AND NOW, comes Benjamin Paxton, Defendant/Appellant, by his Attorney, Dirk E.
Berry, Esquire, and Clyde Barrick, Plaintiff/Appellee, by his Attorney, Robert R. Black, Esquire,
and AGREES as follows'
1. Whereas, judgment was entered for Clyde Barrick against Ben Paxton in the above
captioned matter for Eight hundred and twenty nine dollars and eighteen cents on March 29,
2001, and
2. Ben Paxton vacated the apartment on or about the first week of May, 2001, and
3. Ben Paxton appealed the above captioned matter and deposited in escrow at the
Prothonotary's Office of the Cumberland County Courthouse a sum of Eight hundred and eighty
dollars ($880.00), and
4. Clyde Barrick retains the security deposit for the apartment;
5. The parties hereby agree that Ben Paxton will withdraw his appeal, thereby releasing
the Eight hundred and eighty dollars ($880.00) in escrow with the Prothonotary's Office and
6. Clyde Barrick will retain the security deposit and accept the Eight hundred and eighty
dollars ($880.00) in full satisfaction of both the judgment in the above captioned matter and any
additional
rent that was due from March 29, 2001 during Ben Paxton's continued tenancy there.
