HomeMy WebLinkAbout04-3805 IN THE COURT OF COMMON PLEAS OF CUMBERLAND COUNTY INRE: CIVIL DIVISION Misc.2004-EQ- O'{. 3S'Ds" ~ 7:- ONE 1994 YAMAHA WARRIORATV VIN JY43 GDA04RA I 08965 PETITION FOR OWNERSIDP OF VEIDCLE AND NOW COMES the Petitioner, the Pennsylvania State Police ("PSP") as an agent of the Commonwealth of Pennsylvania, represented by and through its attorney, Assistant Counsel Daniel McGuire, from the Office of Chief Counsel, who respectfully requests that this Honorable Court issue an order authorizing the Commonwealth of Pennsylvania to take ownership of the above-referenced vehicle pursuant to Title 75 Pa.C,S,A. g7J05(b). In support hereof, the PSP avers as follows: 1. On June 20, 1995, one 1994 Yamaha Warrior ATV, Vehicle Identification Number ("VIN") JY43GDA04RAI08965, was reported stolen by Joseph Hydock, 8 South 19th Street, Pottsville, P A 17901. 2. On (or about) October IS, 2001, David Gettel, 9341 Rowe Run Road, Shippensburg, P A 17257, who subsequently came into possession of this vehicle, contacted Dane Colyer, Vehicle Fraud Investigator at PSP Carlisle, when he was unable to locate a VIN on the vehicle in order to register the vehicle with the Department of Conservation and Natural Resources, Thereafter, Mr, Colyer contacted Trooper Trent Hurley of the PSP Auto Theft Unit 3, On (or about) October 17, 2001, Trooper Hurley inspected the vehicle at PSP Carlisle. From a subsequent search of the National Crime Information Center ("NCIC") database and National Insurance Crime Bureau ("NICB") records, he was able to identify the VIN as JY43GDA04RA108965. The records further identified Foremost Insurance Company, Grand Rapids, MI, as the owner of the vehicle. 4. On (or about) October 27, 2001, Trooper Hurley identified the vehicle as stolen. To date, the vehicle remains on the impound lot at PSP Carlisle. 5, On (or about) November 2, 2001, Foremost Insurance Company was notified by Trooper Hurley of the vehicle's recovery. At that time, Foremost Insurance Company advised Trooper Hurley that it had paid Mr. Hydock's insurance claim in full and was the sole proprietor of the vehicle. 6. On November 2, 2001, February 19,2002 and March 19, 2002, Trooper Hurley faxed Notices of Motor Vehicle Recovery (Form SP7-0055) to Foremost Insurance Company to the attention of William Troxel, Claims Adjuster, which explained the procedure by which Foremost could claim the vehicle. 7. Trooper Hurley's ongoing investigation revealed that Mr. Gettel had acquired the vehicle from Rick Gilbert, 459 "B" Street, Carlisle, P A on August 22, 1996, Mr, Gilbert, in turn, had acquired the vehicle from Sterling Moyer, Pine Grove, PA on or about July 19, 1996, And Mr, Moyer had acquired the vehicle in an exchange with Bobby Weiss, Pottsville, PA prior thereto. 8. On August 22, 2002, Foremost Insurance Company returned the Notice of Motor Vehicle Recovery (Form SP7-0055) via fax to Trooper Hurley stating that the insurance company waived its proprietary interest in the vehicle. A copy of the signed Notice of Motor Vehicle Recovery (Form SP7-0055) is affixed hereto as Exhibit "A". 9. On March 4,2003, William Troxel executed an affidavit indicating that Foremost Insurance Company relinquished all rights in, and title to, the vehicle. A copy of William Troxel's affidavit is affixed hereto as Exhibit "B". 1 O. The current owner of this vehicle, Foremost Insurance Company, and the victim from whom this vehicle was stolen, Joseph Hydock, are being served with a copy of this petition as set forth in the attached Certificate of Service. WHEREFORE, Petitioner, Pennsylvania State Police, respectfully requests that this Honorable Court issue an order authorizing the Commonwealth of Pennsylvania to take ownership of the 1994 Yamaha Warrior ATV, VIN JY43GDA04RA108965, with the vehicle to be titled in the name ofthe Commonwealth of Pennsylvania. I,_BiII TROXEL , am an employee of Foremost Insurance Company, PO BOX 2739 Grand RapidsMI 49501. 2. The vehicle mentioned above had been reported stolen on June 20 1995, by Joseph HYDOCK, 8 South 19th St., Pottsville PA 17901 3. Foremost Insurance Company paid the victim for the insurance claim and now owns all rights to the above listed vehicle. 