THIS AGREEMENT made this i~ day of July, 2004, by and
between FALCON HOMES, hereinafter referred to as Contractor,
~erald E. Paden and Donna E. Paden, husband and wife, hereinafter
referred to as Owner, whereby the contractor undertook and agreed
to erected and construct a dwelling on the certain lot of ground
situate in North Middleton Township, C~m~erland County,
Commonwealth of Pennsylvania, and more fully described in Exhibit
"A" which is attached hereto and made a part hereof known as Lot
~66RManada Creek Circle Carlisle, Cumberland County, PA.
NOW THEREFORE, THIS ~REEMENT WITNESSETH: That the said
Contractor, for an in consideration of the sum of ($1.00) Dollar to
Contractor in hand paid by Owner, the receipt whereof is hereby
acknowledged, and the further consideration mentioned in the
agreement aforesaid, for itself, himself or themselves and its, his
or their subcontractors, and all parties acting through or under
them, covenant and agree that no mechanic's liens or claims shall
be filed or maintained by them or any of them against the said
buildings and the lot of ground appurtenant thereto for or on
account of any work done or materials furnished by them or any of
them under said contract or otherwise, for, towards, in, or about
the erection and construction of the said buildings on the lot
above described, and the said Contractor, for itself, himself or
themselves, its, his or their subcontractors and others under them,
hereby expressly waive and relinquish the right to have, file, and
maintain any mechanic's liens or claims against the said buildings
or any of them, and agree that this instrument, waiving the right
of lien, shall be an independent covenant.

All that certain tract of land situated in North Middleton Township,
Cumberland County, Pennsylvania, more particularly bounded and described as
follows:
BEGINNING at a point on the northern right-of-way of Manada Creek
Circle, said point being the southwestern corner of Lot #65R; thence, along the
right-of-way by a curve to the right having a radius of 175.00', an arc length of
80.50' and a chord bearing of N 49°20'29" W with a chord length of 79.80' to
appoint; thence, along the same N 36~09'46'' W a distance of 7.58' to a point;
thence, along the same by a curve to the right having a radius of 175.00', an arc
length of 35.70' and a chord bear'mg of N 30°19'07" W with a chord length of 35.64'
to a point; thence, a long the intersection of Manada Creek Circle and Pine Creek
Drive by a curve to the right having a radius of 11.00' and arc length of 17.48' and a
chord bearing of N 21°03'03'' E with a chord length of 15.70' to a point; thence,
along the right-of-way of Pine Creek Drive by a curve to the left having a radius of
400.00', an arc length of 93.38' and a chord bearing of N 59°53'17" E with a chord
length of 93.17 to a, pomt, .thence, along Lot #67R S 36°48'OO" E a distanee of 97.48'
to a point; thence, along Lot # 65R S 40'28'51" W a distance of 94.94' to a point, the
place of BEGINNING.
