BOOZ MILK TRANSPORT, INC., Defendant CIVIL ACTION - LAW NO. COMPLAINT AND now comes the Plaintiff, Frederick Armstrong Fox, t/d/b/a Gaumer Industries, who, by and through his attorneys, Charles O. Beckley, II, Esquire, Thomas S. Beckley, Esquire, and Beckley & Madden, of Counsel, files this Complaint, and in support thereof avers as follows: 1. Plaintiff is Frederick Armstrong Fox, an adult individual trading and doing business as "Gaumer Industries." "Gaumer Industries" is a duly registered fictitious name in Pennsylvania. Gaumer Industries maintains it offices at 150 Derbyshire Street, Chambersburg, Franklin County, Pennsylvania 17201. 2. Defendant is Booz Milk Transport, Inc. ("BMT"), a Pennsylvania corporation with an address of 199 Booz Road, Shippensburg, Cumberland County, Pennsylvania 17257. 3. Among other things, Gaumer Industries operates a vehicle repair facility, commonly known as a "spring shop," at its Derbyshire Street property in the Borough of Chambersburg. 1 4. During the period from November 24, 2010, through January 31, 2011, BMT asked Gaumer Industries to perform repairs to various pieces of equipment delivered to Gaumer Industries by BMT and, upon information and belief, either owned or leased by BMT. 5. Gaumer Industries performed the repairs which BMT requested and presented BMT with invoices on the following dates and in the following amounts for the labor and materials supplied by Gaumer Industries: DATE INVOICE NO. Despite demand therefor, BMT has refused to make payment to Gaumer Industries for the labor and materials supplied by Gaumer Industries. The total amount due and owing from BMT to Gaumer Industries is currently $18,800.71, plus interest at the rate of 1.30 percent (1.30%) per month, as set forth in the invoices. 2 COUNT I - BREACH OF CONTRACT 7. Gaumer Industries hereby incorporates herein by reference the foregoing Paragraphs 1-6 of this Complaint as though set forth in full. 8. BMT and Gaumer Industries entered into an agreement pursuant to which Gaumer Industries agreed to perform service work on the equipment delivered to Gaumer Industries by BMT, and BMT agreed to pay Gaumer Industries for the labor and materials supplied by Gaumer Industries. 9. Pursuant to their agreement, Gaumer Industries performed service work on BMT's equipment but, despite demand therefor, BMT has refused to make payment to Gaumer Industries for the labor and materials supplied by Gaumer Industries. 10. BMT currently owes to Gaumer Industries the sum of $18,800.71, plus interest at the rate of 1.30 percent (1.30%) per month, which amount represents the fair and reasonable value of the labor and materials supplied by Gaumer Industries in servicing BMT's equipment. 11. Gaumer Industries has performed all conditions precedent to its right to receive payment from BMT. 12. The amount demanded by Gaumer Industries does not exceed the maximum for submission to compulsory arbitration. WHEREFORE, Plaintiff, Frederick Armstrong Fox, t/d/b/a Gaumer Industries, respectfully requests the Court to enter judgment in his favor and against Booz Milk Transport, Inc., in the amount of $18,800.71, plus prejudgment and post judgment interest at the rate of 1.30 percent (1.30%) per month, plus costs of suit and such other and further general relief which the Court deems appropriate. 3 l COUNT II - UNJUST ENRICHMENT 13. Gaumer Industries hereby incorporates herein by reference the foregoing Paragraphs 1-6 of this Complaint as though set forth in full. 14. The labor and materials provided by Gaumer Industries substantially enhanced the value and usefulness of BMT's equipment. $18,800.71 represents the fair and reasonable value of the labor and materials supplied by Gaumer Industries in servicing BMT's equipment. 15. BMT would be unjustly enriched if it were permitted to retain the value of the labor and materials supplied by Gaumer Industries without paying for them. 16. The amount demanded by Gaumer Industries does not exceed the maximum for submission to compulsory arbitration. WHEREFORE, Plaintiff, Frederick Armstrong Fox, t/d/b/a Gaumer Industries, respectfully requests the Court to enter judgment in his favor and against Booz Milk Transport, Inc., in the amount of $18,800.71, plus prejudgment and post judgment and costs of suit, and such other and further general relief which the Court deems appropriate.
