GOODLING CONSTRUCTION, Contractor In the Court of Common Pleas County of Cumberland, Pennsylvania c9o7 -/0 t Term 2002 WHEREAS, Judd M. Mumford and Carol Y. Kang, husband and wife, Owners, of 4178 Nantucket Drive, Mechanicsburg, Pennsylvania are about to execute contemporaneously herewith, a contract, with William H. Goodling Construction, Contractor, of 395 Alison Avenue, Mechanicsburg Pennsylvania, for the erection of a two-story residential dwelling upon a lot of land situate in Hampden Township, Cumberland County, Pennsylvania, being more fully bounded and described on Exhibit A attached hereto and made part hereof. NOW, ~,./-F'~~/ 7 , 2002, at the time of and immediately before the execution of the principal contract, and beYore any authority has been given by the said Owners to the said Contractor to commence work on the said building or purchase materials for the same in consideration of the making of the said contract with Contractor and the further consideration of one dollar, to Contractor paid by Owners it is agreed that no lien shall be filed against the building by the contractor, or any sub-contractor, nor by any of the material men or workmen or any other person for any labor, or materials purchased, or extra labor or materials purchased for the erection of said building, the right to file such liens being expressly waived. GOODLING CONSTRUCT[ON Contractor Print n~ne: ' ~/;~lCo-,r~ ~ Title: ~,..~eX.~ f--- {L0246101.1} EXHIBIT A ALL THAT CERTAIN piece, parcel or lot of land situate in Hampden Township, Cumberland County, Pennsylvania, and bounded and described as follows: BEGINNING at a point on the northern right-of-way line of Aspen Lane (50.00 feet wide), said point being located at the southeastern corner of Lot No. 108, thence along the eastern boundary line of Lot No. 108, North 01 degrees 29 minutes 45 seconds West, for a distance of 135.00 feet, to a point in line of other lands now or formerly of The McNaughton Company; thence along said lands of McNaughton, North 88 degrees 30 minutes 15 seconds East, for a distance of 107.00 feet, to a point at the northwestern corner of Lot No. 106; thence along the western boundary line of Lot No. 106, South 01 degrees 29 minutes 45 seconds East, for a distance of 135.00 feet, to a point on the northern right-of-way line of Aspen Lane (50.00 feet wide); thence along said right-of-way line, South 88 degrees 30 minutes 15 seconds West, for a distance of 107.00 feet, to a point and the place of BEGINNING. BEING known and numbered as Lot 107 on the Final Subdivision Plan for Westbury- Phase 6-A, which is recorded in Cumberland County Plan Book 83, page 122. BEING PART OF THE SAME premises which The McNaughton Company, a Pennsylvania corporation, by its Deed dated XT~tztt/a.~r~7, aTa~ and intended to be recorded simultaneously herewith in the Office of the Recorder of Deeds, in ~nd for Cumberland County, Pennsylvania granted and conveyed unto Judd M.
