CIVIL COMPLAINT
I. Plaintiffs Robert W. and Kristina M. Webb, husband and wife, are adult
individuals residing at 191 Meadow Lane, Mechanicsburg, Cumberland County, Pennsylvania.
2. Defendant Smith-Land and Improvement Corporation ("Smith") is a corporation
duly organized under the laws of Pennsylvania, with a place of business located at 845 Route 15
North, Dillsburg, Cumberland County, Pennsylvania and at all times hereto was engaged in the
business of storing personal property.
3. Defendant Smith is now, at all times relevant hereto was, engaged in the
warehouse business in the County of York, State of Pennsylvania, at the following address: 845
Route 15 North, Dillsburg, York County, Pennsylvania.
4. On or about July 10, 1999, Plaintiffs, as the owners, delivered to Defendant
Smith, among other property, the merchandise listed hereto as Exhibit "A" and incorporated
herein by reference.
5. The reasonable value of the merchandise at the time it was delivered for storage
was $19,021.94.

6. Under the Warehouse Contract entered into between the Plaintiffs and Defendant
Smith (attached hereto as Exhibit "8"), Defendant Smith undertook to exercise reasonable care
with respect to goods, as required by law, and Plaintiffs agreed to pay the storage and handling
charges.
7. On January 22, 2000, Plaintiffs discovered that the property stored at Defendant
Smith's storage unit had sustained water damage; the property was so extensively damaged that
it could not be sold or restored.
COUNT I
Plaintiffs v. Defendant Smith-Land and Improvement Corporation
8. Paragraphs I through 7 hereof are incorporated herein by reference as if fully set
forth.
9. The damage to the merchandise was caused by the following acts of negligence
by Defendant Smith that, separately or concurrently, were the proximate cause of the damage:
(a) Constructing and/or maintaining a warehouse with storage
facilities in an area where groundwater, or other sources of water,
accumulate during and after heavy rains, or at other times, when
Defendant knew or should have known of this condition;
(b) Improperly and inadequately constructing and/or maintaining a
warehouse that allowed groundwater, or other sources of water, to
enter and flood the storage facility;
(c) Failing to install proper draining system into the storage facility,
although Defendant knew or should have known that groundwater,
or other sources of water, could remain in the storage area by such
failure;
(d) Failing to install waterproof doors between the storage area and the
area leading into the storage facility, although Defendant knew or
should have known that groundwater, or other sources of water,
could enter the storage area by such failure;

(e) Failing to keep a watch person at the warehouse in order to guard
against the premises being flooded when it was raining and/or
snowing or when rain and/or snow was imminent, when Defendant
knew or should have known that heavy rains and/or snow created
an immediate hazard of flooding the storage area;
(f) Storing Plaintiffs' merchandise in the storage area when Defendant
knew or should have known that it would be seriously damaged if
exposed to water;
(g) Failing to remove Plaintiffs' merchandise from the storage area
when Defendant knew or should have known that heavy rains
and/or snow were imminent and would probably flood the storage
area;
(h) Failing to install discharge pressure pumps of sufficient capacity to
expel the wall of the floodwaters entering the storage area; and
(i) Failing to erect bulwarks or other devices to prevent water from
entering the storage area.
10. Plaintiffs immediately did everything possible to restore the merchandise to its
former condition.
11. Despite Plaintiffs' attempts at restoration, the goods were so extensively damaged
that they could not be sold or restored.
12. By reason of the above, Plaintiffs have been damaged in the sum of $19,021.94.
Such amount represents the costs of the goods, the expenses of restoration and other expenses
incurred by Plaintiffs.
13. Although a demand has been made on Defendant for the damages set forth above,
Defendant has refused to pay such damages or any part of them.
WHEREFORE, Plaintiffs Robert and Kristina Webb demand judgment in their favor and
against Defendant Smith-Land and Improvement Corporation, for the damages, which fall within

the limits for compulsory arbitration in Cumberland County, together with costs, interest, and/or
damages for delay against said Defendant as allowed by law.
COUNT II
Plaintiffs v. Defendant Smith-Land and Improvement Corporation
14. Paragraphs I through 13 hereof are incorporated herein by reference as if fully set
forth.
15. Plaintiffs performed their own obligations in the terms of the contract, and all
conditions precedent to Plaintiffs' right of action for Defendant's breach of contract have
occurred or been performed.
16. The basis of Plaintiffs' above Count II is Defendant's breach of contract,
specifically the failure to exercise reasonable care with respect to the storage of Plaintiffs' goods.
WHEREfORE, Plaintiffs Robert and Kristina Webb demand judgment in their favor and
against Defendant Smith-Land and Improvement Corporation, for the damages, which fall within
the limits for compulsory arbitration in Cumberland County, together with costs, interest, and/or
damages for delay against said Defendant as allowed by law.

