Staudte and Great American Insurance Company Respondents Civil Action Law Settlement Approval Petition for Approval of Settlement in a death case involving a minor 1. Your Petitioner, Deborah L. Martin, is the parent of Holly N. Martin, a minor, with an address of 2718 Ritner Highway, West Pennsboro Township, Cumberland County, Pennsylvania. 2. The minor child, Holly N. Martin, was born on December 19, 1984. 3. Your Petitioner, Deborah L. Martin, is the widow of Galen Martin, deceased. 4. Your Petitioner, Lureye R. Martin, is the adult daughter of Galen M. Martin, deceased. 5. The Respondents are the Estate of Juergen H. Staudte and Great American Insurance Company. 6. Great American Insurance Company is a legal entity registered to do business within the Commonwealth of Pennsylvania. 7. On May 15, 1999, Galen Martin was killed in a private plane accident. At the time of his death he was married to Deborah L. Martin and had two children, Holly N. Martin and Lureye R. Martin. 8. There are no outstanding bills or creditors claims whose claims have not been paid. 9. The late Juergen Staudte was covered by a policy of insurance in the amount of $100,000.00. Said policy was issued by the Great American Insurance Company. 10. On the aforesaid date Juergen Staudte and Galen Martin were traveling in a private plane that was being piloted by Mr. Staudte. The plane went down in Tucumcari, New Mexico and both occupants were killed instantly. 11. Great American Insurance Company has agreed to pay the full policy amount of $100,000.00 for the wrongful death of Galen Martin. 12. The Petitioners have entered into a contingent fee agreement with counsel for the payment of a 33 1/3% contingent fee in the event of a recovery on their behalf. Counsel requests that said fee be reduced to 25% of said recovery for all money allocated to the children of Galen Martin. 13. At the request of the Petitioner, it is requested that $65,000 be allocated to Deborah Martin for the wrongful death of her husband pursuant to 42 Pa.C.S.A. § 8301. 14. It is requested that $17,500.00 be allocated to Deborah Martin as parent of Holly Martin, a minor, for the wrongful death of her father pursuant to 42 Pa.C.S.A. § 8301. 15. It is requested that $17,500.00 be allocated to Lureye Martin for the wrongful death of her father pursuant to 42 Pa.C.S.A. § 8301. 16. Your petitioners request the Court direct that Thirteen Thousand One Hundred Twenty Five Dollars ($13,125.00) be placed in a Federally Insured savings account or certificate of deposit, to be marked, "Not to be withdrawn until age 18 or further Order of a Court", in the name of Holly N. Martin. 17. Your Petitioners request the Court direct that Thirteen Thousand One Hundred Twenty Five Dollars ($13,125.00) be distributed to Lureye Martin. 18. Your Petitioners request the Court direct that Forty Three Thousand Three Hundred Thirty Four Dollars ($43,334.00) be distributed to Deborah L. Martin, individually. 19. Your Petitioners request the Court direct that $30,416.67 be paid to Douglas, Douglas & Douglas in attorney fees. 20. Your Petitioners further request that the Court direct that the Federally Insured Bank or Savings Institution be permitted to pay federal and state income tax on the income earned on behalf of the minor in the said account/accounts. The proceeds are to be divided as follows; Deborah L. Martin, individually $0,334.00 Lureye R. Martin $13,125.00 Deborah L. Martin, as parent of Holly $13,125.00 N. Martin, a minor Douglas, Douglas & Douglas $30,416.67 The proceeds of the settlement for the minor child are to be deposited in a federally insured savings account and/or certificate of deposit, marked "Not to be withdrawn until age 18 or further Order of a Court". All sums set forth above constitute damages on account of personal injuries, arising from the occurrence, within the meaning of § 104(a)(2) of the Internal Revenue Code of 1986, as amended. IT IS FURTHER ORDERED that the institution in which said funds are deposited is hereby granted permission to use such income from said funds that is necessary to pay income tax which may become due and payable as a result of the said funds being on deposit in their institution.
