CIVIL ACTION - COMPLAINT IN MORTGAGE FORECLOSURE And now comes Deutsche Bank National Trust Company, as Trustee for GSAMP 2006-FM I, by its attorneys, Zucker, Goldberg & Ackerman, LLC, and files this Complaint in Mortgage Foreclosure as follows: 1. The Plaintiff is Deutsche Bank National Trust Company, as Trustee for GSAMP 2006- FM1, having its principal place of business at 3476 STATEVIEW BLVD., FT. MILL, SC 29715. 2. The Defendants, Tanya M. Hitz and Steven M. Hitz, are individuals whose last known address is 242 Lowther Street, Lemoyne, PA 17043. 3. On or about January 18, 2006, Tanya M. Hitz executed a Note in favor of Fremont Investment & Loan in the original principal amount of $55,250.00. 4. On or about January 18, 2006, as security for payment of the aforesaid Note, Tanya M. Hitz, a married person joined by spouse, Steven M. Hitz made, executed and delivered to Mortgage Electronic Registration Systems, Inc., as nominee for Fremont Investment & Loan a Mortgage in the original principal amount of $55,250.00 on the premises hereinafter described, with said Mortgage being recorded in the Office of the Recorder of Deeds of Cumberland County on January 20, 2006, in Mortgage Book Volume 1938, Page 108. A, true and correct copy of said Mortgage containing a description of the premises subject to said Mortgage is marked Exhibit "A", attached hereto and made a part hereof. The aforesaid Note and Mortgage was assigned by Mortgage Electronic Registration Systems, Inc., as nominee for Fremont Investment & Loan to Deutsche Bank National Trust Company as Trustee for GSAMP 2006-FM1, plaintiff herein, pursuant to an assignment of mortgage dated December 12, 2008 and recorded on January 7, 2009 in the Office of the Recorder of Deeds for Cumberland County in Assignment Book, Page. 6. The aforesaid Mortgage was amended and increased in principal amount of $73,422.64 pursuant to a certain Modification Agreement, which is unrecorded at this time. The terms of said modification set forth the interest rate at 5.000% with a new monthly payment and interest amount of $ 419.66 commencing January 1, 2010 and continuing thereon with the due date of obligation February 1, 2036. A true and correct copy of said Modification Agreement is marked Exhibit B, attached hereto and made a part hereof. 7. Tanya Hitz and Steven M. Hitz, wife and husband as tenants by the entirety are record and real owners of the aforesaid mortgaged premises. 8. Defendants are in default under the terms of the aforesaid Mortgage and Note for, inter alia, failure to pay the monthly installments of principal and interest when due. 9. On or about January 6, 2011, Defendant(s) were mailed a combined Notice of Homeowners' Emergency Mortgage Assistance Act of 1983 and Notice of Intention to Foreclose Mortgage, in compliance with the Homeowner's Emergency Mortgage Assistance Act, Act 91 of 1983 and Act 6 of 1974, 41 P.S. §101, et seq. The Plaintiff is Deutsche Bank National Trust Company, as Trustee for GSAMP 2006-FMI, (hereinafter "plaintiff") through its servicing agent WELLS FARGO BANK, N.A. D/B/A AMERICA'S SERVICING COMPANY located at. 3476 STATEVIEW Bl,VD- FT, MILL. SC 219715. 2. Defendant, Tanya M. Hitz, is an individual whose last known address is 242 Lowther Street, Lemoyne, PA 17043. 3. Defendant, Steven M. flitz, is an individual whose last known address is 242 Lowther Street, Lemoyne, PA 170431. 4. On or about January 18, 2006, Tanya M. Hitz, a married person Joined by spouse, Steven M. Hitz made, executed and delivered to Mortgage Electronic Registration Systems, Inc., as nominee for Fremont Investment & Loan a Mortgage in the original principal amount of $55.250.00 on the premises hereinafter described in Exhibit "A", with said Mortgage being recorded in the Office of the Recorder of Deeds of Cumberland County on January 20, 2006, in Mortgage Book Volume 1938, Page 108. The mortgage is a matter of public record and is incorporated herein by reference in accordance with Pa.R.C.P. 1019(g), which rule relieves the Plaintiff from its obligation to attach documents to pleadings if those documents are of public record. The Mortgage was assigned by Mortgage Electronic Registration Systems, Inc. to Deutsche Bank National Trust Company, as Trustee for GSAMP 2006-FMI, plaintiff herein, pursuant to an assignment of mortgage dated December 12, 2008 and recorded on January 7. 2009 in the Office of the Recorder of Deeds for Cumberland County, Instrument#200900482. The Assignment is a matter of public record and is incorporated herein by reference in accordance with Pa.R.C.P. 1019(g), which rule relieves the Plaintiff from its obligation to attach documents to pleadings if those documents are of public record. 6. The aforesaid Mortgage was amended and increased in principal amount of $73,422.64 pursuant to a certain Modification Agreement by and between America's Servicing Company (Servicer) and Defendants, Tanya M. Hitz, which is unrecorded at this time. The terms of said modification set forth the interest rate at 5,000% with a new monthly payment and interest amount of$ 419.66 commencing January 1, 2010 and continuing thereon with the due date of obligation February 1, 2036. A true and correct copy of said Modification Agreement is marked Exhibit B. attached hereto and made a part hereof. 7. Tanya M. Hitz and Steven M. Hitz, wife and husband as tenants by the entirety are record and real owners of the aforesaid mortgaged premises. 8. Defendants are in default under the terms of the aforesaid Mortgage for, inter alia, failure to pay the monthly installments ol'principal and interest being contractually due for the September 2010 payment. 9. On January 6. 2011, Defendant(s) were mailed a combined Notice of Homeowners' Emergency Mortgage Assistance Act of 1983 and Notice of Intention to Foreclose Mortgage, in compliance with the Homeowner's Emergency Mortgage Assistance Act. As of 06/12/2012, the amount due and owing Plaintiff by Defendant(s) is as follows: Principal $72,305.08 Interest through 06/12/2012 $6.736.89 Escrow Advance $2,186.13 Late Charges $41.96 Inspection Fees $380.00 BPO/Appraisals $170.00 Corporate Advance Credit ($5.00) Total $81,815.06 plus interest and all other additional amounts authorized under the Mortgage and Pennsylvania Law, actually and reasonably incurred by Plaintiff, including but not limited to. costs (including escrow advances) and Plaintiffs attorneys' fees and expenses.
