ANDREWS, Plaintiff IN THE COURT OF COMMON PLEAS OF CUMBERLAND COUNTY, PENNSYLVANIA NO. 0'1-3(,0'1 {t;.J I~ vs. WILLIAM CHENOWETH, Defendant CIVIL ACTION - LAW COMPLAINT 1. Plaintiff is Carolyn M. Andrews (Andrews), an adult individual who resides at 80 Broadwell Lane, Mechanicsburg, PA 17055. 2. Defendant is William Chenoweth (Chenoweth), an adult individual who resides at 905 S. 29th Street, Camp Hill, PA 17011. 3. Defendant is an auctioneer licensed by the Pennsylvania State Board of Auctioneers and whose license number is Au002921L. 4. On December 31, 2002 Andrews and Chenoweth entered into a written contract, a copy of which is attached hereto as Exhibit "A", by the terms of whiCh Chenoweth agreed to remove all of the contents (whcih were suitable for auction) from Andrews' former home at 301 12'" Street, Lemoyne, PA and to sell same at an auction conducted by him. 5. The contract further provides that Chenoweth would be entitled to a 25% commission on the total sales derived therefrom. 6. Chenoweth, acting pursuant to the aforesaid contract proceeded to remove the voluminous contents of the Andrews former home to his auction house at 207 Walnut Alley, New Cumberland, Pennsylvania and/or to other locations unknown to Andrews. 7. A partial listing of the items removed is set forth on Exhibit "B", attached hereto. 8. Andrews believes, and therefore avers, that Chenoweth sold all of the items enumerated on Exhibit "B" within a few months after he took possession and removed same from Andrews' former home, but he failed to account to Andrews for the bulk of the items sold. 9. On the contrary, in May 2003, Chenoweth did account to Andrews, by sending her a check in the amount of $386.50. 10. The aforesaid accounting covered the items underlined on Exhibit HBlI. 11. Andrews on several and many occasions demanded that Chenoweth account to her for the balance of the articles of personal property removed by Chenoweth, but the latter has failed and refused to so account. 12. The total fair market value of the articles for which Chenoweth hasn't accounted for is $5,400.00. 13. By virtue of the foregoing, Chenoweth has converted to his own use, control and possession the articles of personal property which he removed as aforesaid and has failed to render an accounting to Andrews within a reasonable time. WHEREFORE, Plaintiff demands judgment against Defendant in the sum of $5,400.00, which is within the limits requiring compulsory arbitration in Cumberland County. YOFFE & YOFFE, P.C. BY"~~~ NORMAN M.
