THIS AGREEMENT made the
Contractor,
and between RALPH IACONO,
AND
James L.D. Monroe and Diane F. Monroe, hereinafter referred to as Owner, whereby the former
undertook and agreed to erect and construct a single family dwelling on that certain lot of ground situate
in
Lot #18 Maple Leaf Court, Mechanicsburg, Upper Allen Township, Cumberland, PA.
NOW THEREFORE, THIS AGREEMENT WITNESSETH: That the said Contractor, for and in
consideration of the sum of ($1.00) Dollar to contractor in hand paid by Owner, the receipt whereof is
hereby acknowledged, and the further consideration mentioned in the agreement aforesaid, for
themselves and their subcontractors, and all parties acting through or under them, covenant and agree
that no mechanic's liens or claims shall be filed or maintained by them or any of them against the said
buildings and the lot of ground appurtenant thereto for or on account of any work done or materials
furnished by them or any of them under said contract or otherwise, for, towards, in, or about the erection
and construction of the said buildings on the lot above described, and the said Contractor, for themselves,
their subcontractors and others under them hereby expressly waive and relinquish the right to have, rile,
and maintain any mechanic's liens or claims against the said buildings er any of them, and agree that this
instrument, waiving the right of lien, shall be an independent covenant.

ALL THAT CERTAIN tract or parcel of land being situate in Upper ~len Township and Lower
Alien Township, Cumberland County, Pennsylvania, more particularly bounded and described as
follows:
BEGINNING at a point on the southern right-of-way line of Maple Leaf Court, said point also
being a common property corner of Lot 17 and Lot 18 of the hereinafter referenced Final
Subdivision Plan; THENCE along the southern right-of-way line of Maple Leaf Court by a curve to
the left having a radius of 50.00 feet, an arc length of 19.33 feet, a chord bearing of North 26
degrees 58 minutes 56 seconds East and a chord length of 19.21 feet to a point; THENCE along
the same North 75 degrees 54 minutes 24 seconds East a distance of 83.80 feet to a point;
THENCE along the same by a curve to the right having a radius of 125.00 feet, an arc length of
18.94 feet, a chord bearing of South 80 degrees 14 minutes 51 seconds West and a chord length
of 18.92 feet to a point; THENCE along the same North 84 degrees 35 minutes 17 seconds East
a distance of 104.10 feet to a point; THENCE along the same by a curve to the right having a
radius of 25.00 feet, an arc length of 35.08 feet, a chord bearing of North 55 degrees 12 minutes
32 seconds West and a chord length of 32.27 feet to a point on the western right-of-way line of
Hart Crossing; THENCE along the western right-of-way of Hart Crossing by a curve to the left
having a radius of 275.00 feet, an arc length of 15.20 feet, a chord bearing of South 16 degrees
35 minutes 22 seconds East and chord length of 15.20 feet to a point; THENCE along the same
South 18 degrees 10 minutes 23 seconds East a distance of 142.12 feet to a point, said point
being a common property corner of said Lot 18 and Lot 46 of the hereinafter referenced Final
Subdivision Plan; THENCE along the northwestern boundary line of said Lot 46 South 71
degrees 49 minutes 34 seconds West a distance of 111.15 feet to a point, said point being a
common property corner of Lot 17 and Lot 18 of the hereinafter referenced Final Subdivision
Plan; THENCE along the northeastern boundary line of said Lot 17 North 50 degrees 04 minutes
56 seconds West a distance of 237.09 feet to a point, the point and place of BEGINNING.
THE FORGOING legal description is in conformance with the Phase I Final Subdivision Plan for
The Manor at Fair Oaks, dated April 22, 2002, last revised August 30, 2002, Project Number
210544 and is known as Lot #18, recorded in the Office of the Recorder of Deeds of Cumberland
County, Pennsylvania in Plan Book 86, Page 1.
UNDER AND SUBJECT to any and all conditions, restrictions, easements, rights-of-way,
agreements and covenants of record and that a physical inspection of the property would
disclose, including but not limited to a 50.00 feet wide Laurel Pipeline Right-of-Way and
Easement and a 50' Columbia Gas Transmission Right-of-Way, as shown on said Plan.
BEING THE SAME PREMISES which Rossmoyne Residential Associates, by deed to be
recorded simultaneously herewith in the Office of the Recorder of Deeds of Cumberland County,
granted and conveyed unto James L.D. Monroe and Diane F. Monroe.
