FAMILY SETTLEMENT AGREEMENT
WAIVING FILING OF ACCOUNT
This Instrument (hereinafter "Agreement"), executed by HELEN HI~AWDER,
Individually and as Executrix (hereinafter "Beneficiary") of the Last Will Testament of
HENRY L. SHRAWDER, Deceased.
WITNESSETH:
WHEREAS, Henry L. Shrawder died on March 26, 2010, having f
published his Last Will and Testament dated October 12, 2007, in which
Helen Shrawder as Executrix; and
WHEREAS, on April 9, 2010, said Last Will was duly probated by
Wills of Cumberland County, Pennsylvania, and Letters Testamentary g
to Helen Shrawder, as Executrix; and
WHEREAS, the Executrix has proceeded with the administration
and HELEN SHRAWDER is personally familiar with the Estate assets;

been paid in full or reserved against by the Executrix, pending final billings (accountant

and 2010 income taxes), and Beneficiary desires all remaining Estates rrhs, if any, to
be distributed immediately upon the complete execution of this Agreem nt.
NOW THEREFORE, Helen Shrawder being the sole beneficiary ~if the assets of
the Estate of Henry L. Shrawder, does hereby acknowledge that she ha personal
knowledge of the existence and value of the Estate assets from the file Inheritance
Tax Return, bank statements, and other sources, both objective and pe final, and that
she has received, either in kind or the liquidated proceeds of all such as~e#s due by
virtue of Decedent's Last Will and Testament. ',
AND, Helen Shrawder does hereby stipulate that in view of her
personal knowledge and to avoid further expense and delay involved in h~ filing of a
formal Account and Schedule of Distribution, agrees that no Account is e~essary, this
Agreement is appropriate and final, and she consents to distribution bei g made
without the formal filing of an Account and Schedule of Distribution, suc f~greement to
be with the same force and effect as if the documents had been filed an confirmed by
the Orphans' Court Division of the Court of Cumberland County..
THEREFORE, Helen Shrawder shall and does hereby release, in~femnify,
forever discharge, and hold harmless Helen Shrawder, Executrix, Howar B. Krug,
Esquire and the law firm of Purcell, Krug & Haller, Attorneys for the Estat , 'as well as
their respective agents, employees, partners, heirs, successors, assigns, e~cecutors and
administrators, from all actions, suits, payments, accounts, and claims wf~atsoever,
touching upon the Estate of the Decedent. I~

Helen ShnwMder further agrees that should any liability or claim arise against the
Estate of the said Decedent after the signing of this Agreement, in view~,of the
distribution of all unreserved sums and assets to her, she covenants that the will be
solely responsible for satisfying same should the reserve sums be inadequate, including
but not limited to any and all taxes, liabilities, claims, demands, suits and causes of
action which may be successfully prosecuted or assessed against the Estate after the
signing, sealing and delivery of this Agreement.

undersigned officer, personally appeared HELEN SHRAWDER, Individually and a Executrix of the
Estate of Henry L. Shrawder, Deceased, known to me (or satisfactorily proven) to the person
whose name is subscribed to the within instrument, and acknowledged that she ex cuted this
Family Settlement Agreement for the purposes therein contained.