Hello. Below is the list of items that were damaged due to the water problems with storage unit F 003 at Rt. 15 Storage in
Dillsburg, per our phone conversation this morning. Some items were already fixed, receipts are provided for repair costs.
Some items are discontinued, and we would appreciate if all items be restored to the state that they were in prior to using
the storage shed. Some items are unrepairable and repair cost would exceed replacement costs, so we have given you the
replacement cost. Repair quotes are provided from Moffitt-Smith, Inc. in Mechanicsburg, SH Black and Son Fabrizone
Cleaning Systems, as well as a letter from my allergists office, Dr. Robert Zuckerman-Allergy & Immunology. "Soft" items
such as the mattresses, rug and upholstered items would be better for me (Kristina) if they were replaced -not cleaned due
to health reasons. I have already experienced difficulty with my asthma due to the mold and mildew and have discussed the
situation of these items with Physicians Assistant Michael G. Spaeder. Wood items have been wiped down with c1orox
water to kill the mold by members of my family, but the stains and damage still remain.

The buffet got wet/mold has stained furniture/wood has split, bottom drawers are moldy, tracks are rusted,

This is a brand new-never used piece that was intended for our new home. Receipt of purchase

I am disappointed with what happened at the unit and hope that in the future it will be repaired so that it is indeed a dry
unit for potential storage renters. For us, going through the process of building a $225,000 new home was challenging
enough-and then to find your home's contents ruined when it came time to move in was very disheartening. My husband
and I would appreciate your prompt attention to this matter, and to the fixing of the storage unit so that this does not
happen again to some other family. Please feel free to contact any of the people I have provided letters or quotes from.

SMITH-LAND AND IMPROVEMENT CORPORATION. TO PLAINTIFFS' COMPLAINT
AND NOW, comes Defendant, Smith-Land and Improvement
Corporation ("Defendant"), by and through its undersigned
counsel, Stephen E. Geduldig, Esquire, of Thomas, Thomas &
Hafer, LLP, and files the following Answer and New Matter to
Plaintiffs' Complaint:
1. Denied pursuant to Pa. R.C.P. 1029(e).
2. Admitted that Defendant owns Rt. 15 Self Storage.
However, Defendant is a Delaware corporation.
3. Admitted.
4. Denied as a legal conclusion and pursuant to Pa.
R.C.P. 1029(e). On the contrary, Plaintiffs had custody of and
control over any property which may have been stored at the
facility they rented from the Defendant in accordance with the
Lease which is attached to Plaintiffs' Complaint as Exhibit "B".
5. Denied as a legal conclusion and pursuant to Pa.
R.C.P. l029(e).
6. Denied as a legal conclusion and pursuant to Pa.
R.C.P. l029(e). By way of further response, the contract which
is attached to Plaintiffs' Complaint as Exhibit "B" is a legal
writing which speaks for itself. Defendant denies any attempt
on the part of Plaintiffs to qualify, characterize or summarize
the clear wording of the Lease contract.
7. Denied as a legal conclusion and pursuant to Pa.

WHEREFORE, Defendant, Smith-Land and Improvement Corporation,

NEW MATTER
17. Defendant, Smith-Land and Improvement Corporation,
incorporates herein by reference, as if fully set forth at length,
Paragraphs 1 through 16 of its Answer to Plaintiffs' Complaint.
18. Allor some of Plaintiffs' claims may be barred by the
Economic Loss doctrine.
19. Plaintiffs' Complaint fails to allege a cause of
action in negligence and in breach of contract.
20. If Plaintiffs' Complaint alleges a cause of action in
negligence, which is specifically denied as aforesaid, then
Plaintiffs' claim is barred or limited by Plaintiffs' own
comparative negligence.
21. If Plaintiffs' Complaint alleges a cause of action for
breach of contract, which is specifically denied as aforesaid,
then Plaintiffs breached the clear and unambiguous terms of the
contract.
22. Based on the clear and unambiguous terms of the
contract, which were accepted by the Plaintiffs, Plaintiffs
declined the Customer Storage Insurance Program and, by doing
so, agreed to personally assume the risk of loss or damage to
all property stored in the Storage Unit, whether the property
was owned by Plaintiffs or others; therefore, Plaintiffs' claim
is barred for this additional reason.

23. Not all of Plaintiffs' alleged damages and losses were
caused by any alleged condition of the property, as alleged by
Plaintiffs in their Complaint.
24. Plaintiffs' claim is barred or limited by their
failure to mitigate their damages.
25. Plaintiffs' claim may be barred or limited by the
doctrine of laches, accord and satisfaction, release and/or
waiver and estoppel.
26. Defendant did not design or construct the storage
facility.
27. Defendant had no prior notice of any alleged condition
of the storage facility.
WHEREFORE, Defendant, Smith-Land and Improvement Corporation,
respectfully requests that judgment be entered in its favor and
against the Plaintiffs.
