HomeMy WebLinkAbout04-3629 S TIP UL,4 TION.4 G,4INS T LIENS THIS AGREEMENT made the 21~t day of July, 2004, by and between RW Love Construction, Inc., hereinafier referred to as Contractor, and William R. Sangrey and Jo Ann B. Sangrey, husband and wife, hereinai~er referred to as Owner, whereby the former undertook and agreed to erect and construct a custom built home on that certain lot of ground situate at Lot 18 Sebastian Way, South Middleton Township, Cumberland County, Pennsylvania, known as more fully described in Exhibit "A" attached hereto and made a part hereof. NOW THEREFORE, WITNESSETH: That the said Contractor, for and in consideration of the sam of ($1.00) Dollar to Contractor in hand paid by Owner, the receipt whereof is hereby acknowledged, and the further consideration mentioned in the agreement aforesaid, for themselves and their subcontractors, and all parties acting through or under them, covenant and agree that no mechanic's liens or claims shall be filed or maintained by them or any of them against the said buildings and the lot of ground appurtenant thereto for or on account of any work done or materials furnished by them or any of them under said contract or otherwise, for, towards, in, or about the erection and construction of the said buildings on the lot above described, and the said Contractor, for themselves, their subcontractors and others under them hereby expressly waive and relinquish the right to have, file, and maintain any mechanic's liens or claims against the said buildings or any of them, and agree that this instrument, waiving the right of lien, shall be an independent covenant. Sangrey, husband and wife, known to me to be the persons whose names are subscribed to the within' instrument, and who acknowledge themselves to be the Owners of LOt 18 Sebastian Way, Carlisle, Pennsylvania and that they as such owners, executed the foregoing statement for the purposes therein contained by signing their names. E., dated January 29, 2002 and recorded in the Office of the Recorder of Deeds for Cumberland County in Plan Book 86, Page 112. BEGINNING at a point in western edge of rural residential land at corner of Lot No. 19; thence along Lot No. 19 South 72 degrees 59 minutes 1 $ seconds West 474.59 feet to a point; thence along LOt No. 19 and Lot No. 36 addition North 88 degrees 06 minutes 00 seconds West 511.28 feet to a point in eastern right of way line of State Route 34, Holly Pike: thence along SR 34 by a curve to the right having a radius of 11,459.19 feet, an arc distance of 352.17 feet on a chord bearing of North 00 degrees 4:5 minutes 30 seconds East to a point; thence along LOt No. 17 South 88 degrees :59 minutes 40 seconds East 881.67 feet to a point; thence along rural residential lane South 17 degrees 00 minutes 45 seconds East 266.88 feet to a point, the place of BEGINNING. CONTAINING 8.092 acres and designated as Lot 18, Phase II of Sunrise Meadows. 4
