AND NOW, this day o£April, 2001, cornes the Plaintiffby its attorney, N. Christopher
Menges, and t~les the following Complaint:
1. The Plaintiff is, Bennetton Sportsystern USA, Inc., f/k/a Prince Sports Group, a New
Jersey corporation, in the state of New Sersey, that is authorized to do business in the state of
Pennsylvania whose Principal address
9630. is One Sports System Plaza, Bordentown, New Jersey 08505-
2. The Defendants are, David Gonder and Lee Gonder, believed to be brothers, believed
to be owner-operator~ of World Cup Ski & Cycle individually, and dfo/a World Cup Ski & Cycle,
whose Principal address is 4500 Gettysburg Road, Mechanicsburg, Pennsylvania 17055.
3. Beginning on or about October 14, 1999 and ending on or about Decernber 10,
1999, the Defendants, did order and receive goods from the Plaintiff, which totaled the sum of
$3,887.56.
4. The Defendants accepted the goods of the Plaintiffas being acceptable and in the
ordinary course of business with an express or implied promise to pay therefor.
$. The Plaintiff maintained hooks ofaccoum, keeping an accurate running account of
all debits and credits for the services provided to the Defendants.
6. The Defendants owe the Plaint[ffthe amount of $3,887.56
plus interest at the legal rate o)'6% per annum ($3! 1.02 as of 4/23/01) on the past due balance on
said account as shown by statement of account, a copy of which is attached hereto, marked Exhibit
"A" and incorporated herein by reference.
7. Demand for payment on this account bas been made on 10/24/2000.
In spite ofthis demand, the Defendants have refused to pay said balance of $3,887.$6 plus interest
at 6 percent per annum.
WHEREFORE, Plaintiffdemands judgment against the Defendants in the sum of $3,887.56
plus interest of$311.02 as of 4/23/2001 (for a total of $4,198.58), plus interest continuing at 6%
until payment in full has been made, plus costs of suit. Pursuant to Pennsylvania Rule of Civil
Procedure 1021(c) in counties having rules governing compulsory arbitration the amount claimed
does not exceed the jurisdictional amount requiring arbitration referral by local rule of the county
which this was filed.
