AND NOW, COMES, Petitioner, Evelyn O'Hara, by and through her at[~rney, ·
Shaun E. O'Toole, and hereby petitions for adjudication of incapacity and appointment of
a plenary guardian of the estate and person of Virginia A. Nottingham, and in support
thereof, represents as follows:
1. The name of the alleged incapacitated person is Virginia A. Nottingham
(Mrs. Nottingham).
2. Mrs. Nottingham is eighty-seven (87) years of age and currently resides at
Messiah Village, a residential and long-term skilled nursing care provider, located at 100
Mt. Allen Drive, Mechanicsburg, Pennsylvania 17055.
3. Petitioner is the daughter of Mrs. Nottingham.
4. Mrs. Nottingham's husband, Dolby Nottingham, is eighty-four (84) years
old, resides at the family residence at 1830 Basin Hill Boulevard, Carlisle, Pennsylvania,
and is the sole intestate heir of Mrs. Nottingham.
5. Petitioner is the only child of Mrs. Nottingham's who resides in the
Commonwealth of Permsylvania. Mrs. Nottingham's other two children are a son,
Lowell M. Nottingham, who resides in New Haven, Vermont, and a daughter, A. Elaine
Hardy, who resides in Missoula, Montana.
6. Because of Mrs. Nottingham's complete incapacitation and inability to
handle her personal and financial affairs, a guardian of her estate and person is sought.
7. Attached as Exhibit "A" is an initial Evaluation prepared by Dr. Camilia
Popa, a psychiatrist with Philhaven, indicating that Mrs. Nottingham has Alzheimer's
disease and that her memory is severely impaired. The Initial Evaluation further
indicates that Mrs. Nottingham does not remember her date of birth, her husband's name,
or the number of children she has, and that she has a misperception of her environment
and a disorganized thought process.
8. Mrs. Nottingham has never executed a Power of Attorney and currently
does not have a guardian to handle her personal and financial affairs.
9. Petitioner's only source of income is her social security benefits which is
$536.67 a month.
10. All of Mrs. Nottingham's assets are jointly owned with her husband and
include checking and investment accounts totaling $282,400 and a residence with an
estimated value of $170,000.

12. To the best of Petitioner's knowledge, no other court within the
Commonwealth of Pennsylvania has appointed a guardian for Mrs. Nottingham.
WHEREFORE, Petitioner, Evelyn O'Hara, prays that Mrs. Nottingham be
ordered to show cause, if any there be, why she should not be declared an incapacitated
person and Evelyn O'Hara appointed y guardian of her estate and person.

1. A citation is awarded, directed to Virginia A. Nottingham to show cause
why she should not be adjudicated an incapacitated person and why a PLENARY
GUARDIAN of her person and estate should not be appointed; the hearing thereon to be
held in courtroom / , Cumberland County Courthouse, Carlisle, Pennsylvania

2. Petitioner shall cause to be served (by personal service) the Citation with
Notice and Petition, pursuant to the Provisions of 20 Pa.C.S. §551 l(a), upon the alleged
incapacitated person at least twenty (20) days prior to the court heating for the Plenary
Guardianship. The contents and terms of the Citation with Notice and Petition shall be
read and explained to the maximum extent possible in language and terms the alleged
incapacitated is most likely to understand, in accordance with the Provisions of 20
Pa.C.S. §551 l(a). An affidavit of service containing specific averments of the above
requirements shall be presented at the beginning of the court hearing.
3. At least twenty (20) days prior notice of the court hearing together with a
copy of the Petition shall be given personally or by first class mail to all persons residing
in the Commonwealth of Pennslvania who are sui juris and who would be entitled to an
intestate share in the estate of the alleged incapacitated person and to the institution
providing residential services to the alleged incapacitated person in accordance with 20
Pa.C.S. §5511 (a). An affidavit of service containing specific averments of the above
requirements shall be presented at the beginning of the court hearing.
4. Petitioner or counsel shall notify the court, in writing, at least seven (7)
days prior to the court hearing if counsel has not been retained on behalf of the alleged
incapacitated person in accordance with 20 Pa.C.S. §551 l(a). This notice shall also
contain all pertinent information which would indicate to the court whether or not
counsel should be appointed to represent the interest of the alleged incapacitated person.
5. The alleged incapacitated person shall be present at the court hearing
unless it is established by clear and convincing medical evidence that her physical or
mental condition would be harmed by her presence in court in accordance with the
provisions of 20 Pa.C.S. §551 l(a).

