HOBBS TO PROBATE The petition of David M. Kuchinos respectfully states that: f l- ~35~ 1. Petitioner is the son-in-law of Dorothy W. Hobbs who died on January 4, 2011. 2. At the time of her death, the decedent maintained her principal residence at 21p0 Bent Creek Boulevard, Mechanicsburg, Pennsylvania. 3. On November 9, 1989, Dorothy W. Hobbs executed her will (the "Will"), a copy of which is attached as Exhibit A. This Will was prepared by the decedent's attorney, John M. Crabbs, Esquire, at his client's request; its execution was witnessed by the said attorney and by his then secretary, Mary Lee Blasius; and it named Petitioner as executor. 5. Immediately after the execution of the Will, a photocopy was made and was placed by John M. Crabbs in his files, and on information and belief, and as noted at the top of Exhibit A, the original Will was taken by Dorothy W. Hobbs to Peoples State Bank, East Berlin, Pennsylvania, and placed in a safe deposit box. 6. Petitioner has contacted Susquehanna Bank, the successor to Peoples State Bank, East Berlin Branch, and has been advised that no safe deposit box is maintained at that bank in the name of Dorothy W. Hobbs and it is unable to locate the Will. 900200.00001/21974643v.1 1 W~ .--~ LAST WILL AND TESTAMENT I, DOROTHY W. HOBBS, of East Berlin, Adams County, Pennsylvania, hereby make, publish and declare this to be my Last Will and Testament, hereby revoking any and all Wills and Codicils by me at any time heretofore made. FIRST: I direct that all my just debts and funeral expenses be paid as soon after my decease as may be practicable. SECOND: All the rest, residue and remainder of my estate, of every nature and wheresoever situated, I give, devise and, bequeath unto my children Nancy, Joan, Barbara, Hollg and April, in equal shares, share and share alike. THIRD: In the event that any of my daughters should predecease me, then, and in that event, I leave her share to her issue, per stirpes and not per capita. AND. LASTLY, I nominate, constitute and appoint m~ son-in-law, David Kuchinos, as Executor of this, my Lpst Will and Testament. I direct that my Executor shall not e required to post a bond in any court for the faithful performancelof duty, whether a resident or nonresident of this state or fob any other reason.
