unincorporated Associations Law, please consider this my demand for
the production of the corporation's records. Since I am a board member, President, and
maintain the corporate offices and kennel on my premises, my right to see the records on
demand is clear for both the performance of my duties and protection of the corporation
and it's members. Inaddition, I have the right to challenge any actions taken by the
corporation under section 5793.
