Footitt and his minor child, Dylan Jonathan Scholl, by and through their attorney, Melissa P. Tanguay, Esquire, of ABOM & KUTULAKIS, L.L.P., who respectfully request that This Honorable Court allow the minor child to change his name to Dylan Jonathan Footitt, and in support thereof avers as follows: 1. Petitioner is Darren J. Footitt, on behalf of his minor child, Dylan Jonathan Scholl. 2. The child's date of birth is August 5, 2002 and he is currently eight (8) years old. 3. Petitioner has primary physical custody of the child. 4. The child resides with Petitioner at 5985 Eberly Drive, Mechanicsburg,Cumberla.nd County, Pennsylvania 17050. 5. Petitioner desires to change the child's name for the following reasons: a. Petitioner has had primary physical custody of the child for years; b. Petitioner desires for the child to have the same last name as his half-siblings whom he resides with the majority of the time; c. Petitioner desires to pass his family name to the child as his only son; and d. Petitioner desires to have less difficulty in communicating with the child's educational and medical providers. 8. Over the past five (5) years, the child has resided in the following locations: With Petitioner Darren ?. Footitt (the child's biological father and primary custodian): 2007 to present: 5985 Eberly Drive, Mechanicsburg, Cumberland County, Pennsylvania 17050 2004 to 2007: 2309 Warren Way, Mechanicsburg, Cumberland County, Pennsylvania 17050 With Alana Meghan Scholl (the child's biological mother and partial custodian: 2010 to present: 91 Cherry Drive, Marysville, Perry County, Pennsylvania 17053 2007 to 2010: 743 Valley Street, Apartment A, Marysville, Perry County, Pennsylvania 17053 2006 to 2007: 4210 Williamsburg Drive, Apartment F, Harrisburg, Dauphin County, Pennsylvania 17109 9. There are no judgments or decrees of record against the child. If This Honorable Court requires proof of such, Petitioner will provide this at the hearing on this Petition. 10. Petitioner will provide notice of the filing of this Petition and the hearing on this Petition in the Carlisle Sentinel and Cumberland Legal Journal. The child's fingerprints were placed on the fingerprint card on January 6, 2011 at the Hampden Township Police Department in Mechanicsburg, Pennsylvania. 12. The non-petitioning parent of the child is Alana Meghan Scholl. Petitioner will provide notice of the filing of this Petition and the hearing on this Petition to the non-petitioning parent. Petitioner is Darren J. Footitt, an adult individual residing at 5985 Eberly Drive, Mechanicsburg, Cumberland County, Pennsylvania, 17050, on behalf of his minor child, Dylan Jonathan Scholl. 2. The child's date of birth is August 5, 2002 and he is currently eight (8) years old. 3. Petitioner has had primary physical custody of the child. 4. The child resides with Petitioner at 5985 Eberly Drive, Mechanicsburg, Cumberland County, Pennsylvania 17050. 5. At the time of his birth child was given the name Dylan Jonathan Scholl. 6. On June 27, 2007, a Petition for Change of Name was filed by Petitioner and a hearing was held on May 19, 2011. 7. On May 20, 2011, this Honorable Court issues and order denying the Petition for Change of Name without prejudice to renew request on or after the child's twelfth (12t1) birthday. 8. Petitioner desires reconsideration of the Order of the Court for the following reasons: a. Petitioner has had primary physical custody of the child for years. b. Petitioner desires for the child to have the same last name as his half-siblings whom he resides with the majority of the time. c. Petitioner plans to pass his family name to the child as his only son. d. Petitioner desires to have less difficulty in communicating with the child's educational and medical providers. e. Child's mother appeared at the Name Change Hearing, however she was never formally sworn in to testify. f. Child's mother's only justification for denying the name change was the child has always been a Scholl and she provided no reason keeping the last name Scholl was in the best interest of the child. g. Petitioner has provided several reasons why it is in the best interest of the child to change his name from Scholl to Footitt. 2 WHEREFORE, Plaintiff, Darren J.
