APPEAL FROM SUSPENSION OF OPERATOR'S PRIVILEGE
AND NOW comes the Appellant, Mary Ann Dyarman, by and through her attorney, Karl E.
Rominger, Esquire, and avers the following:
I. Appellant resides at 201 Campground Road, Carlisle, Pennsylvania 17015.
2. Appellant received Notice dated January 28, 2011, stating that as authorized by Section
3804E21 of the Pennsylvania Vehicle Code, as a result of his violation of Section 3802B, her
driving privilege was being suspended for a period of one (1) year, effective March 4, 2011,
at 12:01 a.m. A copy is attached hereto as Exhibit "A".
3. The administrative order of the Pennsylvania Department of Transportation suspending
his license is improper.
4. The matter of the conviction is on appeal and due process requires PennDot wait to see if
the conviction stands.
5. The Legislature did not intend for a suspension to apply in this instance.

Dear MS. DYARMAN:
This is an Official Notice of the Suspension of your Driving
Privilege as authorized by Section 3804E2I of the
Pennsylvania Vehicle Code. As a result of your 10/29/2010
conviction of violating Section 3802B of the Vehicle Code
DUI BAC .10-<.16 on 11/28/2009:
¦ Your driving privilege is SUSPENDED for a period of 1
YEAR(S) effective 03/04/2011 at 12:01 a.m.
Before PennDOT can restore your driving privilege, you must
follow the instructions in this letter for COMPLYING WITH
THIS SUSPENSION, PAYING THE RESTORATION FEE and PROVIDING
PROOF OF INSURANCE. You should follow ALL instructions very
carefully. Even if you have served all the time on the
suspension/revocation, we cannot restore your driving priv-
ilege until all the requirements are satisfied.
COMPLYING WITH THIS SUSPENSION
You must return all current Pennsylvania driver's licenses,
learner's permits, temporary driver's licenses (camera
cards) in your possession on or before 03/04/2011. You may
surrender these items before, 03/04/2011, for earlier
credit; however, you may not drive after these items are
surrendered.
YOU MAY NOT RETAIN YOUR DRIVER'S LICENSE FOR IDENTIFICATION
PURPOSES. However, you may apply for and obtain a photo
identification card at any Driver License Center for a cost
of $13.50. You must present two (2) forms of proper iden-
tification (e.g., birth certificate, valid U.S. passport,
marriage certificate, etc.) in order to obtain your photo
identification card.
You will not receive credit toward serving any suspension
until we receive your license(s). Complete the following
steps to acknowledge this suspension.

1. Return all current Pennsylvania driver's licenses,
learner's permits and/or camera cards to PennDOT. If
you do not have any of these items, send a sworn nota-
rized letter stating you are aware of the suspension of
your driving privilege. You must specify in your letter
why you are unable to return your driver's license.
Remember: You may not retain your driver's license for
identification purposes. Please send these items to:

2. Upon receipt, review and acceptance of your Pennsylvania
driver's license(s), learner's permit(s), and/or a sworn
notarized letter, PennDOT will send you a receipt con-
firming the date that credit began. If you do not re-
ceive a receipt from us within 3 weeks, please contact
our office. Otherwise, you will not be given credit
toward serving this suspension. PennDOT phone numbers
are listed at the end of this letter.
3. If you do not return all current driver license pro-
ducts, we must refer this matter to the Pennsylvania
State Police for prosecution under SECTION 1571(a)(4)
of the Pennsylvania Vehicle Code.
PRISON RELEASE REQUIREMENT
The Court of CUMBERLAND CTY, Court Number 349, Court Term
2010 has sentenced you to serve a prison term for this vi-
olation. Pursuant to Section 1541(a.1) of the Vehicle Code,
you will not receive credit for this suspension/revocation
or any additional suspension/revocation until you complete
your prison term and you have complied with the requirements
listed in this letter. The Court must certify your com-
pletion to PennDOT. You may wish to contact your probation
officer and/or the Court after your release to make sure
that PennDOT is properly notified.
PAYING THE RESTORATION FEE
You must pay a restoration fee to PennDOT to be restored
from a suspension/revocation of your driving privilege. To
pay your restoration fee, complete the following steps:
1. Return the enclosed Application for Restoration. The
amount due is listed on the application.
2. Write your driver's license number (listed on the first
page) on the check or money order to ensure proper
credit.

3. Follow the payment and mailing instructions on the back
of the application.
Please note: Paying the restoration fee DOES NOT satisfy
the requirement to acknowledge your suspension/revocation.
If you have not acknowledged your suspension/revocation,
please follow the instructions listed under "Complying with
this Suspension/Revocation".
IGNITION INTERLOCK
Before your driving privilege can be restored you are re-
quired by law to have all vehicle(s) owned by you to be
equipped with an Ignition Interlock System. This is a result
of your conviction for Driving Under the Influence. You will
receive more information regarding this requirement approx-
imately 30 days before your eligibility date.
PROVIDING PROOF OF INSURANCE
Within the last 30 days of your suspension/revocation, we
will send you a letter asking that you provide proof of in-
surance at that time. This letter will list acceptable
documents and what will be needed if you do not own a vehicle
registered in Pennsylvania.
IMPORTANT: Please make sure that PennDOT is notified if you
move from your current address. You may notify PennDOT of
your address change by calling any of the phone numbers
listed at the end of this letter.
APPEAL
You have the right to appeal this action to the Court of
Common Pleas (Civil Division) within 30 days of the mail
date, JANUARY 28, 2011, of this letter. If you file an ap-
peal in the County Court, the Court will give you a time-
stamped certified copy of the appeal. In order for your
appeal to be valid, you must send this time-stamped certi-
fied copy of the appeal by certified mail to:

MOTION TO RELIST HEARING

NOW COMES, Respondent, the Commonwealth of Pennsylvania, Department of
Transportation (the "Department"), by and through its attorney, Philip M. Bricknell, and moves
for the relisting of the hearing of the above -captioned matter as follows:
1. In this matter, Dyarman is appealing a suspension of her motor vehicle operating
privilege imposed by the Department pursuant to Section 3804 of the Vehicle Code, 75 Pa.C.S. §
3804 (relating to penalties for driving under the influence of alcohol or controlled substance). A
copy of Dyarman's appeal is attached as Exhibit A.
2. The above captioned matter was scheduled for a hearing on May 5, 2011, at 1:30 p.m.
in Courtroom No. 4 of the Cumberland County Courthouse. A copy of the original scheduling
order, filed March 2, 2011, is attached as Exhibit B.
3. The hearing was continued indefinitely by Order of this Court entered on May 5,
2011, with "the matter to be relisted at the request of either party." A copy of the May 5, 2011
Order is attached as Exhibit C.
4. A continuance was requested because Dyarman was appealing her October 29, 2010
conviction for her DUI violation on Novebmer 28, 2009.
5. Dyarman unsuccessfully appealed her conviction to the Superior Court and the
Pennsylvania Supreme Court. A copy of the criminal docket for Dyarman's DUI conviction is
attached as Exhibit D.
6. Dyarman filed a petition for writ of certiorari in the U.S. Supreme Court, but it was
denied. See Exhibit D.
7. The appellate process having been exhausted for Dyarman's DUI conviction, the
Department now moves for the relisting of the hearing of Dyarman's appeal of
8. In light of the forgoing circumstances, the Department respectfully, moves that this
Court reschedule the hearing of Dookharan's appeal.