4. The Pennsylvania State Police contacted the Foremost Insurance Company on November 2, 2001 and advised that the vehicle had been recovered. At that time the Pennsylvania State Police faxed a Notice of Vehicle Recovery and a seven (7) page sample court order for Foremost Insurance Company to follow to claim the vehicle. 5. On February 19, 2002 the Pennsylvania State Police again contacted Foremost Insurance Company and spoke with Bill TROXELL and another Notice of '.. .. On August 22, 2002 the Pennsylvania State Police again contacted Foremost Insurance Company and spoke with Bill TROXELL who stated his company did not wish to take the necessary steps to recover the vehicle and advised the company wished to signed the vehicle over to the Commonwealth of Pennsylvania. A Notice of Vehicle Recovery was again faxed and was returned with a signature indicating no possessory interest from Foremost Insurance Company for the above listed vehicle. 7. Foremost Insurance Company voluntarily gives all title and interest in the vehicle to the Commonwealth of Pennsylvania and does not expect compensation of any kind. 8. Foremost'Insurance Company does not object to the Court of Common Pleas of Cumberland County, Pennsylvania entering an order allowing the Commonwealth of Pennsylvania, Pennsylvania State Police to obtain a Pennsylvania Certificate of Title and Vehicle Identification Number Plate for the said vehicle. (Copy of Petition and Certificate of Service are attached as PSP Exhibit "B"). 11. On August 6, 2004, Cumberland County Court of Common Pleas Judge Kevin A. Hess signed the PSP's rule to show cause. The rule was marked returnable twenty days after service. (Attached as PSP Exhibit "A"). 12. On (or about) October 15, 2001, David Gettel, 9341 Rowe Run Road, Shippensburg, P A 17257, who subsequently came into possession of this vehicle, contacted Dane Colyer, Vehicle Fraud Investigator at PSP Carlisle, when he was unable to locate a VIN on the vehicle in order to register the vehicle with the Department of Conservation and Natural Resources. Thereafter, Mr. Colyer contacted Trooper Trent Hurley of the PSP Auto Theft Unit. 3. On (or about) October 17, 2001, Trooper Hurley inspected the vehicle at PSP Carlisle. From a subsequent search of the National Crime Information Center ("NCIC") database and National Insurance Crime Bureau ("NICB") records, he was able to identify the .. · EXHIBIT I 'P-S'P" 8" VIN as JY43GDA04RA108965. The records further identified Foremost Insurance Company, Grand Rapids, MI, as the owner of the vehicle. 4. On (or about) October 27,2001, Trooper Hurley identified the vehicle as stolen. To date, the vehicle remains on the impound lot at PSP Carlisle. 5. On (or about) November 2, 2001, Foremost Insurance Company was notified by Trooper Hurley of the vehicle's recovery. At that time, Foremost Insurance Company advised Trooper Hurley that it had paid Mr. Hydock's insurance claim in full and was the sole proprietor of the vehicle. 6. On November 2,2001, February 19, 2002 and March 19,2002, Trooper Hurley faxed Notices of Motor Vehicle Recovery (Form SP7-0055) to Foremost Insurance Company to the attention of William Troxel, Claims Adjuster, which explained the procedure by which Foremost could claim the vehicle. 7. Trooper Hurley's ongoing investigation revealed that Mr. Gettel had acquired the vehicle from Rick Gilbert, 459 "B" Street, Carlisle, P A on August 22, 1996. Mr. Gilbert, in turn, had acquired the vehicle from Sterling Moyer, Pine Grove, PA on or about July 19, 1996. And Mr. Moyer had acquired the vehicle in an exchange with Bobby Weiss, Pottsville, PA prior thereto. 8. On August 22, 2002, Foremost Insurance Company returned the Notice of Motor Vehicle Recovery (Form SP7-0055) via fax to Trooper Hurley stating that the insurance company waived its proprietary interest in the vehicle. A copy of the signed Notice of Motor Vehicle Recovery (Form SP7-0055) is affixed hereto as Exhibit "A". 9. On March 4, 2003, William Troxel executed an affidavit indicating that Foremost Insurance Company relinquished all rights in, and title to, the vehicle. A copy of William Troxel's affidavit is affixed hereto as Exhibit "B". 10. The current owner of this vehicle, Foremost Insurance Company, and the victim from whom this vehicle was stolen, Joseph Hydock, are being served with a copy of this petition as set forth in the attached Certificate of Service.