A petition has been filed with the Court to have you declared an incapacitated Person. If the
Court finds you to be an Incapacitated Person, your rights xvill be affected, including your right to
manage inoney and property and to make decisions. A copy of the petition which has been filed by
Evelyn O'Hara is attached.
You are hereby ordered to appear at a hearing to be held in Court Room No. 1_, Cumberland
County Courthouse, Carlisle, Pennsylvania, on October 4 ,200~4, at 1:30 P~M. to tell the
Court ~vhy is should not find you to be an incapacitated Person and appoint a Guardian to act on your
behalf.
To be an incapacitated Person means that you are not able to receive and
effectively evaluate information and communicate decisions and that you are unable to
manage your money and/or other property, or to make necessary decisions about where
you will live, what medical care you will get, or how your money will be spent.
At the hearing, you have the right to appear, to be represented by an attorney, and
to request a jury trial, lfyou do not have an attorney, you have the right to request the
Court to appoint an attorney to represent you and to have the attorney's fees paid for you
if you cannot aflbrd to pay them yourself. You also have the right to request that the
Court order that an independent evaluation as to your alleged incapacity.
If the Court decidcs that you are an Incapacitated person, the Court may appoint a
Guardian for you, based on the nature of any condition or disability and your capacity to
make and communicate decisions. The Guardian will be of your person and/or your
money and other property and will have either limited of full powers to act for you.
If the court finds you are totally incapacitated, your legal rights xvill be affected
and you xvill not be able to make a contract or gift of your money to other property. If the
court finds that you are partially incapacitated, your legal rights will also be limited as
directed by the Court.
If you do not appear at the hearing (either in person or by an attorney representing you)
the court will still hold the hearing in your absence and may appoint the Guardian requested.

OPINION and ORDER Of COURT
OLER, J., October 4, 2004.
At issue in the present case is whether Virginia A.
Nottingham should be adjudicated an incapacitated person, and, if
so, whether Evelyn O'Hara, her daughter, should be appointed
plenary guardian of her person and estate. A hearing was held on
this matter on Monday, October 4, 2004, before the undersigned
judge. At the hearing, the Petitioner, Evelyn O'Hara, was
represented by Shaun E. O'Toole, Esquire; the presence of the
allegedly incapacitated person was waived based upon a Sworn
Statement of Physician in Accordance with 20 Pa. C.S. Section
5511(a) (1) .
Based upon the evidence presented at the hearing, the
fellowing Findings ef Fact, Discussien and Order of Court are
made and entered:
FINDINGS OF FACT
1. The allegedly incapacitated person is Virginia A.
Nettingham, aged 87 {date of birth, January 15, 1917}, a married
weman who resides at Hessiah Village, 100 Mount Allen Drive,
Upper Allen Tewnship, Cumberland County, Pennsylvania.
2. Petitioner is Hs. Nottingham's daughter, Evelyn
O'Hara, an adult individual residing at 517 Mountain Road,
Boiling Springs, Cumberland County, Pennsylvania.
3. The allegedly incapacitated person, Virginia A.
Nottingham, suffers from dementia (probably of the Alzheimer's
type).
4. As a result of this condition, Ms. Nottingham is
an adult individual whose ability to receive and evaluate
information effectively and communicate decisions is impaired to
such a significant extent that she is totally unable to manage
her financial resources and totally unable to meet essential
requirements for her physical health and safety.
5. The aforesaid condition is apparently ef an
irreversible nature.
6. Based upon the aforesaid condition, the Court
finds it necessary to establish plenary guardianships with
respect to the estate and person of Hs. Nottingham.
7. In view of the absence efa more favorable
prognosis at this time, the duration ef the guardianships
required must be said to be indefinite, pending further Order of
Court.
8. Evelyn O'Hara, daughter of the allegedly
incapacitated person, who resides at 517 Hountain Road, Boiling
Springs, Cumberland County, Pennsylvania, is found te be a person
qualified under 20 Pa. C.S. Section 5511(f) to serve as plenary
guardian of Ms. Nottingham's person and estate.
9. The foregoing Findings of Fact are made on the
basis of clear and convincing evidence.
DISCUSSION
The provisions respecting an adjudication of
incapacity are contained in 20 Pa. C.S. Section 5501 et seq.
Petitioner has substantially complied with these provisions, and
based upon the foregoing Findings of Fact the following Order of
Court will be entered:

