The Petitioner is the Cumberland County Aging & Community Services, in and for Cumberland County, Pennsylvania, with its office located at 1100 Claremont Road, Carlisle, Cumberland County, Pennsylvania. 2. George W. King currently resides at Claremont Nursing and Rehibiltation Center located at 1000 Claremont Road, Carlisle, Cumberland County, Pennsylvania. 3. On August 20, 2010, a Petition for the Appointment of Permanent Plenary Guazdians of the Person and Estate of George W. King was filed in the Orphan's Court Division of the Court of Common Pleas, in and for Cumberland County, Pennsylvania to No.21-10-0842 and on September 24, 2010, after hearing George W. King was adjudicated to be an incapacitated person and Cumberland County Aging & Community Services was appointed Permanent Plenary Guardians of the Person and Estate of George W. King. A copy of the Final Decree dated September 24, 2010 is attached hereto, marked as Exhibit "A", and incorporated herein by reference. 4. Prior to moving to Clermont Nursing and Rehibiltation Center, George W. King resided at 6027 William Drive, Mechanicsburg, Cumberland County, Pennsylvania. 5. Public records reflect that George W. King and Mary E. King are the owners of the real estate situated at 6027 William Drive, Mechanicsburg, Cumberland County, Pennsylvania, as joint tenants. A copy of the Deed for said property is attached hereto, marked as Exhibit "B", and incorporated herein by reference. 6. Mary E. King, wife of George W. King died on June 25, 2010 and, by operation of law, title to said premises vested solely in George W. King. A copy of the Death Certificate for Mary E. King is attached hereto, marked and Exhibit "C", and incorporated herein by reference. 7. The real estate presently sits empty but is in good condition. 8. The Cumberland County Tax Assessment on 6027 William Drive, Mechaanccsburg, idenfified as Parcel No.10-19-1604-147 is assessed at $154,000.00. A copy of the assessment is attached hereto, marked as Exhibit "D", and incorporated herein by reference. 9. An appraisal of said property was conducted on November 11, 2010 by Diversified Appraisal Services of 36 East High Street, Carlisle, Cumberland County, Pennsylvania and the fair market value was determined to be $163,000.00. A copy of the appraisal is attached hereto, marked as Exhibit "E", and incorporated herein by reference. 10. The Petitioner believes and, therefore, avers that there are presently no mortgages or judgments recorded. 11. Cumberland County Aging & Community Services, the appointed Permanent Plenary Guardian of the Person and Estate of George W. King believes and, therefore, avers that the sale of said real estate is in the best interest of the Estate of George W. King and the proceeds from said sale will be needed to pay for his continuing care at Clazemont Nursing and Rehabilitation Center. 12. The Petitioner will engage the services of a realtor to sell the property. WHEREFORE, the Petitioner respectfully requests that this Honorable Court enter an Order directing the sale of 6027 William Drive, Mechanicsburg, Cumberland County, Pennsylvania (Parcel No.: 10-19-1604-147) owned by George W. King, "AS IS -WHERE IS" with all faults and current conditions to an appropriate buyer and that Petitioner be authorized to execute any and all documents relating to the sale by signing as Guardian of the Person and Estate of George W. Section 5511 with respect to George W. King, an allegedly-incapacitated person, and f ollowing a hearing at which the allegedly-incapacitated person was not present (his presence having been excused by the Court, with the consent of his couxt-appointed counsel), and at which evidence was presented by the Petitioner in support of the Petition, and based upon the foregoing Findings of Fact, the Court finds that George W. King is an incapacitated person, he is consequently adjudicated as such, and Petitioner, Cumberland County Aging and Community Services, is appointed plenary guardian of his person and estate. The fee schedule submitted as Petitioner's Exhibit 2 in this case is expressly approved; and Cumberland County Aging and Community Services is authorized to obtain payment of a guardian fee subject to a maximum of ten pexcent of George W. King's gross monthly income or $100 per month, whichever is less, at such time that George W. King no longer has sufficient assets to pay for guardianship services and would qualify for medical assistance, No bond shall be zequired of the guardian- The guardian shall file on a timely basis with the court all reports and accounts required by statute.
