No. 206.1(a)(2) and C.C. No. 206.1(a), to petition this Court to strike the satisfaction of judgment previously filed by Waste, and in support thereof, avers as follows: 1. Petitioner is the Plaintiff, Penn Waste, Inc. ("Penn Waste"), a Pennsyl corporation. 2. Respondent is the Defendant, Margaret Mary Spatz ("Spatz"), an adult indivi NOTICE PURSUANT TO THE FEDERAL FAIR DEBT COLLECTION PRACTICES ACT: THIS IS AN ATTEMPT TO COLLECT A DEBT. ANY INFORMATION OBTAINED WILL BE USED FOR THAT PURPOSE. 3. On February 23, 2011, Penn Waste entered judgment against Spatz in the of $1,341.84, such judgment being indexed to the above captioned case number. 4. A Writ of Execution was thereafter issue on the judgment in the total amount $1,388.80 (judgment amount plus post judgment interest). 5 of On March 1, 2012, Spatz tendered payment to Penn Waste in the amount Hof $1,588.00 in satisfaction of the judgment, post judgment interest and costs. Payment was in the form of a credit card payment submitted via Penn Waste's website. It is averred, information and belief, that the credit card utilized by Spatz belonged to her brother, Peter Iri and that Spatz was authorized to utilize the credit card for payment of the debt to Penn Waste. 6. As a direct result of the receipt of payment, Penn Waste took the necessary to cancel the pending sheriff's sale and to satisfy the judgment, including the filing of a to Remove, filed on March 8, 2012, which requested that the judgment be designated as In conjunction therewith, the Sheriff was requested to close its execution file. 7. Subsequent to the satisfaction of the judgment Penn Waste was notified that credit card holder was disputing the charge. On or about July 12, 2012, Penn Waste was by M&T Bank that the credit card payment to Penn Waste was reversed, such that the sum $1,588.00 was deducted from Penn Waste's bank account. By utilizing her brother's credit card to make payment to Penn Waste, Spatz tacitly representing that: a) she had the authority to make payment via that credit card; and (b) payment to Penn Waste from the credit card company was authorized. 9. Penn Waste justifiably relied on these representations (which now appear to false) such that when it initially received the funds from the credit card company it satisfied the judgment. 10. Penn Waste suffered harm in the form of monetary damages in the amount $1,588.00 as the result of Spatz's and/or her agents' subsequent actions in improperly the credit card charge after the judgment was satisfied. 11. Pursuant to Pennsylvania law, the Court may, through the exercise of its power equity, strike a judgment satisfaction when justice so requires. See A-1 Disc. Co. v. Nardi, 1 PA Super 177, 735 A.2d 121 (Pa. Super. Ct. 1999); Beck v. Beck, 435 Pa. Super. 449, 646 A. 589 (1994) 12. Spatz's actions in inducing Penn Waste to satisfy the judgment only to have payment later disputed amounts to fraudulent conduct. 13.