Nottingham resided at Messiah Village, a residential and long-term skilled nursing care facility
located at 100 Mt. Allen Drive, Mechanicsburg, Pennsylvania 17055.
(3) Major Medical or Mental Problems: As of October 4, 2004, Mrs. Nottingham
suffered from dementia, atrial fibrillation, high blood press'~e, GERD and hyperlipidemia.
(4) Description of Living Arrangements and Healthcare Services: As of October
October 4, 2004, Mrs. Nottingham was residing with a roommate in a room in the special care
community at Messiah Village. Around the clock nursing care is available to Mrs. Nottingham,
and she is examined by her tending physician on a monthly basis. The staffofMessiah Village
meets quarterly to discuss and evaluate each resident's care.
(5) Modification of Guardianship: There has been no modification in the
guardianship of Mrs. Nottingham since this Court's Order of October 4, 2004.
(6) Visits by Guardian: Guardian visits with Mrs. Nottingham, on average two to
three times a week.

(4) The present sources of income for Mrs. Nottingham are monthly social security payments of
$481.00 and the interest generated from the investments set forth in the Inventory.
(5) The regular monthly expenses of Mrs. Nottingham are her monthlybills from Messiah Village,
the long-term nursing care facility at which Mrs. Nottingham resides, which amount to about $6,000.00. This
expense is off-set by a long tern~ care insurance policy which pays one-half (1/2) of the cost of the nursing
(6) Guardian does not anticipate any extraordinary expenses on behalf of Mrs. Nottingham in the
next twelve (12) months.
(7) Mrs. Nottingham monthly social security benefits are deposited directly into her checking
account with PNC Bank (#51-4018-9143).
(8) Guardian has no out of the ordinary concerns about Mrs. Nottingham's physical or mental well
being or her finances.

(1) Evelyn O'Hara ("Guardian") was the plenary permanent guardian ofthe Estate of Virginia

** On June 24, 2005, Mr. and Mrs. Nottingham sold their home at 1830 Basin Hill Blvd., Carlis e,
Pennsylvania. Said sale netted $135,121.13 which was deposited into the Sovereign Bank decking
account stated above.
(4) As of the date of Mrs. Nottingham's death, her sources of income were monthly spcial
security payments of $481.00 and the interest generated from the investments set forth in the Inv ntory.

(5) As ofthe date of Mrs. Nottingham's death, her regular monthly expenses were he monthly
bills from Messiah Village, the long-term nursing care facility at which Mrs. Nottingham reside , which
amount to about $6,000.00. This expense was off-set by a long term care insurance policy whic paid
one-half(l/2) of the cost ofthe nursing care.
(6) Mrs. Nottingham's monthly social security benefits were deposited directly into he checking
account with PNC Bank (#51-4018-9143).
(7) Guardian was also the guardian of Mrs. Nottingham's person and her Repo for said
guardianship is filed herewith.
