CIVIL ACTION - LAW COMPLAINT The Plaintiff, HIGHER INFORMATION GROUP LLC and JGF FUNDING LLC, by its attorneys, KODAK & IMBLUM, P.C., brings this action of Assumpsit against the Defendant to recover the sum of NINETEEN THOUSAND NINE HUNDRED EIGHTY ONE DOLLARS AND EIGHTEEN CENTS ($19,981.18), along with interest thereon at the statutory rate of 6% from January 21, 2011, upon a cause of action of which the following is a statement: 1. The Plaintiff, Higher Information Group LLC and JGF Funding LLC, are both limited liability companies organized and existing under the laws of the State of Pennsylvania, duly registered and authorized to do business in the Commonwealth of Pennsylvania, having an office and place of business at 400 N. The Defendant, MINENT, LTD, doing business as CUMBERLAND PRINTING CO., is a corporation having its principal office and place of business at 4 W. ALLEN STREET, MECHANICSBURG, CUMBERLAND COUNTY, PENNSYLVANIA 17055. 3. The Defendant, SCOTT A. MINNICH, personal guarantor for Cumberland Printing Co., is an adult individual residing at 4 W. ALLEN STREET, MECHANICSBURG, CUMBERLAND COUNTY, PENNSYLVANIA 17055. 4. Defendant, MINENT, Inc. doing business as Cumberland Printing Co., is a corporation organized and existing under the laws of the Commonwealth of Pennsylvania, as more fully set forth on the Pennsylvania Department of State Corporation Bureau print out attached hereto, marked Exhibit "A" and made a part hereof. COUNTI JGF Funding LLC vs. Minent, LTD. d/ba Cumberland Printing and Scott A. Minnich as personal guarantor for the Toshiba Copier ES 520/CZG512031 Lease 5. On or about December 2, 2008, Defendant entered into a Lease Document and Guaranty of Lease with the Plaintiff for a Toshiba Copier, a true and correct copy of which is attached hereto, marked Exhibit "B" and made a part hereof. 7. The balance due by Defendantto Plaintiff is the sum of ELEVEN THOUSAND NINE HUNDRED SIXTY DOLLARS AND THIRTY-FOUR CENTS ($11,960.34) as set forth on Plaintiff's Statement of Account attached hereto, marked Exhibit "C" and made a part hereof. 8. The prices charged for said services provided were just and reasonable, were the legal and market prices therefor and were the prices which the Defendant promised and agreed to pay to Plaintiff. 9. Due to the default of Defendant(s), and pursuant to the terms and conditions of the Personal Guaranty executed by Defendant(s) attached hereto as an Exhibit, attorney's fees in the total amount of TWO THOUSAND THREE HUNDRED NINETY TWO DOLLARS AND SEVEN CENTS ($2,392.07) have been added to said account. 10. Plaintiffs Invoices are not attached to this pleading due to the voluminous nature of same and have previously been provided to Defendant. Plaintiff frequently demanded payment from Defendant of said amount due and owing as aforesaid, but Defendant refused and neglected and still refuses and neglects to pay said amount or any part thereof. WHEREFORE, Plaintiff brings this suit to recover from Defendant the sum of FOURTEEN THOUSAND THREE HUNDRED FIFTY TWO DOLLARS AND FORTY-ONE CENTS ($14,352.41), together with interest as set forth herein. Count - II Higher Information Group LLC VS, Minent, LTD. d/b/a Cumberland Printing LLC for the Toshiba Copier ES 520/CZG512031 Maintenance Contract 12. Plaintiff incorporates by reference paragraphs 1 through 11 above the same as if fully set forth at length herein. 13. On or about August 22, 2005, Defendant executed a contract with Plaintiff for the maintenance of the Toshiba Copier, a true and correct copy of which is attached hereto, marked Exhibit "D" and made a part hereof. 14. The balance due and owing by Defendant to Plaintiff under the maintenance contract is FIVE THOUSAND SIX HUNDRED TWENTY EIGHT DOLLARS AND SEVENTY-SEVEN CENTS ($5,628.77) as set forth on Plaintiff's Statement of Account attached hereto, marked Exhibit "E" and made a part hereof.
