WHEREAS, Owner, with their principal address, 6318 Stephens Crossing, Mechanicsburg, Cumberland
County, Pennsylvania, is about to execute contemporaneously herewith, a contract, with W. LEE
ROLAND, Contractor, of 123 Windrush Lane, Mechanicsborg, Pennsylvania, for the construction and/or
erection of improvements for Lot 8 of Pinehurst Final Subdivision Plan Phase IVA, dated January 5,
1996; revised Ap. ri! 19, 1996, in Hampden Township, Cumberland County, Pennsylvania, more fully
described on ExhsbJt A attached hereto and made a part hereof.
NOW, this ~ day of ~. _, 2004, at the time of the execution of the
principal contract, and before any authority has been given by the said Owner to the said Contractor to
commence work on the said building or to purchase materials for the same in consideration of the
making of the said contract with Contractor and the further consideration of one dollar, to Contractor
paid by Owner it is agreed that no lien shall be filed against the building by the contractor, or any
subcontractor, nor by any of the material men or workmen or any other person for any labor, or materials
Purchased, or extra labor or materials purchased for the erection of said building, the right to file such
liens being expressly waived.
This Stipulation against Liens may be executed in counterparts, each of which shall be fully effective as
an original and all of which together shall constitute one and the same instrument.

ALL THAT CERTAIN tract of land situate In Hampden Township, Cumberland County, Pennsylvania, being Lot
No. 8 as shown on the Plan entitled Plnehurst Final Subdivision Plan Phase IV A, dated January 5, 1996, as last
revlsad April 19, 1996, and recorded In Cumberland County Plan Book 72, Page 25, more particularly bounded
and described as follows:
BEGINNING at an iron pin, lying in a northerly right-of-way line of Monterey Drive (50 foot right-of-way) and
being a northerly corner of Lot No. 9; thence along Lot No. 9, South 51 degrees 33 minutes 25 seconds West,
297.87 feet to an iron pin being a westerly comer of Lot No. 9 and lying In an easterly line of lands now or
formerly of Signal Hill Subdivision; thence along said lands, North 04 degrees 16 minutes 53 seconds West,
275.57 feet to an Iron pin lying in said line and being a wastorly corner of lands now or formerly of Pamay
Development Co., Inc., Future Phase IVB; thence along said lands, North 82 degrees 47 minutes 44 seconds
East, 217.38 feet to an iron pin lying in said line and lying In a westerly right-of-way line of Monterey Drive;
thence along the Monterey Drive right-of-way, along a curve to the left, having a chord bearing of South 18
degrees 06 minutes 29 seconds East, a chord distance of 122.95 feet, a radius of 325.00 feet, and an arc length
of 123.70 feet to an Iron pin; being the place of BEGINNING.
CONTAINING 1.070 acres
Lot No. 8 is subject to a wetland boundary area, being described as follows:
BEGINNING at a iron pin, being a westedy corner of Lot No. 9 and being a southerly comer of Lot No. 8 and
lying in an easterly line of lands now or formerly of The Signal Hill Subdivision; thence along said line, North 04
degrees 16 minutes 53 seconds West, 32.41 feet to a concrete monument, lying In said line; thence traversing
through Lot No. 8, South 86 degrees 21 minutes 40 seconds East, 40.01 feet to a concrete monument lying In a
southerly line of Lot No. 8 and lying In a northerly line of Lot No. 9; thence along said line, South 51 degrees 33
minutes 25 seconds West, 47.90 feet to an iron pin, being the place of BEGINNING.

recorded May 7, 1996, in Cumberland County Miscellaneous Book 519, Page 527.
