Plaintiff,,LVNV Funding LLC, by and through its attorneys, Edwin A. Abrahamsen &

Associates, P.C., complains of the Defendant as follows:
1. Plaintiff, LVNV Funding LLC, (hereinafter "Plaintiff') is a Delaware corporation
with a principal place of business located at 15 South Main Street Greenville, SC 29601.
2. The Defendant Darla M Huber (hereinafter "Defendant") is an adult individual
residing at 4700 N CLEARVIEW DR CAMP HILL PA 17011-4013.
3. At all relevant times herein, Plaintiff was engaged in the business of debt purchase
and collection.
4. Defendant applied for and received a credit card issued by Capital One with the
account number 5178052527996736.
5. The within account was sold by Capital One to LVNV Funding LLC for valuable
consideration and all rights under said accounts were assigned to LVNV Funding LLC.
6. Use of the Capital One credit card was subject to the terms and conditions of the
Cardmember Agreement (hereinafter "Agreement"), a copy of which was sent along to the
Defendant with the credit card. A copy of this document has been requested from Capital One,
and will be provided upon receipt.
7. Defendant used the Capital One credit card with account number,
5178052527996736, for purchases, cash advances and/or balance transfers. Use of the card in this
manner constituted acceptance of the terms and conditions and subjects the Defendant to the terms
and conditions contained therein.
8. The Defendant was mailed monthly account statements relative to the Defendant's
use of the subject credit card.
9. The Defendant defaulted under the terms of the Agreement by failing and refusing
to make monthly payments on the account as they became due.
10. The Defendant last made payment on July 15, 2008.
11. The principal amount was $$13,645.07 at the time of charge-off.
12. Pursuant to the account agreement, any unpaid balance accrues interest at the
contract rate of 6%.
13. The principal amount was $13,645.07 at the time it was received by Plaintiff.
14. The total amount due and owing the Plaintiff including interest, is $15,248.83.
WHEREFORE, Plaintiff requests judgment in its favor and against Defendant in the
amount of $15,248.83 plus costs of suit and any other relief as the Court deems just and
appropriate.

Defendant, Darla M. Huber, on the 3rd of March 2011, responds to Complaint as follows:
Defendant, Darla M. Huber, (hereinafter "Defendant") residing at 4700 N.
Clearview Drive, Camp Hill, PA 17011, is an individual defending herself in this action.
2. Defendant herein acknowledges having a legitimate account with Capital One,
maintained in good standing from 02/05 through 08/04/08, at which time Defendant fell behind
on such payments due to a myriad of extenuating circumstances, not the least of which was a
significant decline in income, and at which time my balance on said account was $11,731.41,
including consideration of an additional $39 past due fee and a $39 overlimit fee (with noted Past
Due Fees being the sole reason my account became subject to overlimit fees).
Defendant maintained regular communications with Capital One throughout and
following delinquency on account, including through the placement of said account with two
different debt collection agencies, GC Services Limited Partnership initially and subsequently
NCO Financial Systems Inc. The last known correspondence on this matter, being received
from NCO Financial Systems Inc. and dated 12/13/08, cited a balance at that time of $13,004.81
(although the account had not been accessed since July 2008, so that balance apparently already
included consideration of considerable penalties).
4. While other noted debt collection agencies representing this account sent
Defendant statements relating to account, including reference to making relevant payments
directly to Capital One in resolution of delinquency, Defendant has no record of ever receiving
such notice from LVNV Funding LLC, (hereinafter "Plaintiff'), or receiving any contact
whatsoever directly from Plaintiff
5. In fact, the first record Defendant has of LVNV was an entry on an Experian
credit report received in October 2010, that entry reflecting an Installment Arrangement Opened
03/2009, for an Original Loan Amount of $13,844, but reflecting a Balance of $17,298 As Of
6/14/2010. Please note that a similar entry also appeared for Capital One, giving the appearance
of two such outstanding debts-whereas Defendant believes if Plaintiff bought this account from
Capital One that only one such entry would be being reported to the credit bureaus. While
Defendant had intended to follow up on this new entry (i.e., no such entry existed when I'd
obtained a copy of my credit report in late 2009), as a sole proprietor, Defendant had not yet had
the opportunity to do so at the time I was served with this Complaint.
6. Similarly, Defendant did begin receiving what I would define as repetitive and
harassing phone messages on my work phone at all times of day and night from a firm
identifying itself as Edwin Abrahamsen, a debt collector, but without any indication as to what
debt they might be contacting Defendant about. Defendant believes those messages began
around October 2010.

7. Defendant hereby confirms that while it is Defendant's intent to make good on
my original Capital One account as my financial situation improves, my extreme reduction in
income and extenuating circumstances have made this impossible up to this point. However, it
is Defendant's belief that while currently enrolled in a Trial Modification period that should
reduce my monthly mortgage payment, Defendant will finally be in a position to begin working
on catching up on such arrears. However, at this time, Defendant has received no valid bill or
written notice or confirmation of validity of Plaintiffs claim against Defendant with all details
provided in the Civil Action Complaint generally available through my credit report.
8. Should Plaintiff provide sufficient evidence that they in fact do now own this
account and are in fact entitled to payment of such account, which Plaintiff's attorneys have now
indicated they don't currently have but should be able to provide through a recent conversation
with their office, Defendant will be happy to enter into a reasonable repayment arrangement.
Please note that Defendant feels such written proof is appropriate and necessary to request
considering past situations where Defendant has been contacted by similar law firms purporting
to represent creditors. In one such incident years ago, I did make payment to the purported debt
collector, only to find that neither my original creditor nor that debt collector would confirm
payment in order to get those accounts cleared from my credit report. More importantly, in
another very similar incident just last year, Defendant had to appear in District Court to defend
against a similar civil claim from a law firm purporting to represent a debt collection agency
(another agency that Defendant had personally never received any notice from or been contacted
by) that had purportedly taken over another credit card account of Defendant's--and the
Magisterial District Judge found in my favor and against the Plaintiff because the Plaintiff did
not and could not provide sufficient verification of assignment of that account (Docket No.: CV-
0000146-10). For those reasons, Defendant feels it is only fair and appropriate to demand more
formal confirmation that Plaintiff is now entitled to the payments it is requesting herein.
WHEREFORE, Defendant requests that Plaintiff be required to provide sufficient
evidence of entitlement to said amounts, including a full accounting of calculations used to arrive
at said amounts, and that should sufficient evidence be provided, Defendant be allowed to enter
into a repayment arrangement that allows a reasonable amount of time for repayment, as would
be necessary to remedy this situation.
I, Darla M. Huber, am fully familiar with the facts set forth in this Reponse to Complaint
and hereby verify the facts set forth within this response.
