HomeMy WebLinkAbout02-11-11February 15, 2011 To whom it may concern, I was informed by court staff that in order to schedule a video teleconference to obtain a marriage license due to my fiance being incarcerated at SCI SMITHFIELD I needed to petition the court to use the video conference equipment. The request is being presented to said jurisdiction due to the fact that Pennsylvania Law states that a marriage license acquired in any county is permissible to be used anywhere in the state of Pennsylvania. These documents were created for me by a third party so I may not have to endure the cost of an attorney. These exact documents (w/ name changes) have been used and accepted by President Judge Thomas F. Burke, Jr. and the Luzerne County Courts, so I am anticipating that they will be approved and acceptable also the Honorable Judge, Kevin A. Hess. HESS Commonwealth of Pennsylvania MOTION FOR A MARRIAGE LICENSE TELECONFERENCE TO THE HONORABLE PRESIDENT JUDGE KEVIN A. HESS Petitioner, WAYNE F. RIDEOUT, JR. #ED3837, proceeding Pro Se, hereby moves the following said court to Grant/Allow a Marriage License Teleconference to take place via the county's Register of Wills office OR Clerk of Court's office and represent's the following in support: 1. The Petitioner requests that the § 1306. (b) EXCEPTION as stated the ability of the absent applicant is able to obtain a marriage license through an affidavit, which verifies the information required under subsection (a), to the issuing authority. (c) FORM.-The department shall develop and make available affidavit forms to be used by applicants under subsection (b). (d) DEFINITION.-As used in this section, the term "active services or forces of the United States or this Commonwealth. (Oct. 27, 2006, P.L. 1192, No. 126, eff. 60 days), knowing this statutes were made of active military, but being the Petitioner has an exception also of not being able to be present due to being incarcerated. a. The Petitioner is requesting this privilege also apply to this particular circumstance. 2. The Petitioner's request that a Marriage License Teleconference be given is so to be in conformity with the DOC (Department of Corrections) policy and regulations governing an inmate's right to marry while incarcerated. 3. The said petitioner who resides at the State Correctional Institute Smithfield has been informed that only solemnized marriages are recognized throughout the DOC system. (2) 4. Petitioner, was also told that during certain times and periods only immediate family members i.e. (wife, children, mother, sister, brother) would be permitted to visit him during his incarceration and thereby felt that it was in the best interest of his family and his family's interest to have a legally binding union. 5. The petitioner further wishes his marriage be proper and binding so his partner CONSTANCIA MENDOZA-GASKILL will be able to handle financial and other affairs and responsibilities during the course of his continuing incarceration.
