Brenneman, submits this Complaint TOWNSHIP OF HAMPDEN, Plaintiff V. STANLEY N. DYE and SUSAN E. DYE, Defendants against the Defendants as follows: BACKGROUND. 1. Plaintiff Township of Hampden is a first class township of the Commonwealth of Pennsylvania with a principal office located at 230 South Sporting Hill Road, Mechanicsburg, Cumberland County, Pennsylvania, 17050. 2. Defendants Stanley N. Dye and Susan E. Dye, husband and wife, are adult individuals LAW OFFICES SNELBAKER & residing at 35 West North Street, Carlisle, Cumberland County, Pennsylvania, 17013. BRENNEMAN, P.C. 3. Defendants are the owners of a parcel or tract of land located at 90 Salem Church Road, Hampden Township, Mechanicsburg, Pennsylvania, identified as tax parcel No. 10-19- 1606-018 (the "90 Salem Church Road Property"). 4. Defendants are the owners of a parcel or tract of land at 155 Salem Church Road, Hampden Township, Mechanicsburg, Pennsylvania, identified as tax parcel No. 10-20-1838-005 (the "155 Salem Church Road Property") (the two properties referred to in Paragraphs 3 and 4 being referred to collectively as "Defendants' Properties"). 5. Defendants own and operate mobile home parks on both the 90 Salem Church Road Property and the 155 Salem Church Road Property. 6. Hampden Township operates the municipal sanitary wastewater collection system that provides service to the properties of the mobile home parks on the 90 Salem Church Road Property and the 155 Salem Church Road Property. 7. For more than 20 years, Hampden Township has issued charges to the Defendants for municipal sanitary wastewater collection service provided for the benefit of Defendants' Properties and Defendants' mobile home park businesses on the 90 Salem Church Road Property and the 155 Salem Church Road Property, which charges, except as specifically noted and claimed herein, were and had been paid by Defendants. 8. Plaintiff charges Defendants for the sanitary wastewater collection service provided to Defendants' Properties in accordance with rates and procedures established by Plaintiff. The averments of Paragraphs 1 through 8, inclusive, of this Complaint are incorporated by reference herein. 10. Defendants have failed and refused to pay Plaintiff in full and in a timely manner for charges for the sanitary wastewater collection service provided to and for the benefit of the 155 Salem Church Road Property. 11. Defendants' last payment on account of the sanitary wastewater collection service provided to and for the benefit of the 155 Salem Church Road Property was $3,000 applied November 29, 2010 with the previous payment on account being made by Defendants and applied September 10, 2010 in the amount of $2,500. 12. A true and correct copy of Defendants' utility billing account history report maintained by Plaintiff noting charges made for services provided the 155 Salem Church Road Property is attached hereto and incorporated by reference herein as "Exhibit All. 13. The charges made for sanitary wastewater collection services provided the 155 Salem Church Road Property are reasonable and have never been objected to Defendants. 14. Demand has been made upon Defendants to pay all amounts due for service provided to the 155 Salem Church Property, which payment Defendants have failed and refused to make. WHEREFORE, Plaintiff demands payment against Defendants, jointly and severally, in the amount of $48,682.37, together with interest and costs of this action. LAW OFFICES SNELBAKER & BRENNEMAN, P.C. 3 COUNT II Hampden Township, Plaintiff v. Stanley N. Dye and Susan E. Dye, Defendants 90 Salem Church Road Property 15. The averments of Paragraphs 1 through 14, inclusive, of this Complaint are incorporated by reference herein. 16. Defendants have failed and refused to pay Plaintiff in full and in a timely manner for charges for the sanitary wastewater collection service provided to and for the benefit of the 90 Salem Church Road Property. 17. Defendants' last payment on account of the sanitary wastewater collection service provided to and for the benefit of the 90 Salem Church Road Property was $3,000 applied November 29, 2010 with the previous payment on account being made by Defendants and applied September 10, 2010 in the amount of $2,500. 18. A true and correct copy of Defendants' utility billing account history report maintained by Plaintiff noting charges made for services provided the 90 Salem Church Road Property is attached hereto and incorporated by reference herein as "Exhibit B". 19. The charges made for sanitary wastewater collection services provided the 90 Salem Church Road Property are reasonable and have never been objected to Defendants. 20. Demand has been made upon Defendants to pay all amounts due for service provided to the 90 Salem Church Property, which payment Defendants have failed and refused to make. WHEREFORE, Plaintiff demands payment against Defendants, jointly and severally, in the amount of $47,709.41, together with interest and costs of this action. LAW OFFICES SNELBAKER & BRENNEMAN, P.C. 4 COUNT III Unjust Enrichment 21. The averments of Paragraphs 1 through 20, inclusive, of this Complaint are incorporated by reference herein. 22. By providing sanitary wastewater collection service to Defendants' Properties, Plaintiff confers and has conferred a benefit upon Defendants. 23. Defendants received and appreciated the benefit from the sanitary wastewater collection services provided by Plaintiff by being able to keep, maintain and operate mobile home parks on Defendants' Properties. 24. The provision of sanitary wastewater collection service to Defendants' Properties by Plaintiff allows Defendants to operate the mobile home parks on Defendants' Properties and to receive and collect rent and other charges from tenants and/or occupants thereof. 25. Defendants have kept and retained the benefit of Plaintiffs service to Defendants' Properties without making payment to Plaintiff therefor. 26. If would be inequitable and unjust for Defendants to retain the benefit of service provided by Plaintiff without making payment to Plaintiff. WHEREFORE, Plaintiff demands payment against Defendants, jointly and severally, in the amount of $96,391.78, together with interest and costs of this action. LAW OFFICES SNELBAKER & BRENNEMAN, P.C. COUNT IV Attorney's Fees 27. The averments of Paragraphs 1 through 26, inclusive, of this Complaint are incorporated by reference herein. 28. Pursuant to 53 P.S. § 7106, Plaintiff is authorized to collect reasonable attorney's fees in the collection of delinquent accounts. 29. In accordance with 53 P.S. § 7106, Plaintiff has adopted the required schedule for the collection of attorney's fees for delinquent sewer accounts pursuant to Chapter 18, Part 2, Section '209.6 of the Hampden Township Code of Ordinances. 30. On October 28, 2010 Plaintiff sent to Defendants by certified mail, return receipt requested, postage prepaid, written statements of the intention of Plaintiff to impose or assess attorney's fees and the manner by which such attorney's fees may be avoided by payment of delinquent amounts due. True and correct copies of the letters sent to Defendants October 28, 2010 with respect to both the 90 Salem Church Road Property and the 155 Salem Church Road Property are attached hereto and incorporated by reference herein as "Exhibit C" and "Exhibit D", respectively. 31. Defendants received the letters sent October 28, 2010 on October 29, 2010 as noted by the domestic return receipts for those letters, copies of which are attached hereto as "Exhibit E". 32. Plaintiff has incurred and will continue to incur legal fees through its Solicitor at its customary approved rate of $100.00 per hour in collecting on Defendants' delinquent accounts.
